As the autonomy of local government reaches land and sea, there should be boundaries in land as well as in sea between two local governments. However, while the land boundaries are relatively clear, the maritime boundaries are unclear sofar. To make matters worse, there is no explicit regulation for maritime boundaries. Therefore, whenever a dispute over maritime boundaries between two local governments happens, they have no choice but to file an competence dispute in the Constitutional Court of Korea for maritime delimitation. The Constitutional Court made a decision that ‘if the regulation on maritime boundaries does not exist, the Court should follow the customary law on maritime boundaries. And if the customary law does not exist either, then the Court should render a maritime delimitation according to the equitable principle’[2010hun-ra2 (July 30th, 2010)]. According to the decision, the Constitutional Court should make a maritime delimitation in accordance with the ‘equitable principle’, due to no explicit regulation and customary law in most of the cases. However, the ‘equity’ is a very comprehensive and ambiguous concept. It presents only the goal of equity, instead of presenting any contents and specific standards. So it causes problems of uncertainty as well as unpredictability. In order to develop and materialize the legal principle for maritime delimitation, the Court decided to apply the ‘equidistance/median line principle’ first, and then adjust the line through taking ‘the natural condition of geography and the convenience of residents’ into consideration so as to satisfy the ‘equitable principle’[2016hun-ra8 (April 11th, 2019)]. This is certainly a step forward from the past, but it still reveals its limit when an island of one local government is located near the equidistance/median line between the two local governments mainlands. If the Court includes the island into the base point, the maritime boundary will shift to the equidistance/median line between the island and the other s mainland. As a result, there is a high risk of extreme downscale of maritime area for the other local government as well as its cut-off effect. On the contrary, if the Court excludes the island from the base point, much of the maritime area around the island will belong to the other local government. As a result, the socio-economic benefits of its residents will decline dramatically. However, this awareness of the problem is not only limited to Korea. As the ‘United Nations Convention on the Law of the Sea(UNCLOS)’, which is applied to the delimitation of maritime boundaries between nations, declares the equitable principle and the equidistance/median line principle as well, the ‘International Court of Justice(ICJ)’ and the ‘International Tribunal for the Law of the Sea(ITLOS)’ have the same awareness of the problem when it comes to apply those principles. Through the countless trials and errors, the ICJ announces the ‘three-stage approach’ at the maritime delimitation judgement on Black Sea(February 3rd, 2009; Romania v Ukraine). In the first stage, the Court draws a provisional equidistance/median line. In the second stage, the Court reviews the relevant circumstances which call for the adjustment of the line. In the third stage, the Court checks the ratio of relevant coast and the ratio of relevant maritime area whether there is an grave disproportionality which creates an inequitable result. After the ICJ s judgement, the ITLOS introduces the ‘three-stage approach’ into its maritime delimitation judgement on Bay of Bengal(March 14th, 2012; Bangladesh v Myanmar). And the ICJ repeats the approach into its maritime delimitation judgement on Caribbean Sea(November 19th, 2012; Nicaragua v Columbia). In the end, the ‘three-stage approach’ has become the epitome of the maritime delimitation between nations.
더보기지방자치단체의 자치권이 미치는 구역에는 육상과 해상이 포함되므로, 지방자치단체 사이에는 육상의 경계뿐만 아니라 해상의 경계도 존재한다. 그러나 육상경계는 비교적 명확하였음에 반하여 해상경계는 그동안 불명확하였고, 관련법령에도 해상경계에 대한 명시적 규정은 없었기에, 지방자치단체들은 해상경계에 관한 분쟁이 발생하면 헌법재판소에 권한쟁의심판을 청구하게 되었다. 이에 헌법재판소는, 지방자치단체의 해상경계에 관한 법령상 규정이 존재하지 않는다면 관습법상 해상경계에 따라야 하고, 이마저도 존재하지 않는다면 형평의 원칙에 따라 해상경계를 획정할 수밖에 없다고 판단하였다(헌재 2015. 7. 30. 2010헌라2 결정). 이러한 법리에 따라 성문법상・관습법상 해상경계를 확인할 수 없는 대부분의 경우에는 헌법재판소가 ‘형평의 원칙(equitable principle)’에 따라 해상경계를 획정하게 되는데, 이때 ‘형평’이란 포괄적이고 모호한 개념으로서, 형평에 도달해야 한다는 목표만 제시할 뿐 어떠한 구체적 내용과 기준을 제시하지 않기 때문에, 불확실성과 예측불가능성의 문제를 초래하였다. 이에 헌법재판소는 형평의 원칙에 따른 해상경계 획정 법리를 발전시키기 위하여, 먼저 등거리・중간선 원칙(equidistance/median line principle)을 적용(apply)한 다음, 지리상의 자연적 조건과 주민 편익을 고려하여 이를 사후적으로 조정(adjust)하는 방식으로, 해상경계를 획정하게 된다(헌재 2019. 4. 11. 2016헌라8등 결정). 이는 분명 과거보다 진일보된 방식이었으나, 양 지방자치단체 사이의 등거리・중간선 위치에 일방 관할의 섬이 존재할 경우 그 한계를 드러내게 되었다. 만약 섬을 등거리・중간선의 기점에 포함시킨다면 그 섬과 상대방 육지의 등거리・중간선으로 해상경계가 획정될 것이어서 상대방 지방자치단체의 관할해역이 크게 수축되거나 닫힐 위험성이 있고, 이를 우려하여 섬을 기점에 포함시키지 않는다면 섬 주변해역의 상당부분은 상대방 지방자치단체의 관할에 귀속될 것이어서 섬 주민들의 사회・경제적 편익은 크게 훼손될 수밖에 없기 때문이다. 그런데 이런 문제의식은 비단 우리나라에 국한된 것은 아니다. 국가 간의 해상경계 획정에 적용되는 ‘해양법에 관한 국제연합 협약(UNCLOS)’은 등거리・중간선 원칙과 형평의 원칙을 선언하고 있기에, 이를 구체적 사건에 적용해야 하는 국제사법재판소(ICJ)와 국제해양법재판소(ITLOS)의 경우에도 우리 헌법재판소와 동일한 고민을 할 수밖에 없었다. 이에 국제사법재판소는 ‘2009. 2. 3. 흑해 해상경계 결정’에서 ‘3단계 접근방식(three-stage approach)’을 선언한다. 1단계에서 잠정적인 등거리・중간선을 획선하고, 2단계에서 그 조정을 요하는 관련 상황이 있는지 검토한 다음, 3단계에서 관련 해안선과 해역의 비율을 통해 현저히 형평에 반하는 결과가 있는지 확인하는 것이다. 이후 국제해양법재판소가 ‘2012. 3. 14. 벵갈만 해상경계 결정’에서 이를 도입하고, 다시 국제사법재판소가 ‘2012. 11. 19. 카리브해 해상경계 결정’에서 이를 반복함으로써, 3단계 접근방식은 해상경계 획정의 전형으로 자리잡게 되었다. 그리고 이들 재판소는 등거리・중간선 상에 존재하는 섬의 문제를 해결하기 위하여, 위와 같은 단계를 거쳐 섬의 효과를 모두 인정 또는 배제하거나, 섬에 가중치를 부여하는 등으로 형평에 부합하는 결론을 도출하기 위해 노력하였다. 물론 국제법을 근거로 국가 간 영해・배타적경제수역・대륙붕의 경계를 획정하는 국제 재판기관의 결정이, 국내법을 근거로 지방자치단체 간 관할해역의 경계를 획정해야 하는 헌법재판소의 권한쟁의심판에 그대로 적용될 수는 없을 것이다. 그러나 국내법적으로 지방자치단체 사이의 해상경계 획정에 적용할 실체법이 없는 현실에서, ‘형평의 원칙’을 매개로 하여 국제 재판소의 고민과 결론을 헌법재판소 권한쟁의심판에 적용하기 위해 연구하는 것은 여전히 중요한 의미를 가진다.
