In 2016, the Korean Court suggested a ‘New Assessment Model for Non-pecuniary Damages,’ which increases its cap and considers various factors of the perpetrators and the victims of a tort. However, the research about this new model is not yet sufficient. The assessment of non-pecuniary damages is pertinent not only to its methodology but also to the essence and function of non-pecuniary damages.
Unlike the Supreme Court of the Republic of Korea, the Canadian Supreme Court has been understanding the function of non-pecuniary damages only as providing solace instead of as a compensation or deterrence. This difference makes it difficult for the Korean court to adopt Canadian approach, but at the same time, it offers a chance to take a different view of non-pecuniary damages. Indeed, this view of the Canadian Supreme Court has influenced the United States as well as Commonwealth countries.
The Supreme Court of Canada recognizes the various types of non-pecuniary losses. In particular, in the case of bodily damage, items of damages are categorized into, for example, loss of the amenities of life, reduction of life expectancy and pain, in an effort to deduct appropriate amount of non-pecuniary damages.
Moreover, Canadian law aims to provide victims with money which they could exchange for services that could give them new joys of life, under the premise that the victims’ non-pecuniary damages cannot be evaluated in terms of monetary value. It draws a specific amount of non-pecuniary damages that can provide solace to the victims depending on by figuring out the judicial awards in previous cases, and adjusting it to serve the individual needs of the victims.
The Canadian Court set the upper ceiling of non-pecuniary damages in a case of bodily damages at CAD 100,000 in January, 1978, and adjusts the specific amount by taking into account victims’ individual circumstances and inflation. The court is able to ensure the uniformity of non-pecuniary damages nationwide, and predictability.
One of the relevant factors taken into consideration in the victims’ individual circumstances is a victims’ age. The newly proposed model for non-pecuniary damages by the Korean court in 2016 increases the amount of non pecuniary damages in a case of a child victim. Canada takes a step further, and actively reflects the ages factor in determining the amount of non-pecuniary damages. Furthermore, in Canada, rather than simply relating work disability rating (WDR) and non-pecuniary damage, such factors as the lifestyle led by a victim and his demeanor are taken into account in determining the amount of non-pecuniary damages, in addition, such factors as infertility, leisure, and breast-feeding ability are also considered in calculating non-pecuniary damages.
The way one understands the essence of non-pecuniary damages is related to the assessment of the awards. The Canadian court’s approach for non-pecuniary damages focus more on the specific and individual circumstances of the victims, while at the same time, pursuing uniformity and predictability. The Korean court has a lot to learn from this functional approach of the Canadian court.
