1948년 세계인권선언이 채택된 지 50여년이 지난 현재, "인권"이라는 화두는 더 이상 국내 차원의 문제로 취급해서는 안 될 전 인류가 지향해야 하는 보편타당한 목표로 자리잡게 되었다. 이러한 가운데 한 국가의 인권 침해를 이유로 최근 빈번하게 발동되고 있는 다른 국가(들)의 경제 제재가 과연 국제법상 적법한지의 여부가 문제되고 있다.
국제법상 강행규범의 지위를 획득한 인권 규정은 그 무엇과도 대체될 수 없는 강제적 규범이며, 국가는 이러한 규범하의 의무를 지속적으로 회피할 수 없으며, 이는 조약 및 국제관습법상의 원칙에 우선한다. 그러나 한 국가가 보편타당한 강행규범으로서의 성격을 지닌 인권을 준수하지 않는 경우, 어떠한 조치가 강구되어야 할 것인가? 이 논문은 이에 대한 방안으로 경제 제재가 적법한지 여부를 살펴보았다.
경제 제재가 일으키는 문제는 특정 국가의 주권을 침해하는 것 - 전통국제법과 유엔 헌장에 의해 보호되는 원칙, 즉 순수한 국내 문제에 있어 다른 국가의 간섭으로부터 자유로울 권리를 인정하는 원칙 - 이 아닌가에 있다. 유엔총회는 특정 국가의 심각한 인권상황을 개선하기 위해 필요한 조치, 특히 경제·외교 제재를 취하도록 회원국들에 대해 권고할 수 있다. 이는 총회가 인권개선을 효과적으로 실시·강제할 수 있는 가장 실효적인 수단이라 할 수 있다. 또한 유엔안전보장이사회도 평화에 대한 위협, 평화의 파괴, 또는 침략행위의 존재를 결정하고, 아울러 국제평화와 안전을 유지 또는 회복하기 위하여 권고를 하거나 군사적 또는 비군사적 강제조치를 취할 수 있다. 또한 개별 국가 차원에서 제재를 취할 수도 있는데, 주로 미국이 이 분야에 있어 가장 활발한 활동을 보여주었다.
경제 제재는 기본권을 준수하도록 하기 위한 초국가적 노력의 견지에서 볼 때 틀림없이 중요한 무기이며, 실질적 행동 수정의 가능성을 보유하고 있다. 제2차 세계대전 이후 Gary Hufbauer와 Jeffrey Schott의 제재에 관한 포괄적 연구 보고서는 미국의 조치들이 Idi Amin의 우간다, Somoza의 니카라과, 1977년과 1984년 사이의 브라질의 인권을 개선하는 데 있어 상당히 효과적이었음을 보여 주고 있다. 물론 이러한 경제 제재를 비판하는 사람들은 다른 국가의 문제에 대한 경제 간섭은 국내문제불간섭원칙과 영토 관할권에 관한 국제법상의 원칙들을 위반하는 것이라고 주장하며, GATT/WTO의 무역자유화에 관한 원칙들과도 충돌할 수 있다고 본다.
그러나 경제 제재는 분명히 피제재국의 정치 운영에 인권이라는 관심사를 환기시킴으로써 인권 준수를 국내법상의 원칙으로 수용하는 데 기여한다.
이러한 경제 제재의 대표적인 사례로 미얀마 정부는 인권과 관련한 중요한 조치들을 채택하였다. 우선 6년 동안 가택 연금상태에 있던 아웅산 수지 여사를 석방시켜 주었고, 또한 주요한 인권 관련 조약들에 서명한 바 있다.
한편, 오늘날 국제관계에서 경제강국이 자국의 특정한 국가정책 및 이익을 추구하기 위한 수단으로서 경제적인 강제 및 간섭수단을 빈번히 사용하고 있는 것도 사실이다. 이른바 경제적 강제는 무력의 행사 및 위협이 불법화된 현대 국제법 체제 하에서 분쟁당사국에 의해 선호되는 효과적인 간섭수단 및 분쟁해결수단으로 기능하고 있다. 그러나 경제 강국들의 경제 제재 조치가 인권 개선을 위한 일련의 과정에 있어 중요한 역할을 수행하였음은 부인할 수 없는 사실이다. 그럼에도 불구하고 경제 강국들의 자국이익의 논리만을 앞세운 무분별한 경제 제재 또한 지양되어야 할 것이다. 결국 가장 효과적인 방안은 국제공동체 전체가 인권의 보편성과 중요성을 깨닫고, 인권침해 사례에 대해 일관되게 공동으로 대처해 나가는 것이라고 보여진다.
최근 WTO 분쟁해결제도를 통한 Shrimp/Turtle Ⅰ&Ⅱ와 Asbestos 사건의 판결은 한 국가가 다른 국가의 환경 문제를 개선시키기 위한 경제 제재를 인정한 바 있다. 이러한 판결은 상당히 고무적이며, 앞으로 GATT/WTO 체제 하에서 한 국가의 인권 침해를 이유로 한 다른 국가(들)의 경제 제재와 관련된 분쟁 해결에 있어서도 시사점을 제시해준다고 보여진다.
Since the adoption of Universal Declaration of Human Rights in 1948, "Human Rights" which can no longer be taken as domestic matters are now regarded as universal objects that all humankind should seek for. The question is whether recent economic sanctions which are frequently taken in cases of human rights violation are lawful in international law.
Certain human rights standards that have achieved the status of jus cogens under the classic international law are considered peremptory norms which cannot be substituted and prevail over all other rules of treaties and customary international law, and therefore states are not supposed to evade persistently their obligations under these norms. Where one state, however, does not respect human rights having universal character as jus cogens, which measures should we take? This article examined the legality of economic sanctions as the solution to it.
The question raised by economic sanctions is whether they violate the sovereignty of the target state - a principle protected by both Charter of the UN and the classic international law, which recognizes the states' right to be free from other state's intervention in purely domestic matters. UN General Assembly may recommend member states to take necessary measures, especially economic?diplomatic sanctions in order to improve target state's serious human rights situation. This can be the most effective way which General Assembly can implement and coerce human rights improvement effectively. UN Security Council shall also make recommendations or take military or nonmilitary coercions in order to maintain and restore international peace and security as well as determine the existence of any threat to the peace, breach of the peace, or act of aggression. In addition, sanctions may be taken on the individual state level, and the US especially has been the most active player in this field.
Economic sanction is an important weapon in international efforts to promote respect for fundamental rights, and has an essential possibility to change behavior. Since the Second World War, Gary Hufbauer and Jeffrey Schott's study on sanctions shows that the US sanctions were effective to promote human rights in Idi Amin's Uganda, in Somoza's Nicaragua, and in Brazil between 1977 and 1984. Of course, critics of economic sanctions argue that the economic intervention in another state's affairs violates principle of non-intervention and the principle relating to territorial jurisdiction, and that it may conflict with the GATT/WTO free trade principles.
But economic sanctions would certainly contribute to incorporating human rights respect into one state's domestic law by calling the sanctioned state's attention to human rights in political activities.
As an important example of economic sanctions, Myanmar government took significant measures concerning human rights. First it set free Aung San Suu Kyi from house arrest for 6 years, and it ratified important human rights conventions.
Meanwhile, today developed countries in the international relations make frequent use of economic coercion and intervention as means of seeking their own specific policy and benefits. In other words, the economic coercion functions as an effective way of intervention and of dispute settlements among the dispute parties under modern international law in which act or threat to force is unlawful. But it is an undeniable fact that economic sanctions of developed countries play an important role in the course of human rights promotion. Nevertheless, imprudent use of economic sanctions directed at their own benefits should be still disapproved. To conclude, the most effective way is that the whole international community recognizes the universality and the importance of human rights and that it together responds consistently to human rights violations.
The recent findings of Shrimp/Turtle Ⅰ&Ⅱ case and Asbestos case recognize one state's economic sanctions to improve other state's environmental matters. These findings are very encouraging, and give future suggestion in the dispute settlements relating to other state(s)' economic sanctions against one state's human rights violations under the GATT/WTO system.
