형법 제13조 ‘고의(故意)’개념의 재해석과 적용문제 = Reinterpretation and application of the concept of ‘Criminal intent’ in Article 13 of the Criminal Law

형법 제13조는 ‘고의’에 관한 규정이다. 최근 형법 조문이 일부 변경되었지만, 여전히 고의(故意)개념은 명확하지 않다. 그리고 제13조의 단서 조항은 고의범 처벌의 원칙과 과실범의 예외적 처벌에 대한 명확한 경계도 없이 과실범의 예외적 처벌만을 규정하고 있을 뿐이다. 물론 제14조에서 과실의 개념을 규정하고 있지만, 사실상 과실범의 예외적 처벌을 구체화한 것으로서 제13조의 단서 조항을 부연하고 있는 것에 불과하다. 그래서 형법 제13조는 고의와 과실의 개념을 함께 규정하고 있는 것으로 볼 수 있다. 그러나 형법 제13조는 범죄성립의 구체적 개념을 규정하고 있는 것이 아니라 범죄성립의 요소 혹은 요건으로서 고의 아니면 과실이라는 이분법적 논리에 입각한 추상적 개념만을 규정하고 있을 뿐이다. 그래서 현재까지도 형법학계와 형사실무(법조계)에서는 고의의 성부와 관련하여 항상 논란이 제기되는 미필적 고의와 인식 있는 과실의 구분기준에 대하여 명확한 결론을 도출하지 못하고 있다. 사실 이러한 문제점은 향후 AI시대를 맞이하여 AI와 관련된 인간의 범죄행위에 대한 형사처벌의 흠결을 야기할 수도 있을 것이다.
이에 따라서 필자는 고의개념의 적용문제에 대하여 형사실무에 유용한 단초를 제공하고자 기존에 논의된 고의개념의 본질과 해석을 재검토하였으며, 그 결과 주된 인식과 이에 부수된 종된 의적 요소에 의하여 고의개념이 완성된다고 파악되는 신인식설(新認識說)이 타당하다고 생각된다. 즉 형사실무에서 신인식설에 따라 고의개념을 추론하여 적용하는 것이 타당하며, 이러한 신인식설은 향후 AI시대에 AI와 관련된 각종 신종범죄의 해석과 적용에 있어서 매우 합리적인 방안이 될 수 있다. 왜냐하면 아무리 AI시대라 하더라도 AI는 결코 인간과 동등한 인격체가 될 수 없으며, 오로지 주된 인간과 이에 부수된 종된 AI의 관계로 정립되는 것이 헌법적 가치에도 부합하기 때문이다. 따라서 AI시대를 맞이하여 AI와 관련된 각종 신종범죄에 대한 합리적인 형법의 해석과 적용을 위하여 신인식설에 입각하여 고의개념을 재구성하는 것이 미래지향적 형법적용의 방향성으로서 타당하다고 할 것이다. 이에 따라 다음과 같이 형법 제13조(고의)에 대하여 “죄의 성립요소인 사실을 인식하지 못하여 그 실현을 의욕하지 아니한 행위는 벌하지 아니한다. 다만, 법률에 특별한 규정이 있는 경우에는 예외로 한다.”라고 고의개념을 구체화하여 명확하게 적시하는 입법론을 제안하고자 한다.
Article 13 of the Criminal Law is about “criminal intent”. Although there have been some recent changes to the Criminal Law, the concept of intent remains unclear. Furthermore, the provisos in Article 13 only provide for exceptional punishment for negligent offenders, without a clear distinction between the principle of punishing intentional offenders and exceptional punishment for negligent offenders. Of course, Article 14 defines the concept of negligence, but in fact, it definitizes the exceptional punishment of negligent offenders and is only a reference to Article 13. Therefore, Article 13 of the Criminal Law can be seen as a combination of the concepts of criminal intent and negligence. However, Article 13 of the Criminal Law does not stipulate a specific concept of criminalization, but only an abstract concept based on the dichotomous logic of criminal intent or negligence as an element or requirement of criminalization.
Accordingly, to date, criminal law scholars and criminal procedure practitioners have not been able to draw a clear conclusion on the distinction between gross negligence and willful negligence, which is always controversial regarding the nature of intent. In fact, this problem may lead to deficiencies in criminal punishment for human criminal behavior related to AI in the future AI era. Therefore, in order to provide a useful basis for criminal practice on the application of the concept of intention, I reviewed the nature and interpretation of the concept of intention previously discussed, and as a result, I believe that the new cognition theory, which identifies that the concept of intention is completed by the main cognition and the subordinate intentional elements, is valid. In other words, in criminal procedure practitioners, it is appropriate to infer and apply the concept of intent according to the new theory, and this new theory can be a very reasonable way to interpret and apply various new crimes related to AI in the era of AI. This is because even in the age of AI, AI can never become a person equal to humans, and it is in line with constitutional values to establish the relationship between the main human and the subordinate AI. Therefore, it is appropriate as a direction of future-oriented criminal law to reconstruct the definition of criminal intent based on the new theory for reasonable interpretation and application of criminal law to various new crimes related to AI in the age of AI. Accordingly, Article 13 (“Intent”) of the Criminal Law reads as follows: “An act shall not be punished if the person does not recognize the fact that is an element of the crime and does not intend to realize it. However, exceptions shall be made in cases where there are special provisions in the law.” We would like to propose a legislative theory that clearly states the concept of intent.
