디지털 플랫폼 콘텐츠 창작 노동자에 대한 젠더 이슈 사상검증이 미치는 영향과 법적 대응에 관한 연구 : 웹툰, 웹소설, 일러스트 영역을 중심으로 = The Impact of Ideological Vetting about Gender Issues on Digital Platform Creative Workers and Suggestion of Legal Action against Ideological Vetting: in Webtoon, Webnovel, and Illust Industries

2016년경 게임사들은 소비자들이 일러스트레이터의 사상에 대해 항의한다는 이유로 작업물을 삭제하거나 계약을 해지하였다. 이와 같은 ‘사상검증’은 점차 웹툰ㆍ웹소설 작가들에게까지 확대되었으며 현재진행형이다. 그러나 아직 디지털 플랫폼의 창작 노동자에 대한 사상검증이 어떻게 진행되었고 진행되고 있는지, 그것이 이들의 노동환경과 작업과정, 작업의 결과물에 어떤 영향을 미쳤는지에 대한 충분한 연구가 이루어졌다고 보기는 어렵다. 이에 본 연구는 디지털 플랫폼에서 콘텐츠를 제작, 게시하는 창작 노동자들을 향해 이루어지고 있는 젠더 이슈에 관한 사상검증의 실태를 조사하고, 사상검증의 경험과 인식이 노동과정과 결과물, 노동환경에 어떠한 영향을 미치는지 밝히고자 하였다. 디지털 플랫폼 산업에 대한 문헌 연구와 심층 면접을 통한 현상학 연구를 병행하였으며, 심층 면접 대상자는 눈덩이 표집법(snowballing)으로 모집한 웹툰 작가, 웹소설 작가, 일러스트레이터, 창작 노동 관련 활동가 등 총 21명이었다. 사상검증으로 인한 자기검열을 직접적으로 경험하였다고 응답한 15인의 면접자 중 SNS 사용을 중단하거나 창작과정에서 특정 표현이나 내용을 포기한 경우도 있었다. 사상검증의 방식은 SNS 등에서의 사이버불링, 댓글을 통한 공격, 사측 등으로부터의 작업 개입, 업무 배제 등이 대표적이었다. 면접자들 중 15명이 사상검증으로 인한 자기검열을 경험하고 있다고 보고했는데, SNS 사용을 중단하거나, 창작과정에서 특정 표현이나 내용을 포기하기도 하였다. 연구 결과, 디지털 플랫폼 콘텐츠 산업의 경우 일감 배분 권력을 가지고 있는 플랫폼이 우월적 지위에 있어 창작 노동자는 그로 인한 불안정함을 느끼고, 끊임없이 시장성에 대한 고민을 할 수밖에 없어 사상검증으로 인한 영향이 크다는 것을 확인하였다. 또한 게임 업계와 웹툰ㆍ웹소설 업계에 내재된 업계 내 성차별도 사상검증의 영향력을 강화하고 있음을 확인하였다. 본 연구에서는 연구 결과를 토대로 창작 노동자들의 계약 형태에 따라 「근로기준법」을 활용하거나, 「공정거래법」, 「국가인권위원회법」 등을 활용하여 사상검증에 대응할 수 있는 법적 방안을 제시하였다. 나아가 본질적인 해결을 위하여는 디지털 플랫폼 콘텐츠 창작 노동자들의 플랫폼에 대한 경제적 종속성을 낮추고, 예술인으로서의 보호나 차별금지법(평등법)의 제정이 필요함을 제언하였다.
더보기In 2016, some game development companies deleted the works and even terminated the contracts with a number of illustrators in that consumers had complained about ideologies personally held by those illustrators. The on-going ideological witch hunt of the gaming industry has spread to illustrators and webtoon artists outside the gaming industry. However, researches about how this ongoing ideological vetting against creative workers working on digital platforms affects their working conditions, work process, and work performance (artwork) has not been conducted thoroughly. Thus, this paper looks into the current status of ideological screening about gender issues against creative workers on digital platforms and inquires into how it affects the working conditions, work process, and job performance (artwork) of the creative workers. The research uses methods; Documentary researches on digital platform industry and phenomenological research through depth interviews. The interviewees are 21 web cartoonists, web novelists, illustrators and activists working on the digital platform industry, who were chosen by snowball sampling. All 21 interviewees replied that they have either directly or indirectly experienced ideological vetting. 15 interviewees testified that they experienced ideological screening firsthand. The methods of ideological vetting experienced by the interviewees includes cyber bullying on social media, accusations delivered through comments, unwanted influences on their work by corporate superiors and colleagues or contracting parties, and exclusion from work opportunities. 15 interviewees also reported self-censoring and testified that they stopped using social media or furthermore gave up using certain expressions or dealing with certain topics in their work. The research finds that the ongoing ideological vetting against the creative workers has significantly impacted them. Since the company of digital platform has the power to offer the work (and the creative workers have little bargaining power against them), the creative workers inevitably feel anxiety about the commercial value of their artwork. Moreover, the research indicates that misogyny (sexual discrimination) within the gaming, webnovel and webtoon industries exacerbates the influences of the ideological vetting. The research suggests the assertion of several legal actions based on the rights cited in individual acts including the Labor Standards Act, Monopoly Regulation and Fair Trade Acts, National Human Rights Commission of Korea Act and et cetera, depending on the features of the contractual relationship. Furthermore, the research advises limiting the economic dependency of creative workers on digital platforms, strengthening legal protections for artists and enacting a comprehensive Anti-Discrimination Act to resolve this problem fundamentally.
