민법 제3조에 의하면 사람은 생존한 동안 권리와 의무의 주체가 된다. 생존한 동 안만 권리의 주체성이 인정되기 때문에 태아에게는 원칙적으로 권리능력이 인정되지 않는다. 그리하여 태아를 보호하기 위해 민법은 개별적인 보호규정을 두고 있다. 그 대표적인 규정이 민법 제762조 불법행위에 대한 손해배상청구권에 대한 출생의제 규정이다. 출생의제 규정의 해석과 관련하여서 전통적으로 정지조건설과 해제조건설이 주장되어 왔으나 이러한 전통적인 견해에 의할 때에는 모체와 함께 사망하거나 사산 된 태아를 보호할 수 없는 문제가 발생한다. 법원은 이러한 문제를 해결하기 위해 일반적인 사안에서보다 부모의 위자료를 증액하여 인정하는 방법을 택하고 있다. 그러 나 이는 근본적인 문제 해결방법이 될 수 없다. 전통적인 견해에 의할 때 사산된 태아를 보호할 수 없는 문제점은 민법 제762조를 제3조에 대한 특별규정으로 인정하여 제 3조와 분리하여 별개로 해석, 적용함으로써 해결할 수 있다. 민법 제762조를 민법 제3 조로부터 분리시키면 불법행위에 대한 손해배상청구권에서는 태아를 완전한 사람으로 인정하게 되므로, 사산한 경우에도 태아 자신의 위자료청구권을 포함한 손해배상 청구권을 인정할 수 있고 이에 대한 상속도 인정할 수 있게 된다. 민법에서 보호하는 태아는 수정란이 모체에 착상된 시점부터 인정되는 것인데, 배아에 대한 연구가 활발하게 진행되고 있는 현실에서 착상 이전의 배아 단계에 대한 보 호도 중요하게 논의되어야 한다. 배아에게 직접 불법행위가 행해져 배아가 모체의 자 궁에 착상되지 못한 경우에는, 착상되지 못한 배아를 권리주체로 인정할 수 없기 때문 에 배아에게 위자료청구권이 인정되지 않는다. 그러나 배아가 착상되고 출생에 이르지 못한 경우에는 배아가 태아의 단계까지는 이른 것이므로, 태아에 대한 논의에서와 마찬가지로, 태아에게 위자료청구권을 인정하는 것이 타당하다. 나아가 배아에 대한 불법행위가 행해져 장애를 가진 상태로 출생한 경우에는 완전한 사람으로 출생한 것 이므로 위자료청구권을 인정해야 한다. 배아는 권리주체로 인정할 수는 없지만 생명으로 발전할 가능성이 있는 특별한 물건으로 인정할 수 있으므로, 혈액이나 신체 일부 보다 더욱더 존중되어야 하는 권리의 객체에 해당한다고 볼 수 있다. 따라서 배아에 대한 불법행위는 배아생성자의 인격권 침해에 해당하여 배아생성자의 위자료청구권 이 인정된다.
더보기According to Article 3 of the Civil Act, a human being becomes a subject of rights and duties for the duration of existence. Because the recognition as a subject of rights is only during existence, in principle, a fetus is not recognized as subject possessing rights. Thus, the Civil Act includes separate regulations on the protection of the fetus. The representative regulation is Article762 of the Civil Act, regulation on the subject of birth: the claim for damages in case of illegal acts performed. With regard to interpreting this regulation on birth, traditionally the condition precedent and condition subsequent have been argued. However, when resorting to these traditional standpoints, a problem arises: the fetus that dies as a result of the death of the mother or in stillbirth cannot be protected. To address this problem, the court chose the solution of increasing the compensation for the parent(s), rather than resorting to generic subjects. Even still, this does not address the fundamental problem. The problem of the unprotected fetus under the traditional standpoints can be addressed by designating Article 762 of the Civil Act as a special regulation under Article 3 of the Act, thus to receive separate interpretation and application from Article 3. With such separation, the fetus is recognized as a complete human being in the process of claim for damages. When the fetus ends up in stillbirth, both the recognition of claim for damage of the fetus (in the claim to compensation) and the inheritance are recognized Under the Civil Act, the recognition of fetus is from the point of implantation of the fertilized egg. With the ongoing, dynamic research on the subject of embryo, discussions on the protection of pre-stage fetus, the embryo, must be actively done as well. If in the case where implantation occurs but does not result in birth, the development from embryo to fetus has been reached. Thus, just as it is applied to fetus, claim to compensation may be reasonably done for embryo as well. Furthermore, if the infant is born with disability due to harm done at the stage of embryo development, the claim to compensation must be recognized as the subject is now fully and completely in existence as human. While the embryo cannot be recognized as a subject of rights, given its potential to develop into a full living matter, it must given greater respect and recognition than what is given to the blood and parts of the human body. Thus, illegal act against the embryo falls under an infringement of rights of the embryo producer (mother), and the embryo producer``s claim to compensation is rightfully recognized.
