‘기지촌 여성’에 대한 입법ㆍ사법운동과 법적 주체 생산 -법은 서브알턴의 말하기를 도울 수 있는가 = The Movement of Legislation & Jurisdiction and the Production of Legal Subject of US Camptown Women

이 논문에서는 기지촌 여성을 둘러싼 ‘법적 주체’ 생산을 포스트-식민법의 시각으로 살펴보고, 이것이 서브알턴의 법적 주체 생산에 어떤 실천적 함의를 줄 수 있는지 고찰해본다. 먼저 ‘주한미군기지촌 성매매 피해 진상규명 및 지원에 관한 특별법안’과 ‘기지촌 미군위안부 국가배상청구소송’에 대한 분석을 통해 기지촌 여성이 어떤 ‘법적 주체’로 생산되고 있는지 살펴보았다. 입법운동의 주체가 작성한 법안의 초안을 위안부피해자법, 과거사 관련법, 성매매처벌법과의 비교를 통해 분석한 결과, 기지촌 여성은 일본군 ‘위안부’에 대한 지원과 유사한 법적 지원을 필요로 하며, 한국의 역사적 맥락 속에서 국가의 위법한 행위에 의해 피해를 입었고, 성매매가 지닌 인권침해적양상에 의해 피해를 입은 복합적인 주체로 형성되고 있었다. 또 입법운동의 주체가 작성한 법안의 초안이 국회에 발의되는 과정에서 겪는 변화를 통해 법적 주체가 형성되는 제도적 과정에서 어떤 변화를 겪게 되는지 보았을 때, 기지촌 여성의 주체성과 역사적 특수성이 비교적 덜 드러나게 되었으며 명시된 진상조사의 범위가 축소되고 있었다. 소송에 대해서는 기지촌 여성의 법적 주체 구성을 두고 원고 측과 피고 측 사이에 담론적 투쟁이 일어나고 있다고 분석했다. 원고 측에서는 ‘기지촌 위안부’라는 용어를 사용하면서 국가의 기지촌 여성 관리와 일본군 ‘위안부’ 제도의 공통된 역사적 맥락을 강조하고, 기지촌 여성을 구조적 책임의 피해자로서 드러내고 있었다. 반면 피고 측에서는 기지촌 여성을 개인의 선택에 따라 성매매를 행한 ‘자발적 성판매여성’으로 위치 짓고자 한다. 이러한 분석을 바탕으로 기지촌 여성의 법적 주체 생산에 어떠한 담론들이 개입하고 있는지 고찰해보았을 때, 먼저 일본군 ‘위안부’와 기지촌 여성을 분리하려는 자발/강제 이분법이 작동하고 있다. 또 냉전 구조 하의 한미 동맹 하에서 이루어진 기지촌 관리에 대한 문제제기는, 일본군‘위안부’ 문제에 비해 현재의 국가권력 문제를 더욱 직접적으로 드러내기 때문에 어려움을 겪는다고 보았다. 마지막으로 이러한 분석들을 바탕으로 서브알턴의 주체 생산에서 법의 가능성을 모색해 보았다. 법운동의 과정에서 서브알턴의 증언이 촉발될 수 있고, 들리지 않는 개인들의 경험으로 남겨져 있었던 목소리들이 사회적이고 역사적인 것으로 엮일 수 있다. 이 때 법의 서브알턴 재현은 법의 언어에 맞추어 피해자성을 재현한다는 점에서 불완전한 것이지만, 사회적인 서브알턴 재현의 시작점이 될 수 있다는 점에서 가능성을 가진다.
더보기This paper examines the production of ‘legal subject’ of US Military prostitutes in the perspective of post-colonial law, investigating how this can offer meaningful implications for the construction of subaltern’s legal subject. First, it studies what ‘legal subject’ the women has developed into, through the analysis of ‘Special act on the search for truth and support for the damage of US military camptown prostitution ’ and ‘State compensation suit for US camptown women’. This paper compares the draft written by the subject of ‘legislative movement’ with the law of Japanese Military Comfort Women, the Act related to the past and the Act on the Punishment of Acts of Arranging Prostitution. Based on the comparison, it turns out that the US camptown women are constructed as complex subjects who need legal supports similar to those of Japanese Military comfort women, have been damaged from the illegal behavior of government in the Korean historical context and were suffered from the aspect of human rights violation prostitution itself has. Furthermore, the draft has experienced changes in the process of proposal to parliament, which shows how the legal subjects have been produced and changed in the institutional process. From that, it can be inferred that the nature as a main subject and historical characteristics is less exposed, while the range of the fact finding is being reduced. This thesis suggests that there is discursive struggle between plaintiff and defendant on the issue of US military prostitutes’ legal subject construction. The plaintiff emphasizes historical context common to both management of US camptown women and Japanese Military Comfort women by using the term “US Military Comfort Women”, revealing the US camptown women as structural victims. On the other hand, the defendant are trying to situate them in the position of ‘voluntary prostitutes’ who took the job by their own decisions. Moreover, based on this analysis, this paper examines what kind of discourses is involved in the production of legal subject of US Military Prostitutes. It shows that there is voluntary and compulsory dichotomy trying to separate US military prostitutes from Japanese Military Comfort Women. Bringing up a problem with the US camptown management operated under the Korea-US alliance, in the structure of cold war, has more difficulties, since it exposes problems of current state power more directly than the case of Japanese Military Comfort women. Lastly, this paper seeks for the possibility of law in the construction of ‘subject of subaltern’. In the process of legislative movement, testimony of subaltern can be triggered. Moreover, the voices, which have been ignored just as personal experiences, can be interwined with social and historical dimension. Re-representation of subaltern in law is incomplete in the point that it represents the victims with the language of the law. However, it has possibility as well, since it can be the start point of re-representation of social subaltern.
