공익사업을 위한 재산권 제한과 손실보상 - 헌법적 쟁점을 중심으로 - = Restrictions on Property Rights and Compensation for Losses for Public Projects Focusing on Constitutional Issues

According to the Constitution, our law is divided into three areas: criminal law, civil law, and administrative law. Among these, administrative law is based on the idea that individual rights can be limited to some extent for the public good. An example of this is land expropriation, which is the removal of private land for public works. However, in this case, the land cannot be received for free and the value of the land must be compensated. This is generally referred to as compensation for losses under public law.
There are two methods for determining the degree of compensation for losses: the full compensation theory and the equivalent compensation theory. The full compensation theory is the idea that in the case of land expropriation, the original value of the land should be fully compensated. On the other hand, the theory of equivalent compensation states that only the amount judged to be reasonable depending on the situation should be compensated, and special situations such as the land reform that distributed the land of large landowners after liberation to farmers at low prices are also explained by this idea. As can be seen from this conflict of theories, the idea of compensation provides a hint when thinking about what true equality and fairness are in the real world. In the field of compensation for damages, there are separate laws such as the Land Expropriation Act. However, there is no general law with the same name as the National Compensation Act that applies in all cases. Instead, Article 23 of the Constitution, which guarantees the people's property rights, is used as the basis for claiming statutory damages. Article 23, Paragraph 3 of the Constitution stipulates that “expropriation, use or restriction of property rights for public necessity and compensation therefor shall be made by law, and fair compensation shall be paid.” The Supreme Court believes that if a citizen's property rights are violated and there are no legal provisions for appropriate compensation for the loss, he or she can request compensation for the loss from the court. As can be seen from this, it is important to consider not only the interpretation of individual administrative laws, but also how property rights guaranteed by the Constitution are violated and the amount of compensation.
Article 23, Paragraph 1 of the Constitution stipulates that “the property rights of all citizens are guaranteed. Their content and limits shall be determined by law.” The Constitution guarantees the private property system and individual property rights, but in some cases, these may be restricted for the sake of public welfare. In this case, compensation must be given to those who have made special sacrifices in relation to property rights in order to ensure that property rights are guaranteed and to prevent disadvantages only to specific people. Here, whether an infringement is a special victim or not depends on whether the infringement targets the general public broadly or is limited to specific individuals or groups, or whether the infringement falls within the range of acceptable constraints on property rights. In addition, it is expected that the decision will be made by considering two factors, including whether it is strong enough to infringe on the essential content of property rights.
Since the basis of our judicial system consists of the principles of private property and private autonomy, infringement of private property rights is not permitted even if compensation is made. However, since the private property system is originally based on liberalism and individualism, and its ideology was adopted for the purpose of establishing a fair and equitable social order, the principle of good faith and the prohibition of abuse of rights exist as constraints inherent in the system. 헌법에 따라 우리 법은 형법, 민법, 행정법의 세 영역으로 나뉜다. 이 중 행정법은 개인의 권리가 공익을 위해 어느 정도 제한될 수 있다는 생각에 기초하고 있다. 이에 대한 예는 공익사업을 위해 사유지를 제거하는 토지수용이다. 다만, 이 경우 토지를 공짜로 받을 수 없으며, 토지의 가치를 보상해야 한다. 이를 일반적으로 공법상 손실에 대한 보상이라고 한다.
손실보상의 정도에 대해서는 완전보상이론과 등가보상이론의 두 가지 방법이 있다. 완전보상이론은 토지수용의 경우 원래 토지의 가치가 완전히 보상되어야 한다는 생각이다. 한편, 등가보상론은 상황에 따라 합리적이라고 판단되는 금액만 보상하면 된다고 하고 있어, 광복 후 대지주의 토지를 농민에게 싸게 분배한 농지개혁 등 특수한 상황도 이 발상으로 설명된다. 이러한 이론의 충돌에서 알 수 있듯이 손해배상에 대한 생각은 현실 세계에서 진정한 평등과 공정이 무엇인지 생각할 때 힌트를 준다.
손실보상 분야에서는 토지수용법 등 별도의 법률이 있다. 다만, 모든 경우에 적용되는 국가보상법과 같은 명칭을 가진 일반법은 없다. 대신 국민의 재산권을 보장하는 헌법 제23조를 법정 손해배상청구의 근거로 삼고 있다. 헌법 제23조 제3항은 “공공필요에 의한 재산권의 수용ㆍ사용 또는 제한 및 그에 대한 보상은 법률로써 하되, 정당한 보상을 지급하여야 한다.”고 규정하고 있다. 대법원은 시민이 재산권을 침해당했는데 손실에 대한 적절한 보상에 대한 법적 규정이 없는 경우 법원에 손실에 대한 보상을 청구할 수 있다고 보고 있다. 이를 통해 알 수 있듯이 개별 행정법의 해석뿐만 아니라 헌법이 보장하는 재산권이 어떻게 침해되고 보상액이 얼마가 되는지를 고려하는 것이 중요하다.
헌법 제23조 제1항은 “모든 국민의 재산권은 보장된다. 그 내용과 한계는 법률로 정한다.”고 규정하고 있다. 헌법은 사유재산제도와 개인의 재산권을 보장하고 있지만, 경우에 따라서는 공공의 복지를 위해 제한될 수 있다. 이 경우 재산권의 보장을 이행하고 특정인에게만 불이익이 발생하지 않도록 하기 위해 재산권에 관하여 특별한 희생을 감수한 자에게 보상하여야 한다. 여기서 침해가 특별한 희생인지 아닌지는 침해가 일반 대중을 광범위하게 대상으로 하는지 아니면 특정 개인이나 집단에 국한되는지 또는 침해가 재산권에 내재된 제약으로 수용될 수 있는 범위 내에 있는지 여부에 달려 있다. 그 외에도 재산권의 본질적 내용을 침해할 만큼 강한지 여부 등 두 가지를 고려해 판단할 것으로 본다.
우리 사법제도의 근간은 사유재산의 원칙과 사적 자치로 구성되어 있기 때문에 보상이 이루어져도 사유 재산권을 침해하는 것은 허용되지 않는다. 그러나 사유재산제도는 본래 자유주의와 개인주의에 기초하고 있고, 그 이념은 공정하고 공평한 사회질서 구축을 목적으로 채택되어 있기 때문에, 제도에 내재된 제약으로서 신의성실의 원칙과 권리남용금지가 존재하며, 권리의 행사는 공익을 위하여 제한될 수밖에 없다. 다만, 이러한 제한은 절대적 소유권의 원칙에 대한 예외이기 때문에 소유권의 제한에는 엄격한 요건이 필요하며, 법령의 해석도 해석의 대상이 된다.
