군사용 해양무인체계에 관한 국제법적 연구

From a military perspective, the use of unmanned systems is increasing. At sea, advanced maritime powers such as the United States and the United Kingdom have been building fleets of unmanned warships and auxiliary vessels, and the Republic of Korea Navy is also planning to introduce unmanned surface vessels (USVs). This paper examines whether the rules and principles of existing international law can be applied to this new type of unmanned maritime systems (UMS), defined as a self-propelled or remotely-navigated craft and control system that are normally recoverable and designed to perform functions at sea by operating on the surface, semi-submerged or undersea. As the use of military UMS for peacetime has already begun, and the Republic of Korea Navy plans to introduce them, it is necessary to review the international law related to the use of military UMS. Without clarifying the relevant legal regulations and interpretations, the operation of military UMS may lead to disputes between countries due to different interpretations and law enforcement.
Therefore, this paper identifies the legal issues expected to arise from the operation of military UMS in the waters adjacent to the Korean Peninsula and reviews relevant treaties, customary international law, international jurisprudence, and theories. There are only a limited number of countries that have national practices that indicate that new forms of military maritime unmanned systems are or are not the same as conventional warships in terms of legal status and basis. Therefore, a supplementary review of manuals interpreting treaties applicable to military UMS was conducted. This paper aims to contribute to reducing the likelihood of diplomatic row and military conflict by providing an international legal logic for responding to expected conflict situations between states in the operation of military UMS.
Since this paper focuses on the legal status and international legal issues related to military UMS, the scope is limited to military operations, separated from commercial maritime autonomous surface ships (MASS). Also, military UMS are examined in terms of USVs and unmanned underwater vehicles (UUVs) that replace existing manned vessels, and the legal issues related to the fact that the crew is not physically on board the vessel are discussed by focusing on the term "unmanned". Additionally, for the legal interpretation of military UMS, this paper referred to state practices related to the operation of UAVs, military manuals, manuals of experts, and opinions of scholars. This is because UAVs have already been put into practice and related discussions have developed, and UAVs and UMS have commonalities in that they are unmanned, operated remotely or supervised by a remote operator, and used for military purposes. In addition, treaties and customary international law applicable to UMS are analyzed based on when they are operated, divided into peacetime and armed conflict.
With these research objectives and methods, Chapter 2 confirms the concept and legal status of military UMS. It analyzes whether military UMS still have the same rights and obligations as manned vessels and warships and examines their legal status as weapons in armed conflict. Chapter 3 analyzes the rights and obligations of warships under the United Nations Convention on the Law of the Sea in peacetime, in particularly the right of navigation, sovereign immunity, and provisions applicable to warships engaged in law enforcement and military activities. In addition, since military UMS can also be used for law enforcement activities, this paper has examined the legal basis for their operation and considered the legal issues that may arise. Furthermore, legal issues regarding the activities of conventional warships will continue to arise in disputes that may arise during law enforcement or military activities, so we have reviewed the precedents of international tribunals regarding the determination of military activities and law enforcement activities.
Chapter 4 reviews the legal issues of the military UMS used in armed conflict. The use of military UMS in armed conflict is not per se illegal or prohibited, so there is no need for a new legal framework, as the rules and principles of the law of armed conflict may still apply even when new technologies are used. Moreover, while military UMS are operated by a crew which is under regular armed forces discipline, their legal status may differ when operated by civilian contractors in armed conflict.
Chapter 5 analyzes state practice on the military UMS and finds that the United States, in particular, actively reflects its interpretation and implementation of military UMS in its The Commander’s Handbook on the Law of Naval Operations. In this chapter, the necessity of preparing a manual based on international law to guide field commanders when operating military UMS was presented to the Republic of Korea Navy. Since there is no agreement with neighboring countries on military UMS, the way to minimize conflicts with neighboring countries when unmanned vessels encounter each other between countries will be to use a consistent logic based on the rules and principles of international law.
군사적 관점에서 무인체계의 활용이 증가하고 있다. 해상에서도 미국, 영국 등의 해양 선진국은 무인으로 운용되는 군함이나 보조선박으로 구성된 함대를 구축하고 있으며, 대한민국 해군도 무인수상정을 도입할 예정이다. 본 논문에서는 기존의 유인 함정을 대체하는 수준의 무인수상정과 무인잠수정을 군사용 해양무인체계로 칭하고 ‘일반적으로 회수가 가능하고 수면, 반잠수 또는 해저에서 작동하며 해상 기능을 수행하도록 설계된 자체 추진 또는 원격으로 항행하는 기기와 통제체계’로 정의하여 무인으로 운용되는 새로운 형태의 군사용 해양무인체계에도 기존 국제법의 규칙과 원칙이 적용될 수 있는지 검토하였다. 평시 작전에서 군사용 해양무인체계의 운용이 이미 시작되었고 대한민국 해군 역시 도입을 계획하고 있으므로, 군사용 해양무인체계 운용과 관련된 국제법적 검토가 필요하다. 관련된 법적 규정과 해석을 명확히 하지 않은 채 군사용 해양무인체계를 운용할 시, 국가 간 다른 해석과 그에 따른 법집행으로 인한 분쟁이 발생할 수 있다.
따라서 본 논문에서는 한반도 주변수역에서 군사용 해양무인체계 운용 시 예상되는 법적 쟁점을 확인하고, 관련 조약과 국제관습법, 판례와 학설을 검토하였다. 추가로 기존 유인 함정과 비교하여 새로운 형태인 군사용 해양무인체계의 법적 지위와 근거에 관해 기존 군함과 동일하다거나 그렇지 않다는 국가실행을 나타내고 있는 국가는 한정되므로, 군사용 해양무인체계의 법적 지위와 적용되는 조약에 관해 해석한 매뉴얼들을 보충적으로 검토하였다. 이를 통해 군사용 해양무인체계 운용 시, 예상되는 국가 간 갈등 상황의 대응을 위한 국제법적 논리를 마련하여 외교적 마찰과 군사적 충돌 가능성을 낮추는 데 이바지하는 것을 목적으로 한다.
이 논문은 군사용 해양무인체계에 관한 법적 지위 및 국제법적 쟁점에 관한 연구이므로, 상업용 자율운항선박과 구분하여 그 대상을 군사용 운용에 한정하였다. 또한, 군사용 해양무인체계는 기존 유인 함정을 대체하는 수준의 무인수상정과 무인잠수정을 중심으로 검토하였으며, ‘무인’에 초점을 맞추어 승조원이 실제로 함정에 탑승하지 않는 것에 관한 법적 쟁점을 논하였다. 한편, 군사용 해양무인체계에 관한 법적 해석에서 무인항공기 운용에 관한 국가실행 및 각국의 군사매뉴얼과 전문가들의 매뉴얼, 학자들의 의견 등 관련 내용을 참조하였다. 이는 무인항공기가 이미 실전에 투입되어 관련 논의가 발전하였고, 군사용 해양무인체계와 무인체계라는 점, 운용자가 원거리에서 원격 또는 감독하 운용된다는 점, 군사적 목적에서 활용된다는 공통점을 갖기 때문이다. 또한, 군사용 해양무인체계의 운용 시기를 기준으로 평시와 무력충돌시로 구분하여 적용되는 조약과 국제관습법을 분석하였다.
이러한 연구목적과 방법을 가지고 제2장에서는 군사용 해양무인체계의 개념과 법적 지위를 검토하였다. 군사용 해양무인체계는 기존에 유인으로 운용되던 선박과 군함이 무인으로 대체되는 것이므로 여전히 동일한 권리와 의무를 갖는지 분석하였으며 추가로 무력충돌시 무기로서의 법적 지위를 검토하였다. 제3장에서는 평시 유엔해양법협약을 중심으로 군함의 권리와 의무, 특히 항행권과 주권면제, 법집행활동과 군사활동에 운용되는 군함에 적용되는 조항들을 분석하였다. 또한, 군사용 해양무인체계는 법집행활동에도 운용될 수 있으므로 법적 근거에 따라 운용되는 경우를 검토하고 예상되는 법적 쟁점을 살펴보았다. 한편, 군사용 해양무인체계의 법집행활동이나 군사활동시 발생할 수 있는 분쟁에서도 기존 군함의 활동에 관한 법적 쟁점이 이어질 것이므로 군사활동과 법집행활동 여부 판단에 관한 국제재판소의 선례를 검토하였다.
제4장에서는 무력충돌시 사용되는 군사용 해양무인체계에 관한 법적 쟁점을 검토하였다. 무력충돌시 군사용 해양무인체계의 운용은 그 자체로 위법하거나 금지되지 않으므로 신기술이 적용되었다 하더라도 무력충돌법의 규정과 원칙들이 적용될 수 있어, 새로운 법적 체계가 필요한 것은 아니다. 또한, 군사용 해양무인체계는 군율에 따르는 군대의 구성원들이 운용할 것이지만 만일 민간인 계약자가 무력충돌시 운용할 경우 법적 지위가 다르게 부여될 수 있다.
제5장에서는 군사용 해양무인체계에 관한 국가실행을 분석하고 특히 미국이 군사용 해양무인체계에 관한 자국의 해석과 실행을 해군 지휘관 지침서에서 적극적으로 반영하고 있는 것을 확인하였다. 대한민국 해군도 군사용 해양무인체계 운용시 현장지휘관에 지침이 될 수 있도록 국제법에 근거한 지침서 마련의 필요성을 제시하였다. 군사용 해양무인체계에 관해서는 주변국과 합의된 내용이 없으므로 국가 간 무인 선박을 조우할 시 주변국과의 갈등을 최소화하는 방안은 국제법의 규칙과 원칙이라는 일관된 논리를 근거로 활용하는 것이 될 것이다.
