헌법소원제도에 대한 새로운 고찰 - 위헌심사형 헌법소원제도의헌법적 문제점을 중심으로 = Examination of the Constitutional Petition System – Focusing on the Constitutional Issues of the Petition for an Adjudication on Constitutional Complaint

사법부와 헌법재판소가 법률해석권 등을 중심으로 이견을 보이고 있는데, 많은 학자들은 현행 헌법의 개정 없이는 이 문제를 근본적으로 해결할 수 없다고 본다. 과연 위와 같은 논란의 근본적인 원인이 현행 헌법의 불명확한 규정 때문인지를 현행 헌법 자체를 기초로 살펴보기로 하되, 특히 논란의 고리가 되고 있는 이른바 위헌심사형 헌법소원제도를 중심으로 논하기로 한다.
위헌심사형 헌법소원제도는 헌법재판소법 제68조 제2항에 의하여 생성된 제도로서, 통계적으로 헌법재판소가 담당하고 있는 사건 중 이 유형의 신청사건 수가 급증하고 있고, 헌법재판소의 법률에 대한 위헌심사의 중심축도 위헌법률심판제청사건에서 위헌심사형 헌법소원신청사건으로 이동하고 있다. 그럼에도 불구하고 이 제도는 우리 헌정사에서 종전에 거의 논의가 이루어진 바 없고, 전 세계적으로도 그 유래를 찾아보기 힘든 독특한 제도이다.
이 제도의 본질이 헌법소원제도인지 아니면 위헌심사제도인지에 대하여 논란이 있으나, 현행 헌법은 이러한 형태의 헌법소원제도 내지 위헌심사제도를 예정한 바가 없다. 결론적으로 이 제도는 헌법적 근거가 없을 뿐만 아니라, 현행 헌법이 규정하는 헌법재판에 대한 기본적인 원칙과 헌법재판제도의 근본적인 구조에 부합하지 못한다.
우리 헌법은 헌법 제111조 제1항 제1호에서 법률의 위헌심사권을 법원과 헌법재판소가 함께 행사하도록 규정하고 있다. 법원의 제청 없이는 헌법재판소가 독자적으로 위헌심사를 하지 못하도록 한 것이다. 이는 또한 위헌심판제청권을 일반 국민에게 부여하지 않고 법원에만 부여하기로 하는 헌법적 결단으로 볼 수 있다. 그럼에도 불구하고 헌법재판소법을 통하여 헌법적 근거 없이, 법원이 위헌심판제청을 하지 않아야 한다고 판단하더라도 당사자가 직접 위헌심판을 신청할 수 있도록 함으로써 일반 국민에게 위헌제청권을 부여하였고, 법원이 위헌의 의심이 없다고 판단하여 위헌제청을 기각하더라도 헌법재판소가 독자적으로 위헌 여부를 판단할 수 있도록 하고 있어, 현행 헌법의 위헌심사권 행사에 관한 기본 원칙에 반한다.
위 제도의 헌법적 근거로 헌법 제111조 제1항 제5호를 들 수도 있으나, 이 규정은 헌법적 근거 없이 법률을 통해 헌법소원제도의 본질적인 내용이 아닌 새로운 제도를 창설할 수 있다는 취지로 해석할 수 없다. 오히려 입법권자가 입법재량으로 헌법소원의 대상을 제한할 수 있도록 한 헌법적 결단이다. 만약 위 제5호가 헌법적인 근거조항이 된다고 하면 헌법재판소법 제68조 제2항은 헌법 제113조 제1항에서 정한 결정형태에 관한 규정을 위반한 것이 된다. 헌법소원제도의 본질상 위헌심사형 헌법소원제도가 포함되어 있다고 한다면 헌법적 근거가 없더라도 법률을 통해 이러한 제도를 창설할 여지가 있겠지만, 연혁적·비교법적으로 살펴볼 때 문명국가에서 시행되고 있는 헌법소원제도의 본질적 내용에 위헌심사형 헌법소원제도가 포함된다고 볼 근거는 없는 것으로 보인다.
이러한 문제점이 있더라도 이 제도가 국민의 기본권 보장 등 긍정적으로만 운영될 수 있다면 다행이겠으나, 종래와 달리 위헌심사형 헌법소원사건의 신청 건수는 급격히 증가하고 있지만 이에 따른 위헌취지결정은 오히려 줄어들고 있어 소송과정에서 남용의 폐단을 걱정할 단계에 이르렀다. 위헌심사형 헌법소원을 청구하는 당사 ...

As the Judiciary and the Constitutional Court of Korea have diverged in their views on their respective authorities of statutory construction, the majority of legal scholars have opined that their divergence is not likely to be reconciled without an amendment to the Constitution. Grounded in a review of the current Constitutional text, this article examines whether the root cause of the many controversies lies in the vague statutory provisions of the current Constitution, with a focus on the so-called “petition for an adjudication on constitutional complaint,” the particular bone of contention in this discourse.
The system of petition for an adjudication on constitutional complaint was established under Article 68(2) of the Constitutional Court Act. Statistics have seen a surge in the number of this particular type of constitutional appeal, and the focus of the Constitutional Court’s caseload shifting from the request for adjudication on the constitutionality of laws to the petition for adjudication on constitutional complaint. Nevertheless, the complaint system has hardly ever been the subject of discussion throughout the constitutional history of Korea. It is indeed a peculiar system with rarely any precedent in the world.
Although debate persists over whether the inherent nature of the complaint system lies in the constitutional petition regime or the request for adjudication on the constitutionality of laws, the current Constitution did not anticipate this type of constitutional petition or constitutional adjudication request. In short, the constitutional complaint system is not only constitutionally groundless, but also inconsistent with the basic principles and structure of constitutional adjudication under the current Constitution.
Article 111(1)1 of the Constitution of the Republic of Korea provides that the courts and the Constitutional Court share jurisdiction over the constitutional review of laws. In other words, the Constitutional Court may not conduct a constitutional review without the request of the court. The provision also demonstrates a constitutional decision to authorize only the court, rather than ordinary citizens, to request for constitutional review of laws. Nevertheless, the Constitutional Court Act: (a) allows a party to directly file a petition for constitutional review, notwithstanding the court’s decision to the contrary, which is constitutionally groundless; and (b) allows the Constitutional Court to adjudicate on the constitutionality of a law, notwithstanding the court’s dismissal of a party’s motion on grounds of a lack of any constitutional doubts about the law in question. In short, the current complaint system is contrary to the basic principles of the constitutional review authority as laid out in the Constitution.
Some cite Article 111(1)5 of the Constitution as the constitutional grounds for the said system. However, the provision may not be interpreted to allow for the establishment of a new system grounded in laws but not in the Constitution, deviating from the inherent content of the constitutional petition regime. The legislative intent of the provision rather lies in the constitutional decision to empower the legislature with legislative discretion to restrict the scope of constitutional petition. Were we to consider Article 111(1)5 as the constitutional grounds for a constitutional complaint system, Article 68(2) of the Constitutional Court Act would be in violation of the provision on the mode of decision-making under Article 113(1) of the Constitution.
