18세기 기사 남인의 復官爵 청원을 통해 본 양반 擊錚의 정착 - 睦來善, 李玄逸 후손들의 복관작 청원을 중심으로 - = What 18th Century Requests for the Restoration of the Gisa Nam’in Group’s Position - and - Rank Reveal about the Consolidation of Gyeokjaeng as a Form of Yangban Appeals: The Case of the Position - and - Rank Restoration Appeals Filed by the Descendant

This article examines the gyeokjaeng (擊錚) employed by the descendants of Mok Nae-seon and Yi Hyeon-il–both of whom had been punished in the purge of 1694 for their key roles in the Nam’in (南人) administration of 1689-1694 – in appealing for the restoration of the position-and-rank (復官爵) of their ancestors. In doing so, the paper traces back the institutional, social, and political reasons for the process through which gyeokjaeng were solidified into a particular form of yangban appeal in late Joseon.
Gyeokjaeng were primarily a means by which lower-status members of Joseon society were able to communicate orally to the king their sense of having been wronged. But in the 18thcentury, large numbers of yangban attempted gyeokjaeng appeals primarily over the issues of clearing the name (伸寃), or restoring the position-and-rank, of their ancestors; disputes over burial sites (山訟); and naming of successors (立後). Appeals for the exculpation–or the restoration of the position-and-rank–of ancestors were especially notable in that the yangban choosing to make their cases through gyeokjaeng outnumbered those doing so using the yangban’s own sang’eon (上言) format. Indeed, it was with gyeokjaeng that the descendants of Mok Nae-seon and Yi Hyeon-il made their appeals for the restoration of the position-and-rank of their ancestors. Careful examination of these 18thcentury position-and-rank restoration appeals, made on behalf of ancestors and sustained using the gyeokjaeng format, makes it possible to explain the factors driving the establishment and consolidation of the yangban gyeokjaeng format in this period.
In the late 17thand early 18thcenturies, even as efforts were made to prevent abuse gyeokjaeng of the appeal format, a system resulting in expansion of the acceptable grounds for such appeals was organized, and the legal foundations for the revitalization of the gyeokjaeng appeal were laid. Moreover, Joseon’s government instituted protocol governing the receipt of and formality-punishment (例刑: a light, nominal punishment administered to all gyeokjaeng appellants) for gyeokjaeng made by those of government-official background. In addition, receipt of non-oral, document-based gyeokjaeng appeals became possible. This rationalization of the gyeokjaeng system had the effect of increasing the options available to yangban.
In addition to these institutional developments, the social and political conditions of the time facilitated the consolidation of the gyeokjaeng as a particular form of yangban appeal. First, as a result of the growth in the social and legal importance of the Three Bonds and Five Constants (綱常) ethics, as well as of the development of lineage organizations, the act of risking punishment in order to seek vindication for an ancestor’s having been wronged came to be seen as a virtue. Second, unlike the sang’eon format, gyeokjaeng– for which there were no limits on the number of times an appeal could be raised–proved to be particularly effective means for dealing with issues that were difficult to settle in short periods of time, and that required instead extended and vigorous petition. Whereas appealing politically-sensitive matters via memorial (上疏) initiated an official deliberation, electing instead to use the gyeokjaeng format–a tool designed to relieve the personal frustrations of a single individual–offered a substantially reduced risk of inciting political turmoil. Third, because yangban gyeokjaeng were primarily employed in order to achieve some shared, pressing ambition of an entire patriarchal relative group, even the punishment that an appellant received for a gyeokjaeng would not impact his social standing. 이 논문에서는 목내선과 이현일 후손들의 복관작 청원 격쟁 사례를 검토함으로써 조선 후기 양반 격쟁 형태 정착의 제도적, 사회적, 정치적 원인을 추적했다.
격쟁은 주로 하층민들이 왕에게 구두로 억울함을 호소하던 수단이었다. 그런데, 18세기에 조상의 신원 및 복관작, 산송, 입후 등의 사안을 중심으로 많은 양반들이 격쟁을 시도했다. 특히, 조상의 신원 및 복관작 청원의 경우 양반들의 호소 수단이었던 상언보다도 격쟁을 선택하는 사람들이 더 많았다. 이 시기 목내선과 이현일의 후손 역시 격쟁을 통해 조상의 복관작을 청원했다. 18세기 격쟁을 통해 조상의 복관작 청원을 지속했던 이 사례들을 검토함으로써 이 시기 양반 격쟁 형태 정착의 원인을 다음과 같이 설명할 수 있다.
우선 17세기 말 18세기 초에 격쟁의 남용을 막으면서도 그 허용 대상을 확대하는 제도 정비가 이루어져 격쟁이 활성화될 수 있는 법제적 기반이 형성되었다. 이 뿐만 아니라 일반인과 구분되는 관원 출신 격쟁자의 격쟁 접수 및 예형 절차가 마련되었고, 양반들은 구두가 아닌 문서로 격쟁원정을 접수할 수 있었다. 이러한 격쟁 제도의 정비는 양반들이 격쟁을 선택할 여지를 높였다.
이와 함께 다음과 같은 당시 사회적, 정치적 상황이 양반 격쟁 정착에 도움을 주었다는 사실을 확인할 수 있다. 첫째 강상 윤리의 확산과 문중의 발달로 조상의 억울함을 풀기 위해 격쟁을 감행하는 것이 미덕으로 여겨졌다. 둘째 상언과는 달리 횟수 제한이 없었던 격쟁은 단시간에 해결하기 어려워 오랫동안 치열하게 청원하여 달성해야 할 사안이 있을 때 유용한 호소 수단이었다. 특히 정치적으로 위험한 사안을 호소해야 할 경우 공적인 의사개진 수단인 상소에 비해 1인의 사적인 원억 해소 수단인 격쟁이 정치적 파장을 일으킬 가능성이 적었다. 셋째 양반 격쟁이 주로 부계 친족 집단의 공동의 열망을 이루고자 한 것이기 때문에 격쟁으로 형벌을 받은 후에도 격쟁자의 사회적 위상에 부정적인 영향을 미치지 않았다. 또한 중앙 집권 세력인 노론의 견제 세력을 확보하고자 했던 영조와 정조는 정치적 성격을 띤 목내선, 이현일의 복관작 청원과 같은 사안에 대해 격쟁 내용을 문제삼아 이들을 遠配에 처하더라도 오래지 않아 석방했다.
이를 통해 18세기에 중앙 정계에서 소외된 양반들의 호소를 수용하기 위한 정책 및 사회적 여건이 조성되어 있었다는 사실을 확인할 수 있다. 특히 정치적으로 민감한 문제를 사적인 원억 해소 수단인 격쟁을 통해 호소하는 경우 정치 쟁점화하지 않았다는 사실은 노론 주도의 18세기 정치 지형에서 왕과 중앙의 권력층들이 중앙 정계에서 소외된 양반들과 공존하던 방식을 보여준다.
