GPS전자감독 제도 및 관련 규정에 대한 독일 연방헌법재판소 결정 = The Decision of the German Federal Constitutional Court on the GPS-Based Electronic Monitoring Program and Related Regulations

Methods by which society is protected from high-risk criminals are both similar and different from country to country. Korea’s dualistic criminal justice system that focuses on both punishment and security measures responds to high-risk criminal offenders not only through punishment but also through strengthened security measures. Of note is that Korea no longer implements facility-based protective custody due to its past misuses, but imposes GPS-based electronic monitoring against high-risk criminal offenders after their release into society. As a result, when public demand for stronger social safety arises, GPS-based electronic monitoring becomes more intensified. The scope and period of application of Korea’s GPS-based electronic monitoring program have been expanded through several legislative amendments, and the retroactive application of the program is also permitted. In addition, the program’s monitoring function has been further strengthened with the introduction of personal probation officer designation system and active utilization of CCTVs.
Germany has also introduced a GPS-based electronic monitoring program against high-risk sex offenders. However, Germany is different from Korea in that it widely utilizes facility-based protective custody and therapeutic custody and implements GPS-based electronic monitoring only as a supplementary measure. The reason for this policy decision is the German authorities’ view that GPS-based electronic monitoring of criminal offenders has limitations in terms of crime prevention. In other words, in the German criminal justice system, resocialization of criminal offenders is pursued primarily through intensive education and treatment within correctional facilities, and GPS-based electronic monitoring is implemented as a secondary means of management and supervision of those who have released from these facilities.
Although GPS-based electronic monitoring is not implemented as a primary measure in Germany, the fact that the program involves 24-hour supervision of individuals using a GPS-based ankle bracelet has led to discussions about its constitutional legitimacy and ultimately the decision of the German Federal Constitutional Court examined in this paper. The German Federal Constitutional Court decided that subparagraph 12 of the first sentence of Article 68b(1) of the German Penal Code stipulating the GPS-based electronic monitoring program is not in violation of the German Constitution (Basic Law). What is important is the process through which this decision was reached, not the decision itself. In this 90-page long decision, the German Federal Constitutional Court not only reviewed the restrictions on fundamental rights that may be caused by imposing the electronic monitoring program, but also clearly stated that legislators are obliged to look into the empirical findings of the implementation the program, including its impact on crime prevention and technical details of its implementation, and reflect these findings in the relevant regulations.
The decision of the German Federal Constitutional Court has many implications. In its Decision 2011Heonba89 Decided December 27 2021, the Constitutional Court of Korea has ruled that GPS-based electronic monitoring of criminal offenders does not constitute a violation of the Korean Constitution. However, the decision of the Korean Constitutional Court may be criticized for the following reasons: (i) the court upheld the constitutionality of Korea’s GPS-based electronic monitoring program too easily using abstract argumentation with an overemphasis on public safety; (ii) the court discussed only the rights to freedom of privacy and general freedom of action, not all individual fundamental rights subject to restrictions caused by the program; (iii) the court did not apply a strict test that sufficiently reflects the characteristics of the right to privacy in assessing possible restrictions on the rights to freedom of priva...
본 글에서는 GPS전자감독 제도 및 관련 규정에 대한 독일 연방헌법재판소 판결문(2 BvR 916/11, 2 BvR 636/12) 전체를 번역한 후, 이를 통해 우리가 얻을 수 있는 시사점을 제시하였다. 독일에서도 우리와 마찬가지로 위험한 (성)범죄자에 대한 GPS전자감독 제도가 도입되었다. 하지만 독일은 우리나라와는 다르게, 여러 가지 보안처분 가운데, 시설 내 처우인 보호감호와 치료감호를 주된 수단으로 활용하고, GPS전자감독 제도는 어디까지나 이를 보완하는 기능으로 운영하고 있다. 이러한 차이를 보이는 이유는, 독일에서는 GPS전자감독을 통한 범죄예방은 한계가 있다고 생각하고 있기 때문이다. 즉, 정말 위험한 범죄자에게는 일차적으로 시설 내에서 집중적인 교육 및 치료를 통해 재사회화를 수행하고, 이러한 시설에서 사회로 나온 대상자를 중심으로 이차적으로 GPS전자감독을 통해 관리·감독하겠다는 것이다.
독일에서는 이렇게 GPS전자감독을 전면에 내세워 사용하고 있지는 않지만, 사람의 발목에 발찌를 채워 24시간 감시한다는 특징 때문에, 헌법적 정당성에 대한 논란이 끊이지 않았다. 그리고 이는 본 글에서 소개하고 있는 헌법재판소의 결정으로 이어졌다. 독일 연방헌법재판소는 GPS전자감독 제도를 규정하고 있는 독일 「형법」 제68b조 제1항 제1문 제12호가 독일 헌법인 「기본법」에 위반되지는 않는다고 판단하였다. 이 판례에서 주목해야 할 것은 결론뿐만 아니라 논증 과정이다. 독일 연방헌법재판소는 무려 90페이지에 이르는 결정문을 통해 GPS전자감독을 통한 다양한 기본권들의 제한에 대해 검토를 하였을 뿐 아니라, 입법자에게 GPS전자감독의 경험적 결과, 즉 특별예방적 효과 및 기술적인 제반 사항들을 확인하고, 여기서 얻은 지식적 결과들을 관련 법률에 반영할 의무가 있다는 점을 명백히 밝혔다. 그리고 그 과정에서 관련 연구에 대한 많은 문헌을 소개하고 인용하고 있다.
우리나라의 경우 GPS전자감독은 시설 내 처우가 아니라 사회 내 처우라는 이유로 이에 대한 감시와 압박을 더욱더 강화하는 방향으로 모든 정책이 진행되고 있다. 이러한 흐름이 가속화되면, 또다시 GPS전자감독을 둘러싼 헌법소원이 발생할 개연성이 높다. 또한, 설사 GPS전자감독 제도가 위헌이 아니라고 하더라도, 해당 제도는 형사정책적인 측면에서 보면 더욱 신중하게 고려하거나 보완해야 하는 지점들이 많다. 본 글에서 소개하는 독일 연방헌법재판소 결정에서는 이러한 내용에 대한 고민을 다루고 있으므로, 결정문 전체를 꼼꼼하게 살펴보는 것은 앞으로 우리의 GPS전자감독 제도가 형사정책적인 측면에서 긍정적인 방향으로 발전해 나가는 데 큰 도움이 될 것이다.
