국내외 디지털 플랫폼 이용약관 분석: 텍스트 마이닝 기법을 활용하여 = Analysis of terms and conditions of domestic and foreign platforms: using text mining techniques
디지털 플랫폼은 우리 삶에 필수요소로 자리매김했다. 디지털 플랫폼의 성장은 이용자들에게 편익을 가져다주는 동시에 권리침해와 같은 부작용도 발생하고 있다. 특히 이용자 권리에 대한 논의가 확대되면서 디지털 플랫폼의 다양한 기능과 역할, 한계에 대한 논의가 한창 진행 중이다. 디지털 플랫폼을 주제로 하는 선행연구들은 대체로 플랫폼의 정의와 규제 논의에 집중되어 있다. 이용자 관점에서 디지털 플랫폼 기업과의 계약 수단이라 할 수 있는 약관을 다룬 연구는 상대적 으로 부족하다. 본 연구는 국내외 대표 디지털 플랫폼을 운영하는 구글, 네이버, 페이스북, 카카오의 개인정보처리방침과 이용약관 분석을 통해 각 약관이 어떤 구성으로 이루어져 있는지, 국내외 플랫폼 약관은 이용자 보호 수준에서 어떠한 차이가 있는지 살펴보고자 했다. 분석 결과, 기본적 으로 국내외 디지털 플랫폼 이용약관은 서비스, 이용, 개인정보를 핵심 단어로 활용하고 있다는 공통점을 갖지만, 국내 플랫폼의 이용약관은 국내법을 따른 보편적인 내용으로, 해외 플랫폼 이용약관은 개인정보 활용과 게시물 규정에 초점을 맞춘 내용으로 구성되어 있음을 확인하였다. 또한 선행연구들이 제시했던 것처럼 이용약관이 기업과 이용자가 맺는 계약이자 서비스 제공의 대가로 이용자의 개인정보를 거래 대상으로 삼을 수 있다는 내용을 나타내고 있음을 확인했다.
더보기Currently, digital platforms have grown to a huge scale to lead the global economy. However, as digital platforms continue to grow, the issue of infringement of user rights is becoming more prevalent. In general, digital platforms and users sign contract through terms and conditions, and the terms and conditions specify the collection, use and protection of user information. User choose between agreeing to the terms and conditions for the use of the service provided by the platform or abandoning the use of the service(Cho & Kang, 2021), and even if the user agrees to the terms and conditions, they often do not read or are not familiar with the contents of the terms and conditions. In fact, there have been cases of infringing on users’ rights and interests of using this, and these cases suggest that digital platforms can use their superior position to form unfair conditions(Yu, 2022). In this regard, there is active research on digital platform regulation from the perspective of user protection. However, most previous studies have focused on platform regulation, while research on terms and conditions, which serve as contractual agreements between companies and users, remains insufficient. Therefore, this study aimed to examine the structure of terms and conditions and the disparity in user protection between domestic and foreign platforms using frequency analysis, TF-IDF, LDA topic modeling techniques. This was achieved through an analysis of the personal information processing policies and terms and conditions of Google, Naver, Facebook, and Kakao. The analysis revealed that both domestic and foreign digital platform terms and conditions primarily use words such as ‘Service’, ‘Use’, and ‘Information’. In addition, ‘personal Information’, ‘post policy’ and ‘users’ rights’ were presented as core values. However, domestic platforms’ terms and conditions align more closely with domestic laws, while foreign platform terms and conditions emphasize regulations regarding the use and posting of personal information. Additionally, it was confirmed, as previous studies have suggested, that terms and conditions serve as contracts between companies and users, implying that users' personal information may be exchanged for the provision of services. On the other hand, as pointed out in previous studies, it was confirmed that the contents of the terms and conditions were complex and extensive for users to understand the contents of the terms and conditions. And it was observed that the inclusion of measures to assist users in emergencies is relatively inadequate. Based on the results of this study, recommendations are as follows. First, it is necessary to add detailed information on how domestic platform use users’ personal information to the terms and conditions to reduce users’ privacy concerns. Second, it is necessary to indicate in detail the range in which users can use the content. Third, it is necessary to indicate active remedies for users and increase access to the terms and conditions. The limitations of this study are as follows. First, the four companies selected for comparison of domestic and foreign platform terms and conditions may not be sufficient to use text mining techniques. To compensate for this, a qualitative analysis was attempted together, but subsequent studies need to target more platforms’ terms and conditions. Second, the four companies selected in this study cannot be considered to represent the overall domestic and foreign platforms. Third, this study has the implication of directly comparing the terms and conditions of domestic and foreign digital platforms, but there is a limitation that it is simply compared. If the characteristics of the platforms’ terms and conditions are analyzed together with the legal basis of each country, the platforms’ main services and business models, more implications can be drawn.
