코로나19라는 전 세계적 대유행 감염병 상황에서, 우리 국가와 사회는 감염 방지를 위한 여러 대책을 수립하고 이를 이행하여 왔다. 본 논문은 그 노력 중 하나로 이루어진 감염병 예방을 위한 ‘개인정보 데이터’의 수집 · 활용 · 공개의 법적 근거와 현황 그리고 그 한계에 관하여 다룬다.
우리나라에서의 개인정보에 관한 일반법은 개인정보 보호법인데, 감염병 방지를 위한 개인정보의 수집 · 활용 · 공개는 감염병예방법에 주된 근거를 두고 있다. 미국, 유럽연합도 기본적으로는 개인정보를 엄격하게 보호하면서도, 감염병 상황 등 공중보건과 관련한 특수한 상황에서는 일정 부분 예외를 인정하고 있다. 다만 그 예외의 허용 요건과 범위는 우리나라, 미국, 유럽연합 사이에 다소 차이가 있다.
감염병 확산 방지를 위하여 개인정보 수집 · 활용 · 공개가 필요하다는 점을 부인하기는 어렵다. 다만, 인격권, 프라이버시권 및 그 구체화로서의 개인정보자기결정권과의 관계에서 그 한계가 없는 것은 아니다. 결국 이는 기본권의 제한과 관련된 문제이므로, 비례의 원칙을 준수하는 범위에서 개개인의 피해를 최소화하고 공익과 사익 사이의 균형을 달성하는 수준에서 이루어지는 것이 적절하다.
본 논문에서는, 위와 같은 비례의 원칙이 여러 관련 제도와 구체적인 사례에서 어떻게 적용될 수 있는지를 살펴보았다. 제도적 측면에서 출입명부의 작성, 위치정보를 포함한 정보수집과 공개의 범위, ‘감염병의심자’의 개념, 개인정보 보호법의 포괄적 예외 인정 등에 관하여 각 그 문제점과 개선방안을 확인하여 보았고, 구체적인 사례로서 대규모 위치정보 수집 사례, 정보공개로 인한 사생활 침해 사례 등을 토대로 공공의 이익과 개인정보자기결정권이 어떻게 조화를 이룰 수 있는지를 살펴보았다.
본 논의가 감염병으로부터 국민의 건강을 보호한다는 공익적 목적을 달성하면서도, 개개인의 인격권, 프라이버시권 및 그 구체화로서의 개인정보자기결정권이 조화롭게 균형을 이루는 데에 기여할 수 있기를 바란다.
In the context of the global pandemic of COVID-19, the Korean government and society have established and implemented various measures to prevent the infection. This study deals with the legal basis, current state, and limitations of the collection, use, and disclosure of “personal information data” for the purpose of preventing the infection of COVID-19.
In Korea, the Personal Information Protection Act serves as a general law on personal information while the Infectious Disease Control and Prevention Act pertains to the collection, use, and disclosure of personal information for the prevention of infectious diseases. The United States and the European Union also strictly protect personal information, but at the same time allow certain exceptions under special circumstances concerning public health, such as the outbreak of infectious diseases. However, when it comes to the requirements and scope of the exceptions, there are some differences between Korea, the United States, and the European Union.
No one can deny the necessity of the collection, use, and disclosure of personal information to stop the spread of infectious diseases. Nevertheless, there are still certain constitutional restrictions imposed on this sequence of information processing, especially concerning personality rights, right to privacy, and informational self-determination which derives from these rights. This ultimately leads to the question of the restrictions of basic rights: how to abide by the principle of proportionality by choosing the least restrictive means and maintaining the balance between public and private interests.
This study contemplates how the principle of proportionality can be applied in various relevant systems and specific cases. From an institutional aspect, this study examines the problems of current quarantine policies (such as COVID-19 entry pass, the collection of various information including location information and its scope of disclosure, the definition of “a person suspected of contracting an infectious disease” in Infectious Disease Control and Prevention Act, and comprehensive non-application of Personal Information Protection Act provisions) and their solutions. Through scrutiny of controversial cases concerning privacy violations due to large-scale collection and disclosure of location information, this study draws the measure to achieve harmony between the public interest and informational self-determination.
It is hoped that this study will contribute to accomplishing a harmonious balance between individual personality rights, the right to privacy, and informational self-determination while achieving the important goal of protecting people’s health from infectious diseases.
