헌법재판소는 2017. 11. 30. 선고한 2016헌마503 결정에서 변호인의 변호권, 즉 “피의자 및 피고인에 대한 변호인의 조력할 권리의 핵심적인 부분”이 헌법상 독자적 기본권으로 보호되는 권리임을 밝혔다. 그러나 이에 관하여 대상결정의 별개의견은 변호인의 변호권은 직업수행의 자유로 보호하면 충분하다는 입장에 섰다. 한편 대상결정의 반대의견은 변호인의 변호권은 헌법상 기본권이 아닌 법률상 권리에 불과하다고 하여 법정의견을 반박하였다. 본고는 이 결정을 분석함으로써 변호인의 변호권이 가지는 헌법적 의의를 밝힌다.
변호인의 변호권이 헌법적 의의를 가진다는 점은 분명하다. 변호인의 변호권은 헌법상 명시된 기본권인 형사피고인 등의 변호인조력권과 밀접한 관계에 있다. 이 점과 현행 관계법령의 한계 및 변호인 직무범위의 광범성을 함께 고려하면, 변호인의 변호권을 법률로만 보호하는 것은 불충분하다. 그렇다면 변호인의 변호권이 구체적으로 어떤 기본권인지, 곧 헌법상 독자적인 기본권인지 아니면 직업수행의 자유의 일부인지가 문제된다.
대상결정의 법정의견 및 보충의견(이하 “법정의견 등”)과 별개의견은 이 지점에서 서로 의견을 달리하는데, 그 근저에는 적극적 법해석론과 문언중심적 법해석론의 차이가 있다. 법정의견 등은 헌법의 개방성 · 추상성 · 사회성에 주목하는 적극적 헌법해석론에 따라 설명할 수 있다. 반면 별개의견은 헌법의 최고규범성 · 안정성을 중시하는 문언중심적 헌법해석론에 따라 설명할 수 있다.
문언중심적 법해석론이 엄격한 문언주의와는 구별되는 비원의주의적 입장에 서는 이상, 헌법은 법질서의 예측가능성을 확보하기 위하여 문언중심적 법해석론에 따라 해석하는 것이 타당하다. 이 관점에서 볼 때, 법정의견 등은 헌법 문언에서 합리적으로 도출할 수 있는 범위를 넘어서 독자적 기본권을 창설한 것이어서 부당하다. 변호인의 변호권은 별개의견의 입장과 같이 헌법 문언상 그 근거가 명백한 기본권인 직업수행의 자유로 보호하는 것이 타당하다. 다만, 변호인의 변호권이 가지는 특수성을 반영할 수 있도록 다른 직업수행의 자유보다는 더 두텁게 보호할 필요가 있다. 이상의 분석을 종합하면 변호인의 변호권이 법률상 권리에 불과하다고 주장하는 반대의견의 부당성은 더욱 분명해진다.
변호인의 변호권을 이와 같이 특수한 직업수행의 자유로 개념화하면, ‘변호인의 피의자신문 참여 운영지침’ 제5조(이하 “이 사건 행정지침”)는 그러한 기본권을 침해하여 헌법에 위반된다. 이 사건 행정지침은 일의적 집행행위를 예정하고 있어 대외적 구속력과 청구인에 대한 개별적 강제력이 인정된다. 따라서 이 사건 행정지침의 청구인에 대한 자기관련성 및 공권력행사성과 직접성이 인정된다. 이어서 본안에 관하여 판단하건대, 이 사건 행정지침은 법률유보원칙 및 과잉금지원칙을 위반하여 변호인의 변호권을 침해한다. 대상결정이 이 점을 간과하고 이 사건 행정지침에 관한 헌법소원심판청구를 각하한 것은, 변호인의 변호권을 보장하기 위하여 반드시 하여야 할 판단을 부당하게 회피한 것이다.
The Constitutional Court of Korea, in the decision 2016Hun-Ma503 delivered on November 30, 2017, stated that the right of attorneys to defend their defendants (RAD) is an independent basic right protected by the Korean Constitution. However, the concurring opinion of the decision claimed that it is enough to protect RAD as one subcategory of the right to occupation. Even more, the dissenting opinion of the decision argued that RAD is only a statutory right, not a constitutional one. This paper analyzes the decision in order to clarify the constitutional meaning of RAD.
It is clear that RAD has a significance in a constitutional sense. RAD is closely related to the constitutional right of access to a lawyer. Also, protecting RAD by statutes is insufficient, considering the limits of current legislation regarding attorneys and the wide scope of attorneys’ role. Then, the specific status of RAD as a constitutional right must be clarified. Is RAD an independent basic right, or is it a subcategory of the right to occupation?
The majority opinion of the decision and the concurring opinion have different answers to this question. At the basis of such clash is the difference between an active interpretation of law and a text-oriented interpretation of law. The majority opinion can be explained by an active interpretation of law which focuses on the openness, abstractness and sociality of constitution. On the other hand, the concurring opinion can be explained by a text-oriented interpretation of law, which underscores the supremacy and stability of constitution as a legal base.
Note that a text-oriented interpretation of law takes a non-originalistic view, unlike strict textualism. Based on this, interpreting the Constitution in text-oriented ways instead of active ways is more adequate to guarantee the predictability of the Constitution. On this perspective, the idea of the majority opinion to protect RAD as an independent basic right trespasses the rational range of interpreting Constitutional texts. The idea of the concurring opinion to protect RAD as a subcategory of the right to occupation is more justifiable, adding that RAD deserves a stronger protection than other typical categories of the right to occupation. Plus, according to the discussion above, the dissenting opinion, which protects RAD only as a statutory right, has a weak ground.
These are the reasons why this paper conceptualizes RAD as a special subcategory of the right to occupation. Article 5 of the Administrative Rule on Participation of Attorneys in Interrogation of Defendants, enacted by the Prosecutors’ Office, infringes such right and is therefore unconstitutional. The Article has a binding force to the claimant who filed this case and all the other attorneys who defend their defendants. This means that the Article is indeed a direct exertion of public force to the claimant. As a result, the Constitutional Court must proceed to decide whether the Article is constitutional or not, and declare the unconstitutionality of it because it violates the principles of statutory reservation and proportionality. On the contrary, the Constitutional Court dismissed the claim against the Article in this case; it is an undue avoidance of the critical judgment on the constitutional value of RAD.
