영국 의회에 제출되는 법률안은 그 성격 및 적용범위에 따라 일반법률안(Public Bills), 사적법률안(Private Bills) 및 혼합법률안(Hybrid Bills)으로 분류된다. 사적법률안(Private Bills)은 특정 개인이나 기관·단체 등에 특별한 권한이나 이익을 부여하는 법률안으로서 정부나 의원이 아닌 의회 밖의 개인 또는 기관 등에 의해 제출된다는 점에서 다른 법률안들과 차이가 있는데, 사적법률안을 제출하려면 의회대리인(Parliamentary Agent)을 고용하여야 하고, 사적법률안 입안과 의회처리과정은 의회대리인에 의해 수행된다.
의회에 제출된 사적법률안에 의해 특별하고 직접적으로 영향을 받는(specially and directly affected) 개인이나 기관 등은 의회에 해당 법률안에 대한 반대청원을 제출할 수 있고, 반대청원인 중 당사자적격이 인정되는 경우에는 위원회 청문에 출석하여 증언할 수 있다. 사적법률안을 심사하는 위원회(Committee on Opposed Bills)는 당사자적격이 인정되는 이해관계인들의 의견을 청취하고 대립하는 이해관계를 조정하는 것이 가장 큰 역할이고, 위원회 회의가 민사재판 절차와 유사하게 진행된다는 점에서 일반적인 입법과정과는 차이가 있다.
혼합법률안(Hybrid Bills)은 일반법률안과 사적법률안의 요소들이 혼합되어 있는데, 혼합법률안의 경우에도 이해당사자간 조정 및 타협이 필요한 경우에는 사적법률안에 대한 심의절차를 추가적으로 적용하고 있다.
의회의 법률안 심의과정에 관련 당사자간 이해관계를 조정하는 절차를 공식적으로 두는 것은 영국 입법과정의 특징으로 보이며, 우리나라 입법과정에는 없는 제도이다. 입법과정 에서 재판절차와 유사한 방식을 통하여 이해관계자들의 의견을 듣고 판단을 내리는 영국의 입법절차는 최근 특정 지역·단체 등의 이해관계와 관련된 특별법이 증가하고 있는 우리나라 입법과정에도 시사하는 바가 있을 것으로 보인다. 우리 국회에서도 법률안에 의해 직접적이고 구체적인 영향을 받는 이해관계인의 범위가 비교적 명확하고 제한적인 처분적 성격을 갖는 법률안의 경우에는 이해관계인이 입법과정에 보다 직접적이고 분명하게 의견을 낼 수 있도록 하는 방안을 검토해 볼 수 있을 것이다.
There are three different types of bills introduced in Parliament in the UK, according to their characteristics and application scopes. These can be classified to be as public, private and hybrid bills. Private bills have features differentiating from the other bills in that the bills confer particular powers or benefits on any specific individuals, institutions or organisations, being submitted by persons or organisations outside Parliament other than government or parliamentarians. The registered parliamentary agents shall be employed to be capable of introducing the bills as well as performing in the course of formulating and processing in the Parliament.
Any individuals or institutions to be specially and directly affected by a private bill have the right to petition against it and appear before a committee and testify should they have the admissible standing for the petition. The Opposed Bill Committee plays biggest role to hear the opinions of the interested parties and further to coordinate the conflicting interests, showing differences from the ordinary legislative process since it is to be proceeded similarly to the trial procedure in the civil court.
Hybrid bills have characteristics of both public bills and private bills, so that even such bills are to be additionally applied the hearing procedure of private bills if and when the coordination and compromise of the interested parties would seem to be required.
Recognising officially the systemic procedure for coordinating the interests of the parties concerned in the course of deliberating the bills is remarkable characteristic of the legislative process of the UK in typically contrast to Korea without having an equivalent system. The U.K.’s legislative process having such a procedure to be heard and judged in a manner similar to the trial procedure would favorably give us some suggestions for developing the advanced legislation since in recent years Korea has the increasing number of special acts relating to interests of particular regions and organisations, etc.
We might well attempt to introduce the system in the National Assembly of ROK for giving the interested parties the rights to be heard in order to be able to deliver their opinions more directly and clearly in the legislative process, provided that the submitted bills are to be of the dispositive nature to have specific impacts on the interested parties to be delineated more unambiguously and restrictively in terms of the extent thereof.
