피해자의 처벌불원 의사에 의존하는 형사절차에 대한 포스트식민주의적 비판 = Criticism against Korean Criminal Procedure ’ s Dependence on “ Victim’s Unwillingness to Punish ” : A Post-colonial Perspective

한국의 형사절차에서 피해자의 처벌불원 의사는 반의사불벌죄의 소추조건이자, 피해자가 있는 일반 범죄의 양형에 가장 중대한 영향을 미치는 인자이지만, 현실에서는 피해자의 처벌불원 의사에 좌우되는 형사절차가 피해자에 대한 2차 가해와 사회적 갈등의 원인이 되고 있다. 그럼에도 불구하고 법조인들 사이에서는 국가형벌권의 행사 여부와 정도가 피해자의 처벌불원 의사에 좌우되는 현상이 개인적 법익에 관한 죄에서는 법익의 주체인 피해자의 의사를 존중하고 신속한 피해 회복이 이루어지는 점을 고려하여 국가형벌권이 자제되어야 한다는 관념으로 정당화되고 있다. 이 글은 피해자의 처벌불원 의사에 좌우되는 형사절차가 피해자의 의사 존중을 이유로 정당화되는 현상을 포스트식민주의 관점에서 비판하기 위하여, 형법 제ㆍ개정 자료집, 국회 회의록, 대법원의 판결례를 분석하는 방법으로 우리 형법에 피해자의 처벌불원 개념을 만들어낸 반의사불벌죄가 창설된 배경과 이후 현대 한국의 입법과 사법에서 피해자의 처벌불원 의사에 관한 관념이 형성되는 역사적 과정을 재구성해보았다. 먼저, 제정형법 입법자들이 친고죄 규정을 일부 개정해 반의사불벌죄를 창설한 의도는 국가의 이익을 최우선하고 개인에게 법익 침해를 감수하게 하는 식민지 시기 법과 제도에 담긴 국가주의를 수용하면서도 지배계급 남성 피해자의 의사를 존중하고 그에 대한 형법상 보호를 확대하기 위한 것으로 보인다. 그런데 이후 현대 한국에서 반의사불벌죄 입법과 사법에서는 피해자의 의사 존중과 신속한 피해회복만 입법목적으로 부각되었고, 피해자에 대한 형법상 보호를 위태롭게 하는 현실적인 역기능은 비가시화되었다. 그 결과 피해자의 처벌불원 의사에 따라 국가형벌권의 행사가 자제되는 것을 피해자의 의사 존중과 신속한 피해회복을 이유로 정당화하는 관념이 형성되었지만, 피해자의 진정한 의사가 반드시 표시된 처벌불원 의사와 일치하는 것인지, 피해자의 진정한 의사와 표시된 처벌불원 의사가 부합하지 않는 경우에도 국가형벌권의 행사가 자제되어야 할 규범적 근거는 무엇인지에 대한 의문은 제기되지 않았다. 이는 처벌불원의 판단기준에 관한 대법원의 판례와 양형실무에서 처벌불원을 표시한 피해자의 진정한 의사가 소외되는 문제를 낳았다. 결론적으로, 피해자의 다양한 의사를 처벌불원이라는 소극적 의미로 한정 짓고 피해자의 처벌불원에 의존하면서 이를 피해자의 의사 존중이나 신속한 피해회복을 이유로 정당화하는 형사절차는 근본적으로 재고되어야 한다.
더보기In the Korean criminal procedure, “the victim’s unwillingness to punish” is a procedural prerequisite for “offences unpunishable over objection,” and at the same time the most significant factor in determining the punishment for ordinary offences. Such dependence on “the victim’s unwillingness to punish,” in reality, is the source of secondary victimization and social conflict. Nevertheless, the legal profession tends to justify leaving the decision of whether the state can exercise its punitive authority - and if yes, to what extent - up to “the victim’s unwillingness to punish,” based on the idea that the state should refrain from exercising its punitive authority, especially in crimes against personal liberties and properties where the will of victim should be best reflected and rapid restoration should be achieved.
This paper takes a post-colonial perspective in criticizing the phenomenon that criminal procedure’s dependence on “the victim’s unwillingness to punish” is justified in the name of respecting victim’s intention. In order to do so, it reconstructs the background of the establishment of “offence unpunishable over objection” and the historical process of the formation of how the notion of “the victim’s unwillingness to punish” was formed around modern Korean legislature and judiciary, by analyzing enactment and amendment records of the Criminal Act, National Assembly records, and Supreme Court rulings.
To begin with, in establishing “offence unpunishable over objection” through revising some provisions regarding “offence subject to complaint,” the legislators of the first Criminal Act of 1953 seem to have had the intent to prioritize state interest and put individuals’ legal interests at risk - a manifestation of nationalism contained in the legal system and institutions of the colonial era - while also respecting the will of male victims of the ruling class and extending criminal protection for them. However, among the legislative purposes, only respecting the victim’s will and rapid restoration were highlighted in the modern legislative and judicial discussion regarding “offence unpunishable over objection” and the practical disadvantage of undermining criminal protection for victims was for gotten. This has led to the notion that justifies the non-exercise of state’s punitive power depending on “the victim’s unwillingness to punish” in the name of respecting the victim’s will and rapid restoration; but no question was raised regarding whether the manifested “unwillingness to punish” matches the genuine intent of the victim, and what is the normative basis of restraining the exercise of state’s punitive power even when the genuine intent of the victim does not match the manifested “unwillingness to punish.” Consequentially, the genuine intent of the victim who expressed “unwillingness to punish” has been alienated from Supreme Court rulings regarding the standard of “unwillingness to punish” and sentencing practices. In conclusion, the criminal procedure that limits various intents of victims into “unwillingness to punish,” depends on “the victim’s unwillingness to punish,” and justifies such dependence in the name of respecting victim’s will and rapid restoration, should be fundamentally reconsidered.
