인공지능 및 빅데이터와 최대선의원칙의 고찰 -정보비대칭과 상법상 고지의무를 중심으로- = A Study on Artificial Intelligence, Big Data and the Principle of Utmost Good Faith -Focusing on Information Asymmetry and the Duty of Disclosure under the Insurance Law-

전통적으로 위험정보가 보험계약자에게 편중되어 있다는 정보비대칭의 전제 아래 강조된 보험계약의 최대선의성은 보험자에게만 유리하게 적용된다는 비판을 받아 왔다. 그런데 우리는 IT 기술발전과 함께 보험자가 대량의 빅데이터나 계약자의 위험정보에 용이하게 접근하고, 정교한 인공지능 알고리즘을 통해 위험측정과 분석을 고도화해 가는 상황을 목격하고 있다. 이러한 인슈어테크 발전 현황에 비추어, 최대선의원칙에 관한 새로운 조망이 필요할 수 있다는 출발점에서 본 연구를 진행하였다.
정보비대칭 역전 및 빅데이터를 활용한 난해한 인공지능 의사결정과정 등 기술의 자율판단 영역이 증대하는 미래 환경에서는, 기존의 구체적 법조항으로 해결하기 어려운 다양한 분쟁상황이 발생할 수 있다. 여기서 최대선의원칙 또는 선의원칙이 여전히 폐기하거나 배제해야 할 구시대적 대의(大義)인지 고민이 필요하다. 위와 같은 고도의 기술발전 환경에서 최대선의원칙은 오히려 보험자의 행동원칙이나 보험소비자의 피해구제책으로 활용될 가능성이 커지게 된다. 예를 들어 보험자는 데이터 분석결과나 알고리즘 관련 사항을 보험계약자에게 공개해야 할 수 있는데, 인공지능 환경에서 그러한 보험자의 정보제공의무는 최대선의 원칙이 토대가 된다. 본래 동 원칙은 보험계약자의 고지의무뿐만 아니라, 보험자의 정보제공 의무도 포함하는 상호성에서 출발하였다. 보험자로서도 단순히 정보제공이라는 범위를 넘어서 최대선의의무 이행으로 공정·정직의무를 충실히 이행해야 하며, 그 안에는 공정성, 합리성 등의 개념도 내포되어 있다. 보험자의 최대선의의무를 좀더 구체화할 수 있는 예로는 머신러닝이나 알고리즘의 확인·설명의무, 부수적 정보제공의무, 보험료 산출에 관한 왜곡 금지의무 등을 들 수 있다.
한편, 머신러닝 모델이 제공하는 위험예측 추론은, 상관관계를 기반으로 하며 반드시 인과관계를 전제로 하는 것은 아니다. 그런데 상관관계만 고려하는 경우, 극도로 고도화된 인공지능에 의해 보험사고와 잠재적으로 관련이 있는 모든 사항이 인수여부나 요율산정에 반영된다. 이 경우 기존보다 보험계약자의 고지위반에 관한 책임영역을 대폭 확장시키는 결과를 야기할 우려가 있으므로, 향후 고지의무 이행기준의 조정이 필요할 수 있다. 또한, 보험계약자는 보험자에게 전송된 위험정보가 무엇이고 그 영향이 어떤 것인지 알 필요가 있으므로, 보험자로 하여금 위험측정에 관한 정보를 가입자에게 공개하고 확인을 받는 절차가 필요하다.
보험 분야에서 인공지능 알고리즘의 자율적 결정과 실행은 앞으로 계속 발전하고 확대될 것으로 예상된다. 복잡하고 난해한 기술적 환경에서, 최대선의원칙은 오히려 보험자의 의무를 확대할 토대가 되고 보험계약자에게 유리하게 적용될 가능성이 크다. 여기서 보험계약의 전통적인 특성으로 여겨졌던 최대선의원칙의 의미가 다시 부각되는 것이다.
Traditionally, the principle of utmost good faith of insurance contract has been emphasized due to information asymmetry biased towards policyholders, but it has been criticized for being advantageously applied only to insurers despite the modernization of the insurance environment. As the use of digitized data expands, the traditional information asymmetry is also changing. It is also argued that there are some problems on the principle of utmost good faith, which is biased toward the policyholder's obligations, and that the duty of disclosure needs to be revised.
However, along with the development of IT technology, we are witnessing a phenomenon in which insurers easily access to a substantial amount of big data or risk information of contractors, and advance the risk measurement and analysis through sophisticated artificial intelligence algorithms. In such a situation, it is necessary to consider whether the principle of utmost good faith is still an outdated value that should be discarded or excluded. In a future environment where the area of autonomous judgment increases, such as the reversal of information asymmetry and the complicated AI decision-making process using big data, various dispute situations that are difficult to resolve with the existing specific legal provisions may arise. In such a case, the principle of utmost good faith is more likely to be used as a principle of action for insurers or as a remedy for damage of insurance consumers. For example, an insurer may need to disclose data analysis results or algorithm related matters to the policyholder. In an AI environment, the insurer’s duty to provide information would be based on the principle of utmost good faith. Originally, the principle of utmost good faith started from reciprocity, which includes not only the policyholder's duty to disclosure, but also the insurer's duty to provide information. As an insurer, the insurer must also faithfully fulfill its obligations of fairness and honesty by fulfilling its obligations in the best good faith beyond simply providing information. Examples of concrete examples of the insurer's utmost good faith obligation include the duty to confirm and explain machine learning or algorithms, the duty to provide incidental information, and the duty to prevent distortion in insurance premium calculation.
On the other hand, the inferences provided by machine learning models, such as risk prediction, are based on correlations and are not necessarily causal in the specific problem of fulfilling the duty of disclosure. When only correlation is considered, all matters potentially related to insurance accidents are reflected in the underwriting or rate calculation by extremely advanced artificial intelligence. In this case, there is a risk that the policyholder's responsibility for the violation of notification may be significantly expanded compared to the existing case, so it may be necessary to adjust the standards for fulfilling the duty of disclosure in the future. In addition, since the policyholder needs to know what risk information is transmitted to the insurer and what its impact is, there is a need for the insurer to disclose information about risk measurement to the insured and receive confirmation.
The autonomous decision and execution of artificial intelligence algorithms in the insurance field is expected to continue to develop and expand in the future. In a complex and esoteric technological environment, in conclusion, the principle of utmost good faith is likely to be judged in favor of policyholder as the basis for insurers' obligations. Here, the meaning of the principle of utmost good faith, which was considered a traditional characteristic of insurance contracts, is emphasized again.
