1949년 유엔 국제법 위원회의 성문화를 위한 14개 주제 중 하나인 국가면제에 대해서 유엔 국제법 위원회는 1991년에 국가 및 그 재산의 관할권 면제에 관한 초안을 최종 채택하였다.
국가면제에 대한 이 초안은 이제까지 국제관습법으로 형성되어 온 국가면제에 대한 국가들의 관행과 각 국의 국가면제법을 반영하여, 국가면제의 현재 발전 상태를 보여주고 있다.
이 초안은 5개 분야 22개 조항을 포함한다. PartⅠ(Introduction, 제1조-제4조)는 초안 적용의 개인적, 물질적, 시간적 영역을 규정한다. 가장 중요한 정의들은 제2조에 포함되어 있다. Part Ⅱ(제5조-제9조)는 재판과정 법규로서 면제를 제5조 에서 설명하고 있다. 제6조는 면제 준수를 위한 법정지국의 의무를 특정화하고 있다. 제7조-제10조는 일반적으로 인정되는 면제포기상황을 포함한다. Part Ⅲ(제10조-제17조)는 소송 중인 재판과 관련된 재판에서 면제에 대한 예외를 포함한다. Part Ⅳ(제18조-제19조)는 집행으로부터의 면제에 대해 다룬다. Part Ⅴ이하에서는 잡칙들로 특히 절차적 문제들을 규율한다. 제20조가 송달에 대한 것이고, 제21조는 결석재판을 다룬다. 제22조(1)는 외국에 대한 절차적 강제 부과를 막는다.
그리고, 영국, 미국, 오스트레일리아, 캐나다를 포함하여 각 국의 국가면제법의 발전을 살펴보고 있으며 또한, 각 국의 판례들을 통해서 각 국의 국가면제 적용에 대한 태도를 검토하고 있다. 특히 19세기부터 판례들을 통해 국가면제에 대한 국가 관행이 존재해왔던 영국과 미국의 경우를 중심으로 판례들을 살펴보고 있다.
국가면제에 관한 유럽협약이 채택되었고, 그 후 그 체약국들이 협약을 받아들이면서 국가면제법을 제정하게되었다. 1991년 유엔 국제법 위원회가 국가면제에 관한 초안규정을 채택하기 전에 제정된 영국과 미국 그리고 영연방 국가들의 국가면제법들과 국가면제에 관한 유럽협약이 초안 규정에 반영되어, 국가면제 발전을 가져왔다고 할 수 있다.
그렇지만, 국가면제라는 주제에 있어서 거래와 계약의 상업적 기준, 상업적 행위(jure gestionis)와 같은 문제는 아직 논의가 더 필요하다고 할 수 있겠다. 국가의 경제적 활동이 증가하고 있는 현실을 고려하면, 국가면제에 관한 초안은 국제경제관계 개선과 개인들의 법적 보호 가능성 증진에 기여할 것이다. 이러한 목적을 위해서, 주권면제에 대한 더한 제한들을 받아들일 수 있는 다자간 협약이 필요하다고 본다.
Concerning one of the subjects for codification of UN International Law Commission at 1949, namely, State Immunity, in 1991 UN International Law Commission finally adopted the Draft Articles on Jurisdictional Immunities of States and Their Property.
Draft on State Immunity indicated recent development of State Immunity by reflecting practices of States and States Immunities Act of countries regarding State Immunity which is formulated as international custom.
The Draft contains 22 Articles which are divided into five sections. Part Ⅰ (Introduction, Articles 1-4) regulates the personal, material and temporal sphere of application of the draft, the most important definition being contained in Article 2. Part Ⅱ(Article 5-9) prescribes in Article 5 immunity as the rule for trial proceedings. Article 6 specifies the forum State's obligation to observe immunity. Articles 7-10 contain the generally recognized circumstances where immunity is waived. Part Ⅲ(Articles 10-17) contains exceptions to immunity for trial proceedings associated with the property under the dispute. Part Ⅳ (Articles 18-19) concerns immunity from enforcement. Part Ⅴ under the heading Miscellaneous Provisions regulates in particular procedural questions, while Article 20 concerns notification, and Article 21 the handing down of judgements in absence. Article 22(1) bans the imposition of procedural constraints on foreign States.
And, this document inspects the development of State Immunities Act of countries including the United Kingdom, the United States of America, Australia, Canada. In addition, it also examines the manners of countries to the application of State Immunity through cases which are rendered by domestic courts.
After it had be adopted to the European Convention on State Immunity, Contracting States enacted State Immunity Act adopting the Convention.
State Immunities Acts of countries such as the United Kingdom, the United States of America, and commonwealth, and the European Convention on State Immunity which are enacted before UN International Law Commission finally had adopted the Draft Articles on State Immunity lead the development of Status of State Immunity.
Regarding the State Immunity, however, jure gestionis and the criteria for attributing a 'commercial' character to contract or transactions are still needed to more discussion. If it regards circumstances that commercial activities of States are increasing, Draft on State Immunity contribute to improving international economic relations and improve private persons' possibilities for legal protection. For this purpose, it further restriction of State Immunity should remain necessary even if a multilateral convention.
