오늘날 우리 사회는 ‘난민’이라는 새로운 문제에 맞닥뜨리고 있다. 난민은 인종, 종교, 국적, 특정 사회집단의 구성원 신분 또는 정치적 견해를 이유로 박해를 받을 수 있다고 인정할 충분한 근거가 있는 공포로 인하여 국적국의 보호를 받을 수 없거나 보호받기를 원하지 아니하는 자로서 난민보호는 국제적 인권보장의 측면에서 매우 중요하다. 그러나 현재까지 우리 사회는 난민에 익숙하지 않고, 어떠한 절차를 통해 난민으로 인정되는지 잘 모르는 경우가 많다.
사실 난민인정 심사와 난민재판은 신뢰할 만한 자료나 증거가 거의 없는 상태에서 주로 신청인의 진술에 의존하여 박해 가능성을 판단하는데, 만일 진정한 난민이 난민으로 인정받지 못한다면 생명, 신체 또는 자유에 대한 위협을 당할 수 있는 국가로 강제송환될 수 있으므로 고도의 전문성이 필요하다. 한편 난민신청자는 빠른 시일 내에 난민인정자의 지위를 부여하여 보호할 필요성이 있는 반면에 오로지 체류기간 연장과 취업허가만을 받을 목적으로 난민인정 신청을 할 수도 있으므로, 난민인정 심사와 난민재판은 신속하고 효율적으로 운용될 필요가 있다.
이 연구보고서는 위와 같은 문제의식을 바탕으로 우리나라의 난민인정과 재판 절차의 운용 현황을 살펴보고, 공정하면서도 신속한 절차 운용을 위한 개선 방안을 찾는 것을 목적으로 한다.
먼저 우리나라의 난민인정과 재판 절차의 현황을 살펴본다. 난민법과 관련 규정에서 정한 절차를 개관하고, 서울출입국관리사무소, 서울행정법원 등을 방문하여 심사 과정과 재판을 방청하여 실제 운용 현황을 확인하는 한편, 법무부 통계연보와 법원 사법연감 등을 통해 통계 현황도 파악한다. 법무부 난민과와 서울출입국관리사무소 담당자, 유엔난 민기구 담당자, 난민 관련 공익활동을 하는 변호사, 국내외 난민법 권위자인 교수와 변호사, 민간단체 대표, 난민사건을 담당하였던 판사들을 대상으로 현행 절차의 운용에 대한 인터뷰와 설문조사를 하여 그 결과를 반영한다.
다음으로 난민보호에 앞장서 온 대표적인 국가들의 절차와 그 운용을 비교법적으로 살펴본다. 구체적으로 미국, 영국, 캐나다, 호주, 뉴질랜드, 독일, 프랑스, 일본의 절차와 제도를 검토하고, 각국의 통계를 통해 그 운용 결과를 살펴본다. 여러 나라의 난민인정과 재판 절차를 검토할 때는 공정하면서도 신속한 절차가 있는지, 우리나라와 비교할 때 실질적으로 어떠한 차이가 있는지를 확인하여 우리 제도의 개선을 위한 시사점을 찾는다. 아울러 유엔난민기구와 유럽연합 등이 수립한 국제적 기준도 소개한다.
마지막으로 우리나라 난민인정과 재판 절차의 개선 방안을 실무적, 제도적 차원에서 모색한다. 출입국항에서 난민인정 신청에 따른 회부심사, 출입국관리사무소 등에서의 난민인정 심사, 법무부 난민위원회에서의 이의심사, 법원의 난민재판과 같이 단계별로 절차의 개선 방안을 제시하되, 실무 운영·정책적·입법적 개선 방안을 다각적으로 살펴본다.
일반적으로 개인이 법률상 보장된 권리를 실효적으로 행사하기 위해서는 이를 실현할 수 있는 적정하고 공평한 절차가 전제되어야 하고, 정의는 행해져야 할 뿐만 아니라 행해지는 것으로 보여야 한다는 국제적 원칙에 비추어 현재의 난민인정과 재판 절차가 보다 공정하게 운용될 수 있는 방향에서 개선점을 모색한다. 그러나 여러 번 심리를 거친다고 하여 반드시 공정한 절차가 보장된다고 단정하기 어려움에도 우리나라는 행정청부터 법원에 이르기까지 네 차례에 걸쳐 사실관계를 계속 심리하는 구조를 취하고 있으며, 패소판결 확정 이후에도 별다른 사정변경 없이 재신청하거나 신속한 심리가 필요한 유형의 신청자에 대하여 실질적으로 특별한 절차를 적용하고 있지 않다. 따라서 신속하고 효율적으로 운용되는 방향에서도 개선점을 모색함으로써 궁극적으로 절차가 공정하고 신속하게 진행될 수 있도록 균형 있게 개선 방안을 제시하되, 진정한 난민에 대한 보호가 상위의 우선적 가치이고, 절차의 효율성 증대는 이러한 우선적 가치를 증진하기 위한 것임을 염두에 두기로 한다.
이 연구보고서가 우리나라의 난민인정과 재판 절차를 개선하는 데 밀알이 되기를 기대해본다.
Since Korea’s first Refugee Act came into force in 2013, the number of people seeking asylum in Korea has rapidly increased―the number of applications for refugee status was 2,896 in 2014, 5,711 in 2015, and it climbed to 7,542 in 2016. The number of refugees filing a suit for judicial review of refugee status determination in courts has also increased with 423 filings in 2014, 1,220 in 2015, and a staggering 3,161 in 2016. But the rates of refugee recognition in Korea have been decreasing, and they still remain far less than the average rate of refugee recognition among OECD countries. It has been argued that Korea’s low rate of refugee recognition is caused, at least partially, by the fact that the procedure for refugee status determination has not been designed and operated in a manner that is fair and efficient.
The procedure for refugee status determination requires considerable expertise because not only must decision makers determine whether claimants are likely to be persecuted in their countries of origin, but they must make these determinations under challenging circumstances. These decisions frequently rely on scant and unreliable evidence, often based solely on testimony by claimants who do not speak the local language and who have a strong interest in the outcomes of their claims. These decisions also pose significant risk because false negatives may result in refugees being deported to countries where they face persecution, torture, or even death―a result that would put Korea in breach of international law. Despite these challenges and risks, decision makers―including government officers, adjudicators and judges who are already burdened with heavy caseloads―are encouraged to decide cases as quickly as possible to not only stabilize the status of claimants, but to also prevent those who are not refugees from trying to use the asylum procedure as a means of extending their stay in Korea while they seek a work permit. Experience shows that the longer the procedure is protracted, the more likely the procedure is to be abused. Due to these special characteristics of the refugee status determination procedure, it is important that the procedure be thoroughly designed and performed in a manner that is fair and efficient.
This research examines the current state of Korea’s procedure for refugee status determination and judicial review, and offers suggestions for devising a fairer and more efficient asylum procedure that could better meet the goal of the system. In doing so, this research examines the following. First, this research examines how Korea’s procedure for refugee status determination and judicial review have been designed and performed, and identifies problems in the current procedural system. To accomplish this, the present research examines provisions of the Refugee Act and the relevant regulations on the refugee status determination procedure; it also analyzes statistical data provided by the Ministry of Justice and the National Court Administration on the rates of refugee recognition and of appeals at each stage of the procedure. In addition, this research analyzes the results of interviews and surveys of experts, including refugee adjudicators, judges, professors, public interest lawyers, and legal officers from the United Nations High Commissioner for Refugees (UNHCR) regarding the state of the current procedure. By doing so, this research shows that the current procedure needs to be improved to be fairer by improving the claimants’ procedural satisfaction from the refugee status application stage through the judicial review stage, and to be more efficient by developing procedural safeguards that prevent those with manifestly unfounded claims from abusing the procedure.
Second, this research conducts a comparative legal analysis of procedures for refugee status determination and judicial review in other countries―including the United States, the United Kingdom, Canada, Australia, New Zealand, Germany, France, and Japan― which may shed light on how Korea could improve its refugee adjudication and trial procedure. In particular, this research provides an overview of each countries’ refugee laws, policies, and procedures, and examines what kinds of procedural mechanisms were adopted to make the procedure fair and expedient. It also introduces international standards on the procedures for refugee determination, particularly developed by the UNHCR and European Union.
Finally, this research offers suggestions for improving each and every stage of the procedure, from the refugee status application stage through the judicial review stage. In the pursuit of protecting refugees’ human rights, the values of efficiency and fairness often come into conflict. In a system burdened by many applicants and few decision makers, efficiency often becomes the prevailing value; however, while efficiency is undoubtedly important, fairness must be the ultimate goal. With these principles in mind, this research introduces suggestions for improving both fairness and efficiency. By offering these recommendations, this research aims to help establish a fairer and more efficient asylum procedure in Korea.
