조세특례 적격 연구개발 및 연구개발비의 범위에 대한 비교법적 연구- 영국, 미국, 일본을 중심으로 - = A Comparative Study on the Scope of R&D and R&D expenses Eligible for Tax Incentives- Focusing on the R&D Tax Incentives in the UK, US and Japan -

이 연구는 「조세특례제한법」제10조에서 규정하는 연구개발비 세액공제제도와 유사한 외국(영국, 미국, 일본)의 조세특례제도에 대하여 살폈다. 비교분석은 특례 적격 연구개발과 연구개발비의 범위를 중심으로 이루어졌다. 연구결과는 다음과 같다.
영국과 미국은 특례 적격 연구개발의 범위에 대하여 자세하게 규정한다. 영국은 연구개발은 과학 또는 기술의 진전을 달성하기 위한 프로젝트에서 발생하고, 과학적 또는 기술적 불확실성의 해소를 통하여 과학 또는 기술의 진전에 직접적으로 기여하는 활동이 연구개발이 된다고 특례 적격 연구개발을 정의한다. 미국은 내국세입법 제174조의 특정연구실험비로 취급될 것, 기술적 정보 발견을 위하여 수행될 것, 정보의 적용이 신규 또는 개선된 사업 구성요소의 개발에 유용하도록 의도될 것, 활동의 실질적 전부가 적격 목적과 관련되는 실험과정의 요소를 구성할 것 등을 적격 연구활동의 요건으로 규정한다. 영국과 미국 모두 과학의 범위에 예술, 인문학, 사회과학은 포함되지 않는다고 규정한다. 한편 결과의 불확실성에 대하여 영국은 해당분야의 유능한 전문가를 기준으로 판정하나, 미국은 명문으로 해당분야 유능한 전문가 기준을 배제한다. 일본은 비교적 간략하게 법규에서 연구개발을 정의하고, 과세관청의 해석준칙에서 자세한 사항을 정하고 있다. 일본은 해석에 의하여 과학은 자연과학 등에 한정되고, 결과의 불확실성을 요구한다고 인정한다. 영국, 미국, 일본 모두 우리나라와 같이 인건비 등이 연구전담부서등 관련 지출일 것을 요구하지 않는다.
비교법적 고찰을 통하여 도출된 시사점은 다음과 같다. 조특법에 명확하고 완결된 연구개발 정의규정을 두는 것이 바람직하다. 특히 연구개발로 인정되기 위하여는 활동 결과의 불확실성이 요구된다는 점, 결과의 불확실성을 수행자 및 특례신청기업 기준으로 판정한다는 점 및 과학 또는 기술이 자연과학과 및 관련 기술에 한정된다는 점을 명확히 규정할 필요가 있다.
조특법상 적격 연구개발비 요건으로서 연구전담부서등 관련 비용 요구는 다툼을 줄이고자 하는 데 목적이 있으므로, 제도취지에 부합하도록 많은 다툼을 일으키는 연구전담부서등 관련 지출 비용 요건을 완화할 필요가 있다. 특히 중소기업의 연구전담인력에 관한 다툼이 많고, 연구전담인력의 겸직 인정으로 인한 중소기업의 부담이 크므로 중소기업의 연구전담인력 요건을 완화하는 방향으로 법령을 개정할 필요가 있다.
우리나라의 발전 방향을 급격히 변경하여 외국의 제도를 따를 필요는 없을 것이나 명확성 요구에 부합하고 법적안정성 확보, 다툼 방지에 보탬이 되는 외국의 제도는 참고할 필요가 있다.
This study examined the tax incentive system in foreign countries (UK, US, and Japan) that are similar to the R&D tax credit system stipulated in Article 10 of the Act on Restriction on Special Cases Concerning Taxation(ARSCCT). The comparative analysis centered on the provisions regarding the definition of R&D and the scope of R&D expenses eligible for tax incentives. The findings are as follows.
The U.K. and the U.S. have detailed rules on the scope of tax incentive eligible R&D(‘eligible R&D’). The U.K. defines eligible R&D as follows; “R&D for tax purposes takes place when a project seeks to achieve an advance in science or technology. The activities which directly contribute to achieving this advance in science or technology through the resolution of scientific or technological uncertainty are R&D.” The U.S. sets forth the requirements for qualifying research activities including that they be treated as section 174 specified research experiments(section 174 test), that they be performed for the discovery of technical information(discovering technological information test), that the application of the information be intended to be useful in the development of a new or improved business component(business component test), and that substantially all of the activity constitute elements of an experimental process related to a qualifying purpose(process of experimentation test). Both the U.K. and the U.S. define science as not including the arts, humanities or social sciences. Regarding uncertainty of outcome of a project, the UK uses the standard of a competent professional working in the field. while the U.S. explicitly excludes the standard of a competent expert in the field. Japan defines R&D relatively briefly in its acts and regulations, and provides more detail in its interpretive guidelines. By interpretation, Japan recognizes that science is limited to the natural sciences and requires uncertainty of outcome. The U.K, the U.S, and Japan do not require expenses to be related to the R&D departments or centers(RDDC), as Korea does.
The implications derived from this comparative legal study are as follows. It is desirable to have a clear and complete definition of R&D in the ARSCCT. In particular, it is necessary to clearly stipulate that uncertainty of outcome of the activity is required in order to be the eligible R&D, that uncertainty of outcome is determined on the basis of the performer of project and the tax incentive applicant, and that science or technology is limited to natural sciences and related technologies.
Since the requirement for expenses related to RDDC as a requirement for eligible R&D expenses under the ARSCCT aims to reduce disputes between taxpayers and taxing authorities, it is necessary to relax the requirements for expenses related to RDDC that cause many disputes. In particular, there are many disputes over whether full time research staffs in small and medium-sized enterprises are dual-employed, so it is necessary to revise the law to relax the requirement for the full time researchers.
