조국 광복의 사명을 이룩하고 우리에게 조국을 되찾아주신 할아버지 세대와, 경제발전과 민주화의 사명을 다하여 우리에게 물질적 풍요와 정치적 자유를 물려주신 아버지 세대에 이어, 작금의 시대를 살아가는 나와 이 세대에게는 조국 통일의 사명을 완수할 역사적 책임이 있다. 그러하기에 그들이 그토록 꿈꾸던 그 독립의 날이, 이제 우리에게는 한반도 통일의 날일 것이다. 조국의 독립을 염원하며 분투한 선조들의 소망이 광복으로 이루어진 것처럼 남북의 화해와 한반도 통일을 위해 분투하는 우리 세대의 소망 또한 반드시 이루어질 것이라 새기며 본고를 작성해본다. 한반도의 분단 해소와 겨레의 민족 화해를 통한 평화 통일은 대한민국 헌법 전문과 제4조, 제66조 제3항에서 명문으로 규정하고 있다. 위와 같은 헌법상 통일 관련 규정들은 통일의 달성이 우리의 국민적 · 국가적 과제요 사명임을 밝힘과 동시에 자유민주적 기본질서에 입각한 평화적 통일 원칙을 천명하고 있다. 남북교류협력의 필요성은 우선 ‘비적대적 남북 분단’ 상황의 마련을 위한 남북 긴장 완화와 한반도의 평화 정착에 있다. 또한, 통일을 대비하는 차원에서도 필요하다. 남북경협 활성화와 북한 경제 회생 지원 등 통일 이전에 경제 부문의 점진적·단계적 통일 준비는 통일비용에 대한 부담을 줄이고, 이를 통해 통일에 대한 국민들의 거부감 완화와 통일 의식 제고에 매우 중요한 역할을 한다. 결국, 남북교류협력의 최우선 목표는 한반도의 평화 통일 구축에 있고, 이를 전제로 비적대적 남북관계 형성을 위한 남북교류협력은 기본적으로 중단이나 변개됨이 없는 지속성을 그 원칙으로 해야 할 것이며, 그 발전 방향도 최대한 일관성을 유지하면서 장기적인 안정성을 보장하는 방향으로 나아가야 할 것이다. 「남북교류협력법률」 제3조에서 ‘목적 범위에서’라는 문구는, 국가보안법의 적용이 배제되고 남북교류협력법률이 적용되어 금지규범이 허용규범으로 전환되는 요건으로서 행위자의 처벌 여부가 좌우되는 중대한 기준이 되는 바, 불명확한 요소가 있어 행정기관의 자의적 집행과 법관의 자의적인 판단이 가능할 수 있다는 우려를 남기므로 본 조항에 대한 명확한 기준을 제시하여 개정할 것이 요구된다. 또한, 남북교류협력사업 추진 과정에서 급격한 남북관계의 경색 등 경영 외적인 사유로 발생한 손실에 대한 보상규정을 정비할 것이 요청된다. 그리고 「남북관계발전법률」 제23조 제2항은 대통령에게 일정한 경우 발효된 남북합의서의 효력을 정지시킬 수 있는 권한을 부여하고 이 경우 국회의 동의를 얻도록 하고 있다. 남북 합의서 내용에 대한 효력 정지 여부를 모두 대통령에게 일임할 것이 아니라, 그 합의서 중에 어떤 경우에도 반드시 지켜져야 할 것으로 요청되는 부분, 교류협력의 본질적 사항을 정한 핵심 내용이 담긴 조항은 대통령의 효력 정지권 행사대상에서 유보시킬 필요가 있다. 남북교류협력은, 남북 긴장 완화와 평화 구축을 통한 적대적 분단 상황 개선 및 평화통일 달성이라는 헌법상의 의무이행을 위하여, 정치·군사적인 남북관계의 부침에도 불구하고 일관성과 지속성을 가지고 추구해야 할 것이다. 상호주의 원칙과 더불어, 인도주의와 동포애를 바탕으로 북한의 도발과 신뢰 파기에도 불구하고 자발적 호혜를 베푸는 희생의 결단이 또한 필요하다. 지속적인 남북 교류협력은 남북 상호간 신뢰 증진과 이질감완화 및 한민족 경제공동체 건설과 비적대적 남북관계로의 전환을 이루고, 결국 남북 정치공동체 형성을 이끌어 내는 마중물의 역할을 할 수 있을 것이다.
더보기Our generation including myself has the historical responsibility of fulfilling the mission of unification of the two Koreas. We have the obligation to follow the footsteps of our grandparents’ generation who liberated this country from the Japanese colonial rule as well as our fathers’ generation who achieved economic development and democratization. In this sense, the aspiration of our generation would be the unification of the divided Korean peninsula just like Korea’s independence used to be the dream of the older generation. The past generation dreamt of Independence and their dream came true. In this regard, I am writing this paper believing that our generation’s hope, the reconciliation of the two Koreas and the unification would be achieved someday. The Constitution stipulates the need for alleviation of conflict on the Korean peninsula and the peaceful unification through reconciliation in its Preamble, Article 4 and Article 66 Paragraph 3. The unification-related provisions under the Constitution show the achievement of unification is a national challenge as well as the mission of our times. They also assert a peaceful unification process following the basic principles of liberal democracy. The inter-Korean exchange and cooperation is necessary in order to alleviate tension between two Koreas and bring peace to the Korean peninsula as a way to prepare for the next stage, “the division of the two Koreas without hostility.” It is also crucial for the unification preparation. The gradual and step-by-step unification preparation in the economic sector such as bolstering economic cooperation between two Koreas and helping the North Korean economy to revive prior to the actual unification reduces the unification cost. Also, the economic cooperation beforehand plays an important role in making Koreans less hostile to unification and raising their awareness. The ultimate priority of the inter-Korean exchange and cooperation lies in establishing a peaceful and unified Korean peninsula. With this clear goal in mind, the inter-Korean exchange and cooperation for creating favorable inter-Korean relations shall follow the rule of continuity without any halt or change in the process, the rule of consistency in its future directions and the rule of stability ensuring long-term endurance. In Article 3 of the 「Inter-Korean Exchange and Cooperation Act」, there is the phrase, “to the extent of the purposes of this Act.” This phrase prescribes the exclusion of the application of the National Security Law. Instead, it enables the application of then Inter-Korean Exchange and Cooperation Act thereby changing the prohibition rule to permission rule. As whether to punish perpetrators becomes an important standard, there are many unclear elements. It therefore brings about concerns of arbitrary implementation from the Administration and arbitrary judgement from lawyers. Therefore, the law needs to be revised based on clear standards about the provisions. Furthermore, compensation standards need to be in place for losses caused by external factors such as drastic deterioration of the inter-Korean relations in the process of implementing exchange and cooperation projects. In Article 23 Paragraph 2 of the 「Development of Inter-Korean Relations Act」, it is stipulated that when it is deemed necessary, the President may suspend all or part of effects of each South-North Korean agreement and the President is required to get consent from the National Assembly. Giving the President the full authority to decide whether to suspend the effects of South-North Korean agreement should be refrained. Rather, the provisions which shall be followed at all times and essential to the cooperation should be deferred from the President’s power in suspending the agreement. Despite fluctuations in the inter-Korean relations in political and military sectors, inter-Korean exchange and cooperation must be pursued with consistency and continuity in mind in order to fulfill the obligations of the Constitution, improving the hostile division environment and achieving a peaceful unification through reducing tension and building peace on the Korean peninsula. Based on mutual understanding, humanitarianism and brotherly love, the South Korea should commit itself to provide reciprocal assistance voluntarily despite the North’s provocations and breaking of promises. Continuous exchanges and cooperation between the two Koreas would lead to a favorable inter-Korean relations and ultimately play the role of priming water that gives rise to the foundation of an inter-Korean political community.
