폐기물처리업의 영업구역제한에 관한 일고찰 ― 폐관법 제25조 제7항 단서를 중심으로 ― = A Study on the Business Area Restriction of Waste Treatment Businesses - Focusing on the clues to Article 25, Paragraph 7 of the Waste Management Act -

폐기물관리법 제25조 제7항 단서는 폐기물 반입제한 등 영업구역을 제한할 수 없도록 하는 명시적 규정이다. 대법원은 이에 관한 직접적 판례는 없지만 폐기물관리법 제25조 제7항이 영업구역제한에 관한 규정이라는 점은 명시적으로 인식하고 있다. 최근 하급심판결에서 폐기물관리법 제25조는 폐기물처리업 허가에 관한 일반적 규정이라고 보고, 산집법상 관리권자는 산단운영관리에 관한 광범위한 재량을 가진다고 하여 폐기물관리법이 아닌 산집법 등을 우선 적용하였다. 산집법에 따라 산단 관리권자의 광범위한 관리행위에 따라서 산단내 폐기물처리업자도 규제를 받을 수 있다. 그러나 관련법령을 고려할 때 폐관법 제25조 7항 단서에 근거하여 “영업구역을 제한”하는 것만은 산단 관리권자라도 할 수 없다고 해석하는 것이 타당하다. 결과적으로 최근의 하급심 판례는 법적용의 오류로 인하여 실정법체계 혼란을 야기하여 법적 안정성을 훼손한 대표적 사례로 평가된다. 이와 같은 법적용의 오류와 별개로, 영업구역제한금지의 정당성 여부에 관해서는 견해가 대립할 수 있다. 해당 처리시설의 인근 주민입장에서는 타지역 폐기물까지 반입이 되어 주변환경이 악화되는 등 불만이 고조되고 있으며, 이와 같은 갈등은 전국에 걸쳐서 발생하고 있는 것이 현실이다. 산단외 폐기물반입으로 인하여 쾌적한 환경을 향유할 환경권 침해는 물론 “폐기물 발생지 또는 근접지 처리원칙” 등 환경정의에도 부합되지 않는 측면이 있다. 현재까지 산단내 반입제한을 위한 시민단체등의 입법개정 시도는 지속되고 있지만 입법통과는 기대하기 어렵다. 그 이유는 폐기물매립시설이 대부분 산업단지 내에 위치하고 있는데, 산단외의 폐기물 반입을 제한하게 되면 처리용량의 약 70%에 해당하는 산단외의 폐기물을 처리할 수 없기 때문이다. 즉 산단외 처리시설의 절대적 부족으로 폐기물처리에 커다란 문제가 발생할 수밖에 없다. 결론적으로 현행법 해석상 산단외 폐기물반입을 제한할 수 없다는 점에서 문제해결을 위해서는 입법개선이 요구되며, 다만 산단외 폐기물처리시설의 부족 등 현실을 감안하여 산단외의 일정지역을 한정하여 폐기물 반입을 허용하는 방안이 적절하다고 본다. 즉 산단내 폐기물처리장의 운영과 관련하여 향후 대응방안으로서 폐기물발생지역에서의 우선처리원칙에 보다 충실하게 입법개선을 할 필요가 있다. 타 시・도의 폐기물반입은 향후 법 개정을 통하여 금지하는 것을 원칙으로 하는 것이다. 더 나아가 최근에 제정된 공공폐자원법상의 공공폐자원관리시설의 운영 등 관련내용과 폐기물처리의 사회적 공공성 등을 고려하여 차제에 전면적인 폐기물처리시설의 공공운영방안을 적극 검토할 필요가 있다.
더보기The clues to Article 25, Paragraph 7 of the Waste Management Act are explicit regulations that prohibit restrictions on business areas, such as restrictions on carrying in waste. Although there is no direct precedent for this, the Supreme Court explicitly recognizes that Article 25, Paragraph 7 of the Waste Management Act is a regulation on business area restrictions. In a recent sub-judgment, Article 25 of the Waste Management Act was reported as a general regulation on permission for waste treatment business, and the management authority under the Industrial Cluster Act had broad discretion on the operation and management of the industrial complex. However, in consideration of related laws and regulations, waste treatment companies within the industrial complex may also be regulated according to the industrial complex management authority's extensive management practices according to the Industrial Collective Law. However, it is reasonable to interpret that the industrial complex management authority cannot only limit the business area. Such lower-level trial precedents are evaluated as a representative case that damaged legal stability by causing confusion in the actual legal system. However, the provisions of the proviso of Article 25, Paragraph 7 of the current Waste Management Act, which prohibits restrictions on business areas such as the prohibition of bringing in waste to the industrial complex, can no longer be justified on the basis of the reality of waste disposal such as lack of landfill. From the perspective of residents, they are filing civil complaints such as legislative improvement, claiming that the surrounding environment is deteriorating due to the introduction of waste from other areas. Nevertheless, attempts to amend the legislation to restrict entry into the industrial complex continue to date, but it is difficult to expect a legislative passage. The reason is that even though most of the waste landfill facilities are located in the industrial complex, if the import of waste outside the industrial complex is restricted, there will be an absolute shortage of facilities that can treat the waste outside the industrial complex, which is about 70% of the treatment capacity. In relation to the operation of waste treatment plants in the industrial complex, it is necessary to improve the legislation more faithfully to the principle of priority treatment in waste generating areas as a future countermeasure. However, it is a principle to limit the scope of the import of waste to metropolitan cities and provinces, and to prohibit the import of waste from other cities and provinces through future revision of the law. Furthermore, considering residents' complaints regarding waste disposal, such as bringing in waste, and social publicity of waste disposal, it is necessary to actively review the public operation plan of the waste disposal facility.
