비의료인이 개설자격을 위반하여 의료법인 명의 의료기관을 개설·운영하였는지 여부에 관한 판단 기준 = Standards for Determining Whether Non-medical Personnel Established and Operated Medical Institutions in Violation of Qualifications for Establishment

대상판결의 쟁점은 비의료인이 개설자격을 위반하여 의료법인 명의 의료기관의 개설·운영하였는지 여부를 판단함에 있어서도 주도성에 바탕을 둔 기존 대법원 판례의 법리를 그대로 적용할 수 있는지, 의료법인의 본질적 특성, 의료법인 제도에 관한 구 의료법의 규정 취지 등을 반영하여 수정할 필요가 있다면, 구체적으로 그 판단 기준을 어떻게 설정하여야 하는지이다.
종래 대법원 2011. 10. 27. 선고 2009도2629 판결 등은 의료인 개인 명의 의료기관의 경우 비의료인이 개설자격을 위반하여 의료기관을 개설·운영한 것으로 판단하는 기준으로, ‘비의료인이 그 의료기관의 시설 및 인력의 충원·관리, 개설신고, 의료업의 시행, 필요한 자금의 조달, 그 운영성과의 귀속 등을 주도적인 입장에서 처리하는 것’이라고 판시하여 왔다. 소비자생활협동조합법에 의하여 설립된 소비자생활협동조합 명의로 의료기관 개설신고가 된 경우에도 위와 같은 ‘주도권 법리’를 그대로 적용하여 왔다(대법원 2014. 8. 20. 선고 2012도14360 판결 등 참조).
그러나 의료법인 명의 의료기관의 경우 기존 주도권 법리를 그대로 적용하여 개설자격 위반 여부를 판단할 경우 죄형법정주의 원칙, 특히 명확성의 원칙에 반할 수 있고, 수범자인 비의료인으로서는 의료법인 명의 의료기관 개설·운영과 관련해서 어떠한 행위가 허용되고 어떠한 행위가 처벌대상이 되는 것인지를 구별하고 예측하는 것이 사실상 불가능할 수 있다. 비의료인이 의료법인 명의 의료기관의 개설·운영 등에 필요한 자금의 전부 또는 대부분을 의료법인에 출연하는 것이나, 의료법인 명의 의료기관의 개설·운영에 관여하고 나아가 주도하는 것을 금지하는 규정이 없고, 제3자의 재산출연, 의사결정, 업무집행이 없으면 의료법인의 설립 및 의료법인 명의 의료기관의 개설·운영이 불가능하기 때문이다. 의료법인 제도가 의료인이 의료기관 개설·운영을 기피하여 의료기관 수가 현저히 적은 의료취약지역에 의료법인 명의 의료기관이 개설·운영되도록 함으로써 의료기관의 지역적 편중을 해소하고 의료취약지역 주민에게도 수준 높은 의료서비스를 제공하기 위하여 도입된 것이라는 점에 비추어 보더라도, 의료법인 명의 의료기관은 비의료인의 주도적 자금 조달과 주도적 개설·운영을 예정하고 있다고 볼 수 있다. 따라서 의료법인 명의 의료기관이 개설자격을 위반하여 개설·운영되었는지 여부에 관하여 기존 주도권 법리를 그대로 적용할 수는 없고, 의료법인의 본질적 특징이나 의료법인 제도의 도입 취지 등을 고려한 판단 기준이 적용되어야 할 것이다.
의료법인 명의 의료기관이 개설자격을 위반하여 개설·운영되었는지 여부를 판단하는 구체적 기준으로는 다양한 견해가 상정될 수 있다. 의료법인 설립절차와 관련된 각종 하자는 물론, 의사결정절차의 하자, 비의료인의 의사결정절차 지배, 환자유인, 무면허 의료행위 등의 존재 여부, 재산혼용, 재산유출 등 의료법인 배후의 비의료인을 실질적 의료기관 개설·운영자로 평가할 수 있는 각종 요소들을 모두 철저히 고려하여야 한다는 이른바 종합고려설도 나름의 설득력이 있을 수 있다. 그러나 종합고려설의 경우, 의료법인 명의 의료기관 개설·운영과 관련된 비의료인의 행위 중 어느 것이 허용되고 어느 것이 금지되는 것인지에 대한 예측가능한 답변을 제시하기 어려운 측면이 있다. 다양한 ...
The main issue of Supreme Court en banc Decision 2017Do1807 decided July 17, 2023 (hereinafter the “subject case”) lies in whether the legal principle of the previous precedents rendered by the Supreme Court based on the initiative is applicable in determining whether a non-medical practitioner established and operated a medical institution under the name of a medical corporation in violation of the qualifications for the establishment thereof and how to establish such standards specifically if they need to be rectified by reflecting the essential characteristics of medical corporations and the purpose of the former Medical Service Act regarding the medical corporation system.
The previous precedents, including Supreme Court Decision 2009Do2629 decided October 27, 2011, have ruled that, in the case of a medical institution established under the name of a medical practitioner, whether a non-medical practitioner established and operated a medical institution in violation of the qualifications for the establishment thereof should be determined on the basis of whether the non-medical practitioner initiatively handled the facilities, and manpower supplement and management, of the medical institution, a report on its establishment, the enforcement of medical services, the acquisition of necessary funds, the reversion of its operation performance, etc. The “legal principle of initiative” mentioned above has also applied in the case where the establishment of a medical institution is reported under the name of a consumer cooperative established pursuant to the Consumer Cooperatives Act (see, e.g., Supreme Court Decision 2012Do14360, Aug. 20, 2014).
However, in the case of a medical institution established under the name of an medical corporation, if whether a medical institution violated the qualifications for the establishment thereof is determined by applying the previous legal principle of initiative, this may be contrary to the principle of legality, particularly, the principle of clarity, and it may be impossible for a non-medical practitioner, a person who should follow the law, to distinguish acts allowed from those subject to punishment and predict acts allowed or prohibited in relation to the establishment and operation of a medical institution under the name of a medical corporation. This is because there is no provision prohibiting a non-medical practitioner from donating all or most of the funds necessary for the establishment and operation of a medical institution under the name of a medical corporation to the medical corporation or initiatively engaging in the establishment and operation of a medical institution under the name of a medical corporation, and the establishment of a medical corporation and the establishment and operation of a medical institution under the name of a medical corporation are impossible unless a third party donates property, makes decisions and executes duties. Even in that the medical corporation system was introduced to relieve the unequal distribution of medical institutions and provide high-quality medical services for the residents living in the medically vulnerable areas by allowing medical institutions under the name of medical corporations to be established and operated in the medically unreserved areas where medical institutions are remarkably small in number as medical personnel evade the establishment and operation of medical institutions, a medical institution under the name of a medical corporation is expected to initiatively receive the funds from, and be initiatively established and operated by, a non-medical practitioner.
