회갑을 맞이하면 60년 인생을 뒤돌아보고 앞날을 전망하듯 대한민국 헌법, 그 기초 위에 설립된 대한민국의 60주년을 되돌아보고 앞날을 전망함은 당연한 일일 것이다. 더구나 새 정부가 들어선 금년 초에 일어났던 과격불법촛불시위는 우리나라 민주정치의 근간이 되는 법치주의와 의회주의를 다시 한번 생각하게 하는 계기가 되었다. 그리하여 우리나라 민주주의를 회고하고 전망하는 작업을 우리나라 법치주의와 의회주의(대의정의 원리)를 중심으로 하여 행하려하는 것이 이글의 목적이다. 위의 과격불법시위가 법치주의 화두를 불러왔지만 분석적으로는 법치주의(the rule of law)가 아니라 실은 법치 내지 준법(the rule by law)의 문제를 제기하였다는 것이 우리의 생각이다. 우리나라 헌법은 건국초기 제헌헌법부터 법치주의(기본권보장 및 위헌법률심사제도는 대표적 예)는 성문헌법의 불가분의 하나였으며 지금까지 한 번도 이로부터 벗어난 적이 없었다. 다만 헌법규범에 어긋나는 정치현실(인권탄압, 위헌법률심사제도의 작동정지 등)을 권위주의시대에 우리가 겪었던 것이다. 이론적으로 법치주의와 경제발전을 연계시키는 것이 보통인데, 우리는 권위주의시대에 적어도 경제발전의 도약단계를 겪었기 때문에 권위주의 중국의 경제발전과 우리의 그것을 함께 묶어서 설명하는 일이 많으나, 자유민주주의 헌법 자체가 아예 없는 중국과 그러한 헌법이 있던 우리의 사정은 다르다고 믿는다. 우리의 경우에 경제발전이 가져온 자유주의적 효과(예컨대 중산층의 성장 등)가 종국에는 성문헌법규범과 정치현실의 갭을 없애는 결과를 가져왔는데, 이것이 우리가 부르는 민주화(1987)이다. 법치 내지 준법은 법치주의 이전에 근대국가의 속성이다. 그것은 통치비용을 절감케 하기 때문이다. 위의 과격불법촛불시위는 우리나라 사회에 이 법치 내지준법의 문제를 제기한 것이다. 이것이 되지 않으면 법치주의도 민주주의도 시장경제도 사상의 누각이 될 수밖에 없는 기초의 문제인 것이다. 시위자측이나 이에 대처하는 정부측에서나 다 이 문제를 제기하였다. 사실 법보다 예의를 존중하였던 유교전통의 타락 때문이었든 군주시대, 일제, 권위주의시대의 생존의 필요성 때문이었든 우리나라 사회에는 법을 도덕이나 양심의 문제로 보기 보다는 법을 가볍게 보거나 편의주의적으로, 아니면 오로지 수단적으로만 보는 정서가 있어 법치(준법)를 저해하는 요인으로 작용한다. 동시에 사회에 존재하는 연고주의(인맥)가 또한 법치의 작용을 저해한다. 나아가 상당히 높은 부패인지지수가 보여주는 바와 같은 부패의 만연이 법치를 저해함을 우리가 알고 있다. 우리나라에서는 법치주의에 문제가 있는 것이 아니라(법치주의는 잘 하고 있다!) 법치에 문제가 있는 것이다. 누구나 다 잘 알고 있는 바와 같이 국민대표기관이자 입법기관인 국회는 그 기능이나 구조적으로 (대통령 못지 아니하는) 국가의 중추기관의 하나이다. 국회의 기능은 국민의 다양한 의사를 반영하여 하나의 국가의사(입법 등)로 통합하는 것(국회의 정치력)인데, 이 점에서 헌법(즉 국민)의 기대에 훨씬 미치지 못하고 있다. 또 구조적으로 국회는 대통령의 영향력으로부터(여당의 경우), 정당이나 정파나 지역주의로부터(여야당 모두) 얼마나 독자적인지 의문이다. 그러한 의미에서 우리나라에서는 의회주의가 위기인 것이 아니라 실패하고 있는 것이다. 이와 같이 우리나라의 의회주의가 보여주는 바와 같은 헌법규범과 정치현실의 현격한 괴리현상을 놓고 우리가 의회주의를 전망하면서 제기하여야 하는 문제는 어떻게 하면 이 괴리현상을 제거하고 의회주의(의회가 나라정치의 중심이 되는 원리)를 헌법규범의 기대에 맞게 현실로 만드느냐의 문제가 되어야 한다. 이러한 시각에서 정치인들을 중심으로 하여 제기되고 있는 개헌논의는 국민의 눈을 돌려보려는 정국전환용이지 정당성도 필요성도 발견할 수 없다. 더구나 전 세계적인 경제위기에 직면하여 지금 우리가 개헌논의로 시간과 정열을 허비할 만큼 한가한 상황도 아니다. 나아가 의회주의가 전제가 되는 내각책임제로의 개헌은 위험천만한 작란이라고 판단된다. 왜냐하면 독자의 정치력을 발휘할 줄 모르는 국회가 어떻게 입법부·행정부를 능률적으로 꾸려나갈 수 있다는 것인지 알지 못하기 때문이다.
더보기The violent candle-light riots in the center of the capital city Seoul had nearly paralyzed not only the traffic flows but also the normal functions of the newly inaugurated governments for months in early 2008. And the National Assembly had not been even convened until the middle of August. Naturally the riots gave rise to a nationwide debate on the topic of the rule of law, particularly its necessity as the prerequisite for democratic process and the market economy, versus the constitutionally provided freedom of speech and assembly and the principle of popular sovereignty. They had caused observers to give serious thoughts as well to the state of parliamentary government in Korea. The republic of Korea (South Korea) was established in 1948 on the basis of the free democratic Constitution whose features included both the rule of law and the principle of parliamentary government. As compared with the performance of Japanese judicial review of legislation institution, Korean judicial review has been extremely active, particularly since 1987 when Korean society become finally democratized. During the authoritarian phase in 1960s, 1970s and early 1980s, there existed a gap in Korean society between the formal written free democratic constitutional norms and the political practices which were autocratic. The take-off stage of Korean economic development overlaps the authoritarian phase, however. In any case, the political practices now came to live up to what the formal constitution provides, particularly political freedoms and rights, and judicial review of legislation is firmly embedded in Korean society today. And yet the critical views against judicial review on counter-majoritarian ground have been voiced, following the presidential impeachment trial and the unconstitutionality ruling of the capital city relocation act in 2004, reminiscent of American counterpart debates waged for many years. Korean criticism against judicial review seems, however, to carry little justification precisely because of the written constitutional provisions endorsing clearly the judicial review of legislation, the Constitutional Court at that. What has mattered with the rule of law as aftermath of the candle-light riots concerned with the respect for the law (rule by law) rather than the rule of law as such. For lack of the respect for the law, along with personal ties and corruption, may disturb democratic political order and market rules. Constitutionally the National Assembly is provided as a co-equal department of the government to the President. Politically speaking, however, the legislature has not been up sufficiently to what the constitution provides in terms of its performances and in terms of its autonomy structurally from other sources of power such as the President, political parties, and supporters. It is striking that the representative organ tends simply to reflect political conflicts and divisions that already exist in society and is not doing very well its function to integrate those conflicts and divisions into well-done pieces of legislations and resolution. Its failure particularly in performing its integration functions tends to lead to the increases of constitutional litigations. The president impeachment case and the capital relocation act case are only a few examples. The failure of the legislative organ in performing its representing and integrating functions while living up to the constitutional expectations also tends to be accompanied by street demonstrations and riots and by an increased netizen communications that are quickly to be described by radicals as direct democratic expression of the people. The candle-light riots may be cited as an example. It is also related to the popular distrust of professional politicians and their ambitions. The politicians in power turn to proposals in favor of constitutional amendment to take popular attention away. There are strong popular expectations for the National Assembly to attain its constitutionally provided status as the representative organ empowered with legislative functions and supervisory powers over other departments of the government. Otherwise, the popular idea of introducing a parliamentary form of government into Korea may well be leading to another failure with such form of government. The kind of popular(constitutional) expectations toward the National Assembly is another expression of respect for the constitution.
