전자소송시스템 하에서 전자적으로 저장된 정보에 대한 증거현출 및 조사방법 : 미국의 입법례와 세도나 원칙을 중심으로 = Evidence Production and Discovery Methodology against Electronically Stored Information under the Electronic Litigation System - focusing on the Changes of U.S. Legislature and Sedona Principles

전자소송이 도입됨으로서 여러 가지 제도상의 변화를 경험하게 되는데 가장 급격한 소송환경의 변화는 아마도 변론과 증거조사가 아닐까 생각한다. 이 논문은 전자소송시스템 하에서 전자적으로 저장된 정보의 증거제출과 증거조사에 도사리고 있는 잠재적인 함정과 그 혜택을 논의하고자 한 것이며 전자증거의 제출과 조사에 관한 법규범의 발전을 위한 추가적인 계속 논의를 해야 할 필요성에서 작성되었다. 현재 민사소송법이나 민사소송규칙은 전자증거의 현출과 그 조사방법에 대하여 적절한 조치를 마련해 놓지 않고 있다. 따라서 전자증거와 관련하여 아직 해결되지 않은 수많은 쟁점들이 존재하는데 그 해결책을 비교법적 조사와 검토를 통하여 해결하고자 하였다.
본고에서는 우선 전자소송이 도입됨으로써 변화하게 되는 소송환경의 내용을 설명하였다. 그 중에서도 전자증거의 제출과 증거조사에 대한 일반적인 사항을 언급하였다. 이어서 미국의 FRCP에서 규정하고 있는 전자증거개시 제도를 설명하고 시사점을 얻고자 하였다. 특히 연방법원의 전자소송환경에서 쟁점이 된 전자증거개시 절차에 초점을 맞추어 논의하였다. 다음으로는 세도나 원칙과 전자증거개시를 소개하였다. 또한 전자증거개시를 둘러싼 비용부담의 문제를 논하고 결론을 제시하였다.
전자증거는 전통적인 종이문서와는 다른 형태로 다양한 매체들에 저장되어 있으므로 향후 이를 소송법에서 어떻게 취급해야 하는지 많은 논의가 있을 것으로 예상된다. 미국에서는 판사, 변호사 등의 법률가와 법학교수 및 산업계의 전문가들이 모여 전자소송과 관련된 쟁점들에 대하여 토론하고 해결책을 찾아 이를 입법에 반영하고 법률실무에 적용하는 세도나 회의와 같은 기구가 만들어져 있다. 여기서 논의된 내용을 본고에 소개하였다. 이와 같은 선순환 구조와 모범사례가 우리나라에도 등장하였으면 좋겠다. 우리나라는 미국과 달리 증거개시제도가 존재하지 않으므로 미국의 입법례를 그대로 받아들일 수는 없겠으나 전자소송이 본격적으로 시행되게 되면 우리가 예측하지 못한 상황들이 발생하게 될 것이고 이때에는 본고에서 논의한 미국의 선례가 좋은 참고자료가 되리라 생각한다.
I explored the evidence production and discovery methodology against electronically stored information under the electronic litigation system focusing on the changes of U.S. legislature and cases in this work. It can be easily imagined that the most sudden change of litigation environment is perhaps the oral pleadings and the examination of evidence by introducing the electronic litigation system. This piece aimed that lawyers must realize the potential trap and benefits which result from the production and examination of the electronically stored information. In addition, this article was written for the necessity of further argument of the digital evidence and the procedural rules that regulates the litigation procedure for the electronic evidence presentation and its investigation. Currently, Korean Civil Suits Procedural Act and Civil Litigation Rules have not stated the rules for the evidence production and discovery methodology against electronically stored information. Therefore, I tried to provide some solutions and make suggestions through the research and comparative study of the foreign jurisdictional lesson in this article.
First, the change of the litigation environment by adopting electronically governed civil suits was described. General issues related to the presentation and examination of the evidence was explained in the relevant part. Subsequently, e-discovery system in the U.S. Federal Civil Procedural Rules was described and I desired a better understanding of the amendment of FRCP which reflected the advancement of computer technology. Particularly, the argument was focused on the e-discovery procedures. Next, the Sedona Conference and e-discovery was introduced. In this part, some Sedona Principles were explained for the reference in the revision of the Civil Act and Procedural Rules. Finally, electronic evidence related issues including litigation costs were mentioned to obtain suggestive lesson.
I expect that the electronic evidence is clearly different from the traditional paper form of evidence in type and we need to further discuss how this should be treated in the evidence presentation and examination procedure. In U.S., judges, practitioners, law professors, and experts of the industry are frequently talking about the electronic evidence at the conference and they bring out great ideas. Those traditions contribute to the development of the law as well as the end products of the meeting and are well applied in the law practice. In this manuscript, I covered such wonderful U.S. legal culture. I hope that the virtuous circle between the earnest discussion and law reform becomes a reality and appears as a role model to the legislative process. I know Korea may not directly adopt the U.S. legislature because there is no e-discovery system but the explanation and argument of the electronic evidence presentation and examination procedure in this work would make great contribution towards the new era of the launching of the electronic litigation system.
