9 · 11후 對테러戰爭과 國際法的 問題 : 아프가니스탄과 이라크 戰爭을 중심으로 = The US War on Terrorism and International Law: Focusing on Its Justifiability and Legality of Afgan and Iraqi War

국제법 학자들은 하나같이 무력행사의 대의명분과 필요성, 선전포고 및 전쟁수행 정부의 유무, 그리고 전쟁 개전의 정당한 이유, 무력행사의 비례성, 다른 선택이 전무한 긴박성 등을 정당전쟁(자위권 행사의 정당성)의 조건들로 내세웠다. 이들 주장에 따르면 테러리즘의 경우 전쟁개시를 하는 책임있는 정부가 존재하지 않기 때문에 그들이 말하는 소위 ‘聖戰’이란 이름의 테러리즘은 정당한 전쟁이 결코 될 수 없다고 봐야 한다.
첫째, 자위권 행사 즉 정당전쟁에서 무력행사의 필요성이란 침략을 저지할 수 있는 다른 선택이 전무할 경우를 일컫는다. 둘째, 비례성 원칙이란 자위권행사가 외부 무력침략을 저지할 정도에 그쳐야 함을 말한다. 일부 학자들은 첫 공격무력에 비례해야 하고 침략자에게 입히는 손실도 피해국가에 입힌 손실에 정비례해야 한다고 주장하지만 이는 틀린 논거이다. 피침국가가 먼저 공격한 상대측을 물리치기 위해서는 적을 압도할 만한 무력행사가 있어야 적을 격퇴할 수 있고 미래 공격을 미연에 방지하기 위해서는 적에게 입히는 무력행사가 질적 양적으로 동일할 수 없기 때문이다. 셋째, 긴박성의 조건이란 역시 19세기 미국-영국간의 캐롤라인호사건에서 도출된 “즉각적이며 압도적 위험성” 조건에 근거한 자위권 행사의 법적 논리이다. 아프가니스탄의 탈레반 정권은 자국 영토를 공격거점으로 삼은 알카에다 조직의 對美 테러를 중지시킬 의도가 없었다.
여기다 알카에다는 9.11 테러 공격을 비롯하여 1998년 케냐등 동부 아프리카지역 주재 미국대사관에 대한 공격이래 세계 여러곳에서 일련의 연속적 대미 테러 공격을 가해왔고 오사마 빈 라덴은 장래에도 연속적으로 대미 테러를 가하겠다고 공언해 왔다. 그는 미국에 대항, ‘聖戰’을 선포하고 미국인과 이스라엘인들을 살해할 것을 촉구했다. 오사마 빈 라덴은 1993년 미국 무역센터 폭파와 2000년 예멘에서의 미해군 소속 콜호 공격으로 미국에 의해 테러리스트 범인으로 지명 수배받고 있었다.
따라서 자위권 행사의 긴박성에 대해서 미국의 아프가니스탄 공격은 이와 같은 미국에 대한 알카에다 조직의 진행중인 테러리즘(군사행동)에 대한 긴박한 반격이라고 해야 옳다. 알카에다의 9.11 테러는 미국에 대한 한번의 고립된 단일 공격이 아니라 10여년간에 걸친 연속 공격이며 오랜 세월 계속될 수도 있는 일련의 연속적인 테러의 하나인 것이다.
2001년 10월 7일 미국과 연합국의 아프가니스탄 공격(이하 10 · 7 공격)이 아프간의 영토침범이란 반론도 있다. 유엔헌장 2조 4항은 타국의 영토보전(領土保全)에 대한 무력사용을 금지하고 있다. 무력침공은 침략행위가 된다. 따라서 10 · 7무력공격의 경우 영토보전과 자위권이란 두가지 권리가 서로 상충된다.
그러나 국제법은 국가에게 자국 영토가 타국에 대한 폭력행위(테러리즘)를 범하는데 이용되지 못하게 금지할 책임을 지우고 있다. 이런 국제법 원칙은 〈국가간 우호와 협력관계의 국제법원칙 선언〉(the Declaration of Friendly Relations)과 〈테러리즘 근절조치에 관한 선언〉, 탈레반 정부에게 자국 영토상에서 테러리스트들이 활동하지 못하게 금지토록 요구한 〈9 · 11이전 유엔안전보장 이사회의 여러차례에 걸친 결의안 등〉에 나타나고 있다.
만약 어떤 국가가 이런 국제법적 의무를 준수할 수 없거나 할 의향이 없을 경우 피침국가들은 자국에 대한 무력위협을 제거하고 종지부를 찍기 위해서 그 국가의 영토를 공격할 수 있는 것이다. 이런 자위권에 관해서는 여러 경우가 있는데 캐롤라인호 사건이 대표적 실례이다. 미국등 연합국의 알카에다에 대한 10 · 7 무력공격도 영국군의 캐롤라이나호 격침과 같은 법적 성격을 갖고 있는 것이다.
미국과 영국은 이런 적법한 절차를 거쳐서 자위권 행사의 목적으로 무력공격을 개시했기 때문에, 이 경우 두나라 군대가 아프간 국경을 침범한 행위는 합법적 행위이다. 미국은 9 · 11테러이전인 2001년 6월 탈레반 정권에 대해서 만약 알카에다의 테러활동을 중지시키지 않으면 이 테러조직이 범한 어떠한 테러범죄에 대해서
Scholars of International Law stress that self-defense (just war) should meet conditions of necessity of armed attack, formal declaration of war, existence of appropriate war-conducting government, just cause of invasion, the use of proportionate force and instant overwhelming, apparent imminent danger leaving no choice of any other means.
Therefore they assert that terrorism in the name of 'jihad' (holy war) cannot be considered just war because responsible appropriate governmental authority which declares war does not exist.
First, in case of self-defense namely, just war, necessity requires that the resort to force occurs only when no reasonable other options remain to frustrate continuation of armed attack.
Second, principle of proportionality should meet condition of the degree to which victim state country hold back the invader. A certain scholar wrongly argue that defensive responses must be limited to those actions necessary to defeat the armed attack. This is clearly an inaccurate statement of law, for to successfully defend against the initial attack and prevent future anticipatory attack may require more force than used against the victim state. Therefore victim state cannot maintain qualitatively and quantitatively the collateral damage caused against it.
Third, immediacy criterion of self-defense derived from the legal theory of 19th century American-British Coroline Conflict that is "immediate, overwhelming danger". Taliban regime of Afganistan has no intention of preventing 9/11 terror by the Afganistan based al-Qa' ida against the United States.
In addition to that, al-Qa' ida that perpetrated 9/11 terror attacks against New York WTC has already done a series of terror attacks against U.S in many places of world since they had attacked American embassies in Eastern African countries including Kennya in 1998. Osama bin Laden, mastermind of al-Qa' ida made pubic that he would attack U.S. continuously.
He declared 'jihad' (holy war) against America and calls upon members of al-Qa' ida to kill Amerian and Israel people. Osama bin Laden is wanted terrorist by U.S. government for perpetrating bomb attacks against New York WTC in 1993 and USS Cole in the port of Aden, Yemen, on 12 October 2000.
Therefore as to the criterion of immediacy of defensive self-help, American attack against Afganistan should be construed as counter-attack against al-Qa' ida's imminent ongoing terrorism against U.S. September 11th attack did not represent a single, isolated incident, but rather one in a series of attacks that stretched back for nearly a decade and may be expected to continue for a number of years to come.
Additional issue raised by the October 7th coalition airstrikes involves the violation of Afgan territory. Article 2(4) of the United Nations Charter prohibits the use of force against the territorial integrity of another state. Such an use of force may constitute an act of aggression. Therefore, two conflicting rights were counter-poised on October 7th attacks, territorial integrity and self defense.
But international law imposes on states to keep their territory from being used to commit such violent acts as terrorism against other states. This principles appears in the Declaration of Friendly Relations, the Declaration on Measures to Eliminate Terrorism and multiple pre-9/11 Security Council resolutions demanding that Taliban should not allow terrorists to operate from the territory it controlled.
If a state cannot or will not comply with this duty, the victim state may cross into its territory for limited purpose of putting an end to the threat. There have been numerous examples of states asserting this right to defensive self-help. As to this right Caroline case involved precisely this issue.
The facts underlying October 7th attacks against al-Qa' ida are very similar. As United States and United Kingdom after fulfilling this kind of due legal procedure conducted military actions again
