필자는 본고에서 지방자치법 제22조 단서는 위헌이라는 것을 밝히고 있다. 지방자치법 제22조 단서가 위헌이라고 보는 경우에는 지방자치단체가 제정하는 조례가 『법령의 범위 내』에서 주민의 권리에 대한 제한과 의무의 부과 및 형벌에 관한 규정을 하더라도 법률에서 조례제정에 대해 포괄적 위임을 하였는가의 여부는 문제되지 아니한다고 보아야 할 것이다. 행정입법의 경우에는 포괄위임은 무효가 되는데 이러한 법리를 조례에도 그대로 적용하여 설사 조례에 대한 위임이 포괄적인 것이어서 무효가 된다고 하더라도, 앞서 살핀 바와 같이 지방자치단체는 헌법 제117조의 자치입법권에 근거하여 법령에서 위임한 범위와 동일한 범위 내에서 조례를 제정할 수 있기 때문에, 법률의 포괄위임에 의해 제정된 조례를 바로 무효라고 볼 것은 아니다. 위헌설에서는 위임입법의 법리가 적용될 여지가 없다고 보아야 할 것이다. 그러나 위헌설에 입각하더라도 포괄적 위임의 허용성에 관한 논의의 배경 자체가 전혀 도움이 되지 아니하는 것은 아니다. 헌법 제117조 제1항에서 규정하는 『법령의 범위 안에서』라는 외연을 형성하기 때문이다. 이런 점에서 위헌설이라고 하더라도 합헌설과 마찬가지로 추가조례·초과조례의 문제가 제기되는 것은 마찬가지이다. 다만 위헌설에 입각하는 경우에는 자치입법권의 성격상 유효로 되는 추가조례·초과조례의 범위가 넓어진다고 할 수 있다. 조례가 행정규제기본법의 적용대상에 포함되고 있다. 조례가 행정규제대상에 포함됨으로 인해, 중앙정부는 조례가 정하는 기준이 설령 최소기준을 정한 것에 불과하다고 하더라도 추가조례·초과조례를 불허하게 될 가능성이 크고 이는 결과적으로 행정규제기본법을 위헌성을 띄게 만든다. 그러나 주민복지에 대한 요구가 거세지고 있는 상황에서는 주민복지를 내용으로 하는 추가조례나 초과조례가 유효하다고 해석할 필요가 있고, 그 근거는 헌법제정권력에 의해 헌법변천이 이루어진 데서 찾아야 한다는 것이 필자의 시론이다.
더보기The writer asserts in this article that enactment power of municipal ordinance bases on the Constitution §117 (1) which represents the resolution of enactment power of the Constitution, and the proviso of the Local Autonomy Act §22 is unconstitutional which regulates the enactment of municipal ordinance concerning the restriction on rights of residents, the imposition of obligation on residents, or penal provisions without delegation of individual laws. If we stands on unconstitutionality theory, it doesn`t matter whether the individual law delegates comprehensively so long as the municipal ordinance restrict the right of residents, imposes obligation on residents or stipulates the penalty within the limit of the laws and subordinate statutes. Comprehensive delegation to administrative legislation is void. If we apply this void doctrine on the delegation of municipal ordinance enactment and comprehensive delegation to the ordinance is void, nevertheless the local government can enact the same provision based on autonomous power of enactment conferred by the Constitution, and this enactment cannot be treated as void. But it does not eliminate the necessity of discussing the scope of the enactment power of municipal ordinances as the Constitution restricts the enactment power within the delegation of the laws and the subordinate statutes. Under the constitutionality theory, local government cannot enact restricting the right of residents, imposing obligation on residents or stipulating the penalty without delegation of individual laws. Though the individual laws delegate the enacting power, subsequent problem arises whether general or comprehensive delegation is suffice or individual and specific delegation is necessary. If we stand on constitutionality theory and hold the effectiveness of comprehensive delegation, the scope of enactment power has to be discussed centering additional municipal ordinances/excessive municipal ordinances. Under above-mentioned unconstitutionality theory, applicable room for doctrine of delegated enactment doesn`t exist. But it does not necessarily mean fundamental background of discussing the possibility of comprehensive delegation, as the notion of 『within the limit of the laws and subordinate statutes』 forms the brink of the extent provided by the Constitution §117 (1). So the effectiveness of additional or excessive municipal ordinances, but the permissible exent under unconstitutionality theory is broader than that of constitutionality theory. The next problem we should not neglect is municipal ordinances are subjects of Framework Act on Administrative Regulation. As the municipal ordinances are regulated by the above-mentioned Act, the Central Government easily tend to restrict not to circumvent the limit of the laws though the limit is enacted as minimum standard under the good name of maintenance of uniformity. and this regulation leads the additional or excessive municipal ordinances unpermissible regulations. If we operate Framework Act on Administrative Regulation, that law falls under the unconstitutional category regardless of its merit. In the province of pollution and similar province from which emerges the minimum legal standard theory, environmental right enhances as constitutional right, and the general citizen regard the environmental regulations of corresponding laws are too loose. This sort of citizen`s awareness requires the additional or excessive municipal ordinances stricter than the standards provided by the laws effective, and if the notion of 『within the limit of the laws and subordinate statutes』 under the Constitution §117 (1) forms the barrier, we should the restriction of the Constitution be removed by the constitutional transition.
