취약한 소수자나 그가 속한 집단 전체에 대하여 혐오를 표명하거나 부추기는 ‘혐오표현’(hate speech)이 전 세계적으로 심각한 사회문제로 제기되고 있다. 우리나라에서도 특정 온라인사이트에서의 민주화운동, 여성, 특정지역에 대한 폄하글 등이 무분별하게 온라인 전체로 퍼지거나 동성애와 같은 문제를 혐오하는 표현들을 어렵지 않게 살펴볼 수 있는 상황이다. 또한 독도 문제로 인한 반일감정은 일본인에 대한 혐오표현으로 이어질 가능성도 높으며, 일부 다문화가정이나 외국인 체류자에 대한 혐오표현도 우려되는 실정이다.
혐오표현은 대상이 되는 당사자에게만 피해를 주는 것이 아니라 당사자와 같은 집단과 함께 우리 사회 전체에 좋지 않은 영향을 준다는 점에 심각성이 있다. 이처럼 혐오표현은 피해자 개인이나 집단의 정신적·신체적 피해는 물론 사회적으로는 특정 집단과의 갈등을 유발하여 사회통합을 저해시킬 수도 있다는 문제의식에서 이를 법적 규제의 대상으로 편입시켜야 한다는 주장들이 제기되고 있다.
혐오표현이 혐오의 대상이 되는 집단이나 구성원의 존엄성을 침해한다는 문제가 있지만, 이를 제한하기 위해서는 그 침해가 심각하고 이를 제한함으로써 얻게 되는 질서유지 또는 타인의 명예나 권리 보호 등의 공익이 우월하다는 사회적 공감대가 우선적으로 형성되어야 할 것이다. 사회적이고 역사적으로 합의된 혐오표현의 정의가 없는 상태에서 혐오표현은 표현의 자유에 의한 헌법적 보호 대상에 포함된다. 따라서 아무리 그 내용이 혐오를 조장하거나 표현하는 것이라도 그것이 사회질서를 침해하거나 타인의 권리를 중대하게 침해하는 등 사회적 공익에 관한 문제를 제기하는 것이 아니라면 표현의 자유로 보호되는 영역에 있다.
외국의 입법례를 살펴보면 미국과 유럽국가들은 혐오표현에 대한 법적 접근이 크게 다른 것을 알 수 있다. 이는 표현의 자유를 중시하는 미국과 나치 독일의 반유대주의 정책에 따른 비극을 경험한 유럽국가들의 역사적 배경의 차이에서 비롯된 것이다. 혐오표현의 규제법률이 소수자 보호를 목적으로 하는 것이 아니라 소수로부터 다수파에 향한 혐오표현에도 적용된다는 점은 영국, 독일, 프랑스 3개국에 공통적인 사항이다. 미국이 혐오표현을 규제하지 않는 것은 민권운동이 한창이었던 1960년대 당시 소수자들이 체제에 저항하기 위하여 최대한의 언론의 자유를 요구했다는 역사적인 이유가 있다. 혐오표현 규제법은 소수자 자신의 표현에도 적용될 수 있다는 것을 소수자 측면에서 자각하여 경계하였기 때문이다.
한편, 유럽국가들은 이른바 ‘아우슈비츠의 거짓말’로 대표되는 홀로코스트 부정과 관련하여 독일과 프랑스는 이를 명문으로 금지하고 있지만, 역사적 사실에 관한 언론을 처벌하는 것에 대하여는 혐오표현의 규제에 적극적인 두 나라에서조차도 표현의 자유가 침해되어 위헌이라는 비판이 제기되고 있다. 영국은 이러한 언론을 명문으로 금지하고 있지는 않지만, 홀로코스트를 부정하는 주장을 한 극우정당의 대표를 「1986년 공공질서법」 위반으로 유죄판결한 사례가 있다. 이러한 입법례에서 살펴본 바와 같이 각 국가들은 사회적 경험과 역사적 배경에 근거한 특정한 혐오표현만을 규제하고 있는 것을 알 수 있다. 외국의 입법례에서 살펴본 바와 같이 우리나라의 경우도 우리의 현실에 적합한 혐오의 개념 설정 ...
Hate speech, which expresses or encourages aversion to the vulnerable minority or the group to which it belongs, is being posed as a serious social problem all over the world. In Korea, hate speech to democratization campaigns, women, specific regions are spreading online. In addition, the anti-Japanese sentiments caused by the Dokdo issue are likely to lead to a disgust with the Japanese, and there is also concern about hate speech with some multicultural families and foreign residents.
It is important to note that hate speech does not only damage the target party but also adversely affects our society as a whole with the same group as the party. It is argued that hate speech should be regulated by law because it can cause social and/or physical harm to the individual or group of the victim, as well as conflicts with particular groups.
There is a problem that hate speech infringes on the dignity of the group or members who are the object of dislike. However, in order to regulate hate speech, social consensus, which infringement is serious and public interest such as maintaining order or protecting the honor or rights of others is superior, should be given priority. In the absence of the social and historically agreed definition of hate speech, it is included in constitutional protection by freedom of expression. Thus, even if the content promotes or expresses aversion, it is in the area protected by freedom of expression, unless it raises the question of social public interest, such as infringing social order or seriously infringing on the rights of others.
Foreign legislations show that the United States and European countries have a very different legal approach to hate speech. This is due to differences in the historical background between the US that has emphasized the freedom of expression and Germany that have experienced Nazi tragedies in anti-Semitic policies. It is common in the three countries of England, Germany and France that regulatory laws of hate speech are applied not only to the protection of minorities but also to aversion from the minority to the majority. The reason why the United States does not regulate hate speech is due to historical background in the 1960s, when the civil rights movement was at its height, and minorities demanded maximum freedom of speech to resist the existing system. This is because the regulation of hate speech can be also applied to the expression of the minority's own.
On the other hand, Germany and France have banned for the denial of Holocaust, which is represented by the so-called ‘Auschwitz's lies’. However, in punishing the press on historical facts in these countries, criticism that it is unconstitutional because freedom of expression is infringed has been raised. The United Kingdom has not banned such media, but there is a case in which a representative of a right-wing party who allegedly denied the Holocaust was found guilty of violating the 1986 Public Order Act. As we have seen in these legislation, we can see that each country restricts only certain hate speech based on social experience and historical background. As we have seen in the foreign legislative cases, it is necessary for us to find the legislative regulation against the reality with the concept of hate speech which is appropriate for the Korean society.
It is time to take countermeasures against hate speech by referring to the responses in foreign countries because it can adversely affect our society as a whole, not only the group or the members who are subjected to hate. Hate speech can threaten the socially democratic values and peaceful coexistence because it can raise antipathy and hostility against the minority and the risk of discrimination or physical attack on them.
