누구나 간단히 디지털의 복사나 데이터의 편집, 인터넷상에서의 정보를 공유할 수 있게 된 오늘날에는 타인의 저작물을 이용하는 것이 다반사가 되는 것과 동시에 그 이용태세가 다양화되고 있다. 즉, 고도의 설비를 가지지 않는 아마추어의 경우에도 저렴한 비용으로 간단하게 저작물을 창작, 반포할 수 있게 되었기 때문에 새로운 네트워크 관련 비즈니스가 등장하고 종전에 생각하지 못했던 콘텐츠 이용형태가 나타나고 있다. 따라서 통신기술ㆍ정보기술이 발달한 현대에 있어 일상적인 표현행위 또는 발신행위가 타인의 저작권을 침해하는 일이 없는지 판단이 요청되고, 이로 인해 저작권법이 표현의 자유에 대해 어떤 위축효과를 줄 수 있는 존재라면 헌법상의 문제를 초래할 수 있을 것이다. 저작권은 때로는 타자의 창작 활동(표현 활동)을 제약하는 일이 있으며, 과연 그러한 것이 허용되는 것인지 또한 어느 정도의 제약이 존재한다면 그 수준은 적절한 것인가를 파악하기 위하여 저작권과 표현의 자유와의 관계를 고찰할 필요가 있다. 저작권의 보장의 정도를 어느 정도까지 인정할 것인지 여부에 따라 표현의 자유의 보장 범위가 영향을 받게 될 것이다.
일면 저작권은 표현 활동에 직접적으로 관계되는 권리임에도 불구하고, 우리나라 저작권법에 상당한 영향을 준 일본에서조차 일본 헌법 제21조가 규정하는 표현의 자유와의 관계성이 본격적으로 논의된 것이 근래의 일이라 할 것이다. 이러한 양상은 우리나라와 크게 다르지 않다. 저작권은 표현의 자유에 친화적인 목적을 내세우면서도 그것을 달성하는 수단은 표현의 자유에 정면으로 반하는 일종의 모순된 관계성을 가지는데 이를 저작권의 패러독스(copyright's paradox)라고 한다. 즉 창작자에 대한 저작권의 인정은 저작물 이용자에 대한 저작물을 통한 표현행위를 할 자유를 제한할 수 있으므로 창작자의 저작권보호와 저작물 이용자의 표현의 자유에 대한 보장 사이에서의 균형점을 모색할 필요가 있다.
현재 일본에서 논의되고 있는 상황을 보면, 창작 활동의 촉진이라고 하는 저작권법의 목적이 표현의 자유와 목표로 하는 방향성이 동일한 것에 착안해, 저작권법을 “표현의 자유의 엔진”으로 파악하는 미국 대법원의 입장을 둘러싸고 논의가 양분되고 있다. 즉, 한편에서는 그러한 입장을 비판하고, 어디까지나 개인의 표현 행위의 자유와 그것을 규제하는 입법인 저작권법은 서로 대립관계에 있는 것이라고 주장되고 있으나 다른 한편에서는 미국 대법원의 견해에 귀 기울여 이것을 긍정적으로 받아들이는 생각도 있는 것이다. 과연 저작권법이 표현의 자유의 엔진인지, 만약 그렇다고 하더라도 그것을 이유로 2개의 헌법상 권리의 대립이 완화될 수 있는 것인지에 대한 판단을 위해 저작권과 표현의 자유 관계 구조를 명확히 할 필요가 있을 것이다.
선행연구로서 비교법적으로 미국에 관한 논의는 일부 있으나 우리나라 저작권법의 모태라 할 수 있는 일본의 저작권법과 표현의 자유에 관한 논의는 거의 없는 바, 일본에서의 논의를 통해 표현의 자유에 대한 중요성을 다시 한 번 자각하고 디지털 시대에 부합하는 저작권의 활용에 대해 살펴보고자 한다.
The rapid development of digital technology has significantly changed the environment surrounding copyrights, which have traditionally been the primary means of communication between analog media such as books, records, and canvas. However, in recent years, audio and word files have been widely distributed through these digital devices and across the Internet. Today, anyone can easily make a digital copy, edit data, and share information. It has become a daily occurrence to use the work of another person in a multitude of ways. At the same time, even amateurs who do not have sophisticated facilities can easily create and distribute their works at low cost, which authors and copyright holders of famous works are diversifying. At present, with the developments of communication and information technology, it becomes questionable whether an individual can carry out the most reasonable acts of expression and transmission without violating the copyright of others.
When people express or issue things, it becomes a matter of concern to the Constitution if the possibility of copyright infringement goes too far in the individual’s mind that they avoid the act of expression itself or they decide to deliver it in a different form altogether. If copyright law could have atrophic effects on freedom of expression, will constitutional problems arise? Although copyright is a right directly related to expressive activities, it is only recently that its relationship with the freedom of expression, as stipulated by Article 21 of the Constitution of Japan, has been seriously discussed in the region.
In recent years, research on this issue from the perspective of both copyright law and constitutional law has been actively increasing in Japan. Given the present theoretical circumstances, it is noted that the object of copyright law, the promotion of creative activities, can be found in the same direction where freedom of expression is sought. Discussions are divided over the position of the U.S. Supreme Court, which considers copyright law as an engine of the freedom of expression, and on the other hand, it has been argued that there is a conflict between the freedom of individual expression and copyright law. However, some people are inclined to take the view of the U.S. court and insist on accepting it positively.
Can copyright law be the engine of the freedom of expression? Even if it were the engine of the freedom of expression, could the conflict between the two rights be eased by this connection? To answer these questions, first, the structure of the relationship between copyright and freedom of expression must be defined, taking into account the nature of copyright and the problems that arise during the legislative process.
In considering the constitutional review of copyright laws, the researchers first look at the constitutional position of copyright. The Japanese Constitution does not include words such as “copyright” or “intellectual property rights,” and the definition of copyright concerning the Constitution is not always clear. As mentioned above, the Constitution of the United States has provisions on patents and copyrights. However, this sits in contrast to the fact that even though the Constitution guarantees patent rights and copyrights, Congress has the power to enact laws on them. Does that mean copyright is not constitutional? In Japan, the relationship between copyright and freedom of expression has been frequently discussed in recent years, and there are limited references regarding the legal position of copyright.
