독자적 경찰수사의 사법권 침해에 관한 연구 - 헌법 제101조 제1항 위반을 중심으로 - = A Study on Infringement of Judicial Power in Independent Police Investigation
Our Constitution adopted the principle of separation of powers and granted exclusive and comprehensive judicial power to the courts.
Accordingly, in principle, state agencies other than the court can not exercise judicial power, nor can they exclude or control the exercise of judicial power by the courts. However, if there is a written provision limiting the judicial power of the court in the Constitution, or even if there is no explicit provision, if the Constitution is interpreted that the Constitution is intended to limit the judicial power of the court, the judicial power of the court is limited within the limit.
In relation to criminal procedures, investigations and decisions by prosecutors and police can be actions that exercise judicial power and exclude the exercise of judicial power by the court. Although there are no explicit provisions in the Constitution for prosecutors to investigate and decide whether to prosecute or not, it is interpreted that the Constitution plans limiting the judicial power of the courts and is consistent with the constitutional order. On the other hand, the police investigation and the decision on whether to send the case are unconstitutional, as there are no written provisions in the Constitution and they are not interpreted as limiting the judicial power of the courts as planned by the Constitution.
With the revision of the Criminal Procedure Act in 2020, the police were given the authority to independently investigate and decide whether to send the case independently. This infringes on the judicial power of the court as the police, which is an administrative agency, exercises the judicial power to find facts and declare the law, and to exercise the power to exclude the exercise of the judicial power by the court. Therefore, the National Assembly needs to promptly amend the provisions of the Criminal Code that allow administrative agencies to infringe on judicial power against the principle of separation of powers in the Constitution.
우리 헌법은 권력분립의 원리를 채택하여 배타적이고 포괄적인 사법권을 법원에부여하였다. 이에 따라 원칙적으로 법원 이외의 다른 국가기관은 사법권을 행사하지못하고, 법원의 사법권 행사를 배제하거나 통제하지도 못한다. 다만, 헌법에서 법원의사법권을 제한하는 명문의 규정을 두거나 명문의 규정은 없더라도 헌법의 해석상헌법이 법원의 사법권을 제한하는 것을 예정하고 있다고 해석되는 경우, 그 한도내에서 법원의 사법권은 제한된다.
형사절차와 관련하여 행정기관인 검사의 수사와 기소여부 결정, 경찰의 수사와송치여부 결정은 실질적 사법권을 행사하고, 법원의 사법권 행사를 배제하는 것으로그 위헌성 여부가 문제된다. 검사의 수사와 기소여부 결정은 헌법에 명문의 규정은없지만, 헌법이 법원의 사법권 제한을 예정하고 있는 것으로 해석되어 헌법질서에합치한다. 반면 경찰의 수사와 송치여부 결정은 헌법에 명문의 규정이 없고, 헌법이 예정한 법원의 사법권 제한으로 해석되지도 않아 사법권을 침해하는 것으로 위헌이다.
2020년 형사소송법 개정으로 경찰이 독자적으로 수사하고, 독자적으로 송치여부를결정하는 권한을 부여받았다. 이는 행정기관인 경찰이 사실규명과 법 선언에 관한사법권을 행사하고, 법원의 사법권 행사를 배제하는 권한을 행사하는 것으로 법원의사법권을 침해한다. 따라서 국회는 헌법상 권력분립의 원리에 반하여 행정기관이 사법권을 침해할 수 있도록 규정한 형사소송법 규정을 조속히 개정할 필요가 있다.
