Guarantee of the rights of the child as special basic rights in constitution and international treaty for protection of human rights is recent trend. Although texts of traditional constitutions may recognise the necessity of protection for the child and the juvenile, any specail provision for right of the child and the juvenile cannot however regulary be founded in them.
Children are mainly considered as an object of social state’s care, or rather their rights are an appendage to their parent’s basic rights. Historically the children and the juvenile are only restrictively perceived as independent holder of rights by legal state order and constitutional order. In theory of basic rights (Grundrechtstheorie) legal status of the child and the juvenile just can be taken into consideration as legal concerning capacity to claim civil liberties (Grundrechtsmündigkeit). Most constitutions of EU memberstates deal with right of the child and the juvenile also today in fragmentary form. Differently from these constitutions article 24 in the Charter of Fundamental Rights of the European Union as independent subject of basic rights and not only part of family (Article 7, 33) or beneficiary of right of parents (Article 14 (3) alternative 2). The Convention for fundamental rights (Grundrechtskonvent) uses convention on the Rights of Child from New York especially article 3, 9, 12 and 13 as a model for article 24 in the Charter of Fundamental Rights of the European Union (EUCFR).
Article 24 (1) sentence 1 EUCFR is based on article 3 (2) in Convention on the Rights of the Child. Artilcle 3 (2) in Convention on the Rights of the Child intends States Parties to undertake to ensure the child such protection and care as is necessary for his or her well-being, taking into account the rights and duties of his or her parents, legal guardians, or other individuals legally responsible for him or her. In article 24 (1) Sentence 1 general a sort of clause which forms principle is only founded, whereas another sentences contain special basic rights.
Article 24 (1) sentence 2 and 3 EUCFR have double bases in Convention on the Rights of the Child in detail article 12 (1) and 13 (1). According to article 12 (1) in Convention on the Rights of the Child States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child. Persuant to article 13 (1) in the convention on the rights of the child every child has the right to freedom of expression.
Article 24 (2) EUCFR is based on article 3 (1) in Convention on the Rights of the Child. In accordance with Article (1) in Convention on the Rights of the Child in all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.
Article 24 (3) EUCFR is developed from Article 9 (3) in Convention on the Rights of the Child. Persunat to article 9 (3) convention on the rights of the child States Parties shall respect the right of the child who is separated from one or both parents to maintain personal relations and direct contact with both parents on a regular basis, except if it is contrary to the child's best interests. Article 24 (3) EUCFR has direct effect of constitutional right on a third party (unmittelbare Drittwirkung), because every child has a right to maintain personal relations and direct contact with both parents on a regular basis.
The Structure of Article 24 EUCFR is uncertain. In all the parts of this article the main thing is constantly welfare of child. 어린이와 청소년의 기본권의 헌법적 보장 그리고 국제인권법 보장은 현대의 기본권 보장의 전개과정에 있어서 비교적 새로운 중요한 국면의 전개이다. 설사 이미 유럽의 여러국가들이 그들의 헌법상의 기본권 보장 전개과정에서 어린이와 청소년의 기본권 보호의 필요성을 인식했다 할 지라도, 그들은 자신들의 기존의 헌법 속에 별도로 어린이와 청소년의 권리보호를 위한 독자적인 기본권 보장을 두고 있지 않고 있다.
헌법상의 기본권 보호의 객체로서 어린이와 청소년, 특히 그 중에서 어린이는 (사회)국가적인 배려의 객체로서 인정되거나 혹은 어린이의 권리는 그 부모들의 기본권에 대한 부속물로 받아들여져 왔다. 역사적으로 어린이와 청소년은 단지 그들이 성인과 같은 기본권 주체가 될 수 있는 경우에 한해서만, 제한적인 측면에서만 국가법질서 혹은 헌법질서에 의하여 독립적인 권리주체로서 인정받을 수 있을 따름이었다. 이에 대한 예외로서 어린이의 기본권 주체적 지위를 강조하고 있는 유럽연합의 구성국가의 헌법은 핀란드 헌법이다.
유럽연합의 기본권 헌장 제24조에 규정된 어린이의 권리의 보장은 유럽헌법제정회의의 의장단 회의가 확인한 바와 같이 어린이의 권리에 대한 뉴욕 협약 제3조, 제9조, 제12조 그리고 제13조에 근거를 두고 있다. 유럽연합의 기본권 헌장은 제21조에서 어린이를 정상적인 성인과의 관계에서 연령으로 인한 차별금지로부터 또한 보호되어져야 할 뿐만 아니라, 더 나아가서 제24조에서 독자적인 권리로서 어린이의 복리(well being, Wohlergehen)에 필요한 보호와 배려요구권(제1항), 어린이의 의사의 고려(제1항), 공공기관이나 사적 기관의 어린이의 복지(welfare, Wohl)의 우선적 고려(제2항), 어린이의 양쪽 부모와의 인격적 관계 그리고 직접적 접촉을 가질 권리(제3항)를 보장하고 있다.
물론 유럽연합의 기본권 헌장 제24조는 어린이(child, Kind)이라고 규정하고 있지만, 이에 대한 법적인 법적인 판단근거가 되는 어린이의 권리에 대한 협약 제1조에 의하면 어린이에 적용되는 법에 의하여 만 18세 이전에 성인을 인정하지 않는 한에서는, 어린이는 만 18세에 달하지 않는 모든 사람이 된다. 이런 의미에서 유럽연합의 기본권 헌장 제24조는 어린이의 권리를 규정하고 있지만 그 적용범위는 어린이와 청소년의 기본권 보장이 된다.
