화석연료보조금에 관한 국제법 논의

이 논문은 국제사회에서 2009년부터 G20, APEC 등 국가들이 낭비를 조장하는 비효율적인 화석연료보조금을 단계적으로 폐지할 것을 약속한 이래 활발히 논의되고 있는 화석연료보조금의 개혁에 관한 국제법적 논의를 살펴보는 것이다. 화석연료보조금의 폐지가 국제적 문제로 등장한 것은 기후변화와 대기오염의 악화로 화석연료에너지의 사용을 줄이고 저탄소재생에너지로의 전환이 신속히 이뤄져야 하지만 G20 국가들의 상당수가 석탄, 석유, 천연가스의 화석연료에너지의 생산과 소비에 막대한 보조금을 제공하고 있기 때문이다. 특히 화석연료의 생산자에게 제공되는 보조금은 경제성이 없어서 그 자체로는 생산되지 못할 화석연료까지 지하에서 채굴되어 낭비적인 소비를 조장하는 비효율성을 낳는다. 정부보조금을 받아 생산된 화석연료를 쉽게 소비하며 배출되는 CO2로 인해 기후변화가 가속되고 대기오염의 더욱 악화되어 환경오염, 인간의 생명과 건강을 위협하고 있다.
국제사회에서 국가들의 정치적 약속보다는 좀 더 규범성이 있는 국제법하에서 지속가능한 발전목표(SDGs) 12는 명시적으로 낭비적인 소비를 조장하는 화석연료보조금을 합리화할 것을 목적으로 정하고 있다. UNFCCC하의 파리협정을 통해서도 화석연료보조금의 폐지를 자발적으로 강제할 방안들이 제시되고 있다. WTO의 SCM협정은 화석연료보조금의 문제를 더욱 직접적으로 다룰 수 있다. 그리고 최근의 EU-싱가폴 FTA는 화석연료보조금의 단계적 폐지를 명시적으로 언급하고 있다. 그러나 이들은 모두 화석연료보조금의 개혁문제를 다루는데 일정한 한계도 가지고 있어서, 특히 WTO/SCM협정의 개정을 통해 화석연료보조금의 문제를 더욱 적극적으로 다루고자 하는 국제적 논의가 활발하다. 이에 국제법에 속하는 이들 영역에서의 화석연료보조금의 개혁 및 폐지를 위해 제안되는 주요 사항들을 살펴본다.
Subsidizing fossil fuels such as coal, oil, and natural gas has been accelerating the adverse impacts of climate change and exacerbating air pollution. Many rich countries in the world have provided subsidies for fossil fuel energy consumption and production, which has been far more than for subsidies for renewable energy. Fossil fuel subsidies can be said for government to provide subsidies for climate change and to help human health and life put in danger through air pollution. In particular, fossil fuel production subsidies fix carbon dioxide for a long time, produce “zombie energy” and expand inefficient fossil fuel supply which enhances wasteful consumptions. In this context, although since 2009, G20, APEC and more countries have promised that they would phased down inefficient fossil fuel subsidies, such political promises have not been appropriately implemented so far.
This paper therefore discusses the fossil fuel subsidy reform under international law, which have more legal bindingness and implementing forces rather than political pledges. Under the international legal framework, the most promising systems for discussing fossil fuel subsidy reform could be the UNFCCC/Paris Agreement and the WTO/SCM Agreement, even though phasing down the fossil fuel subsidies are explicitly mentioned in the Sustainable Development Goal 12 and in the EU-Singapore FTA.
First of all, Paris Agreement can provide suitable mechanisms such as regularly submitting of the NDCs that each party could present its fossil fuel subsidy reform targets together with its GHGs emission targets; making the global financial flow be in line with maintaining average global temperature well below 2℃; treating fossil fuel subsidies with no applicability standing while applying “climate finance”; assessing the fossil fuel subsidy reform through the global stock-taking; including fossil fuel subsidy reform into the long-term low emission strategy that requests for each party by 2050. These related provisions of the Paris Agreement can lead Parties to pursue their fossil fuel subsidy reforms. Paris rule-book and/or the future COP decisions could provide more details for the fossil fuel subsidy reform under the Paris Agreement as long as Parties would agree with such.
More importantly, the WTO/SCM Agreement, having more powerful dispute settlement mechanism under the international law than any other, can find that the fossil fuel subsidies by government are inconsistent with the SCM Agreement as long as those subsidies are included in it by definition and requirements. Since the SCM Agreement does not include all sorts of fossil fuel subsidies provided around the world, some WTO Members who believe WTO would/could/should/must play a significant role and be a right forum called for a new negotiation on the fossil fuel subsidy reform within the WTO system based on the previous and the current experiences of agricultural goods subsidies and fishery subsides negotiations.
Both the Paris Agreement and the SCM Agreement are not enough to address phasing down the fossil fuel subsidies provided in the world, yet it should be considered more seriously to use the existing system to away from fossil fuels and to transit towards low carbon society.
