본 연구에서 나는 흄의 ‘자유와 필연의 화해 프로젝트’를 고찰함으로써 도덕적 책임의 본성과 조건에 관해 해명하고자 한다. 흄은 『인성론』 제2권 〈정념론〉과 『탐구』 제8장에서 자유와 필연의 “화해”를 시도하는데 우리는 이를 이해하기 위해 도덕감을 일으키는 인과적 기제에 대한 그의 설명을 이해해야만 한다. 나는 이러한 맥락에서 흄의 입장을 정확히 이해하기 위해 『인성론』 제1권에서 흄이 제시한 ‘인과에 관한 두 가지 정의’를 분석하는데 착목할 것이다. 흄의 첫 번째 ‘원인’에 관한 정의에 따르면, 인과관계는 규칙성에서 비롯되지만 규칙성 이상의 필연성 개념은 그의 두 번째 정의인 인간의 ‘마음의 추론’, 또는 ‘마음의 결정’에서 비롯된다. 이러한 것을 인간 행위를 설명하는 데 적용하면 다음과 같이 말할 수 있다. 즉 우리는 행위자의 동기와 행위 간의 규칙성을 관찰하면 ‘마음의 추론’ 또는 ‘마음의 결정’을 통해 행위자에게 그에 맞는 성품을 귀속시키고 그와 같은 성품에서 비롯된 행위에 대해 책임을 물을 수 있게 되는 것이다.
이렇게 볼 때 자유와 필연 그리고 도덕적 책임에 관한 흄의 입장은 홉스의 고전적 양립가능론을 보완한 슐릭-에이어-러셀의 그것과 다르다. 왜냐하면 이들은 규칙성 이론에 입각해서 흄의 입장을 ‘약한 결정론’으로 해석하는데, 문제는 어떤 행위자의 동기와 행위 간의 규칙성만으로 그에게 도덕적 책임을 물을 수 없기 때문이다. 흄이 규칙성 이론을 통해 필연성에 관한 전통적 개념에서 ‘강제’의 성격을 제거하였다는 약한 결정론적 해석은, 강제의 함축을 피할 정도로 충분히 약하지만, 자유와 책임에 필수적일 정도로, 다시 말해 행위자에게 도덕적 책임을 물을 수 있을 정도로 충분히 강하지는 않다고 해야 할 것이다. 흄에 따르면 이와 같이 행위자와 행위를 연결시키는 ‘필연성’은 도덕에 필수적이다. 그렇지만, 한편으로 이 필연성이 ‘강제’의 의미를 띄어서는 안 된다. 우리는 어떤 강제된 행위에 대해서도 도덕적 책임을 질 필요가 없다. 강제된 행위는 자유롭지 못한 행위를 의미하며, 이는 자신으로부터 비롯된 행위라고 할 수 없기 때문이다. 따라서 도덕적 책임을 귀속시키기 위해서는 특정 행위가 강제되지는 않았지만, 행위자로부터 산출된(caused) 행위라는 것이 요구된다. 흄은 이와 같이 우리의 행위가 강제되지는 않았지만 행위자로부터 산출된 행위라는 요구를 만족시키기 위해 행위자로부터 산출되었다는 것을 행위자의 지속적 성질 즉 성품에서 비롯되었다고 보고, 이 때 관찰자들은 그 행위와 그 사람이 ‘연결’되어 있다고 ‘믿음’으로써 그 사람에게 승인ㆍ불승인이라는 공감적 반응을 통해 도덕적 책임을 귀속시키는 것이다.
My aim in this project is to shed some light on the discussion of moral responsibility by considering Hume’s view on liberty and necessity. To this end, we need to examine the way in which Hume extends the problem of ‘Causal Necessity’ in Book One to the problem of ‘Liberty and Necessity’ in Book Two of the Treatise and Enquiry § VIII. Hume attempts to apply the way of investigating ‘causal necessity’ in physical world in Book One to the way of exploring ‘liberty and necessity’ of the mental world in Book Two of the Treatise. It is worth noting why he discusses the ‘liberty and necessity’ in the context of dealing with his theory of passion. In order to understand this, we need to appreciate Hume’s moral psychology showing us the relation between passion and character-traits or virtue.
We focus on the analysis of Hume’s “Two Definitions of Cause” of Book One in the Treatise. According to his first definition, causal relation is derived from regularity, while the necessity above regularity comes from ‘mind’s inference’, or ‘mental determination’ in his second definition. If we apply this definition to the explanation of human action, we can say as follows: once we observe the regularity between motive and action of the agent, we ascribe character-traits having been showing the regularities to the agent in terms of ‘mind’s inference and determination, and require the agent the responsibility for the action derived from the character-traits.
In order to appreciate the importance of Hume’s “reconciling project” of liberty and necessity, we need to understand causal mechanism eliciting moral sense. In view of this, Hume’s position of liberty and necessity and moral responsibility quite differs from the classical compatibilism such as the view of Hobbes-Ayer-Schlick. For the classic compatibilists read Hume as a ‘soft-determinism’ based on the regularity theory, but it is difficult to justify ascribing moral responsibility to agent on the basis of the regularity. The interpretation of ‘soft-determinism’ according to which Hume deprives a compulsion of a necessity traditionally understood is too weak to avoid the implication of compulsion, but it is not enough to be strong to attribute the responsibility to the agent. According to Hume, the necessity is essential to a morality in order for the agent and action to be connected. Yet, this necessity, for Hume, should not be compelled us. For we need not be responsible for the forced action. A forced action is not a free action, and it is not an action derived from the agent. Hence, we can attribute a moral responsibility to the agent on the action not caused by compulsion but elicited by agent. In order to satisfy this requirement, Hume finds the fact that an action is caused by an agent’s durable qualities, i.e., character-traits.
