유럽국가의 기본권보장 체계와 규범내용 = Contents of the System and the Norms for guaranteeing the Fundamental Rights in European Countries
In a country, the fundamental rights for the people shall function as the best value of the Constitution of each country which exists as a constitution-based country. The fundamental rights mean the ones that a human being has naturally as specified in the constitution of each country. A Constitution is the supreme law that defines the relationship between a country and the people. A Constitution as the supreme law of a country defines the relationship between a country and the people symmetrically or the relation that a country takes priority over the people from the country perspective and that the people does over the country from the people’s perspective. In case that a country takes a priority over the people, it means that a country can impose some duties on each person, but in case that the people does over a country, it means that each person of the people has the fundamental rights. The fundamental rights are formed and developed under the relation with Human Rights. The term, “Fundamental Rights”, appeared in the Frankfurt Constitution of Germany that was enacted on March 28, 1949, but there had been used to be announced many kinds of declarations of human rights for guaranteeing the rights of a human being in many European countries before the term appeared for the first time.
‘Magna Carta’ (the Great Charter of Freedom in 1215), ‘Habeas Corpus Act’ (a Trafficking Victims Protection Act in 1679) and the English Bill of Rights (1689) were enacted in England, ‘Declaration des droitsde I homme et du citoyen’ (Declaration of the Rights of Man and the Citizen in 1789) was done in France and ‘Frankfurt Verfassung’ (Frankfurt Constitution in 1849) & ‘Weimar Reichverfassung’ (Weimar Constitution in 1919) were done in Germany. Through such a procedure, the rights of human beings that are called the ‘Fundamental Rights’ were strated to be guaranteed as the best value within each country in the modern era. In the contemporary days, it is not an exaggeration if it is said that the fundamental rights that are enjoyed by the people as the universal value of the world were originated from the norms and the development of such norms in those countries. Especially, the guarantee of the fundamental rights by such written constitution-based countries, such as, France and Germany, etc., are making great effects on many countries over the world. Taking a consideration of the creation of provisions on the fundamental rights in a constitution, the constitution of France does not specify the provisions on the fundamental rights directly in the constitution. However, the Basic Law (‘Grundgesetz’) of Germany has specified many kinds of fundamental rights inheriting the provisions in the constitutions of the previous eras. Except for such a difference, as far as the guaranteed contents are concerned, both the constitutions of France and Germany guarantee the best fundamental rights over the world. In this study, the systems and norms of France and Germany for guaranteeing the fundamental rights only with such a difference only in a type were examined. In case of France, the contents of the norms were examined while the fundamental rights were classified into the private freedom, the group one and the social and economic one. In case of Germany, the contents of the norms were examined in the aspects of the dignity of humanity, the Equality before the Law, the Freedom of Conscience and the Guarantee of Property Rights, etc.
어느 나라라 하더라도 헌법국가로 존재하는 기본권은 헌법의 최고가치로 기능한다. 기본권은 헌법상에 규정된 인간이 인간으로서 당연히 갖는 권리를 말한다. 헌법이 국가와 국민의 관계에 대하여 규정하고 있는 최고법이다. 헌법은 국가 내에서의 최고법으로 국가와 국민의 관계를 대칭적으로 또는 국가의 면에서 국민에 우선하는 국가, 국민의 면에서 국가에 우선하는 국민의 관계에 대한 체계를 규정하고 있다. 국민에 대한 국가의 우선에 관한 것이 국민에게 의무를 부과하는 것이고 국가에 대한 국민의 우선에 관한 것이 기본권이다. 기본권은 인권과의 관계에서 형성되고 발전된다. 기본권이라는 용어는 1949년 3월 28일에 제정된 독일의 프랑크푸르트 헌법에서 등장하였지만, 기본권이라는 용어 이전에 유럽국가들에서 인간의 권리의 보장을 위한 여러 인권선언이 있었다. 영국의 1215년 대헌장(Magna Carta), 1679년 인신보호법(Habeas Corpus Act), 1689년 권리장전(Bill of Rights), 프랑스의 1789년의 인간과 시민의 권리선언(Declaration des droitsde I homme et du citoyen), 독일의 1849년 프랑크푸르트 헌법(Frankfurt Verfassung), 1919년 바이마르 헌법(Weimar Reichverfassung)의 제정 등이 있었다. 이를 통하여 우리라 오늘날 기본권이라 불리는 인간의 권리들을 국가 내의 최고의 가치로 보장하기 시작하였다. 오늘날 세계가 보편적 가치로서 누리고 있는 기본권들은 이들 나라에서의 규정과 발전에 기인한다고 하여도 과언이 아니다. 특히 성문헌법국가인 프랑스와 독일의 기본권보장은 세계 각국에 지대한 영향을 미치고 있다. 헌법에 기본권규정의 조문화라는 점에서 보면 프랑스 헌법에는 직접 기본권규정을 두지 않고 있으며, 독일기본법에는 앞선 시대의 헌법에서의 규정들을 이어온 여러 기본권규정을 두고 있다. 그러한 차이만 있을 뿐 그 보장의 내용에 있어서는 프랑스와 독일은 세계 최고의 기본권보장 국가이다. 본 연구는 이러한 형식상의 차이점이 있는 프랑스와 독일의 기본권보장의 체계와 그 규범내용을 고찰하였다. 프랑스의 경우 기본권을 개인적 자유, 집단적 자유 및 사회·경제적 자유로 나누어서 그 규범내용을 고찰하였고, 독일의 경우의 기본권의 규정순서에 따라 인간의 존엄성, 법앞의 평등, 양심의 자유, 재산권 보장 등에 대하여 규범내용을 고찰하였다.
