해양미세플라스틱 오염 대응에 대한 법적 쟁점과 환경적응 방안 = Legal Issues and Environmental Adaptation to Marine Microplastic Pollution Response System

현행법상 해양미세플라스틱 오염으로 인한 국민의 건강 보호 관련 규정은 미비한 상황이다. 해양미세플라스틱 오염 중 2차 미세플라스틱 문제는 미세플라스틱이 해양환경에 이미 광범위하게 존재하고 있기 때문에 사실상 저감과 관리가 어려울 뿐만 아니라, 해양환경, 해양생태계, 수산식품, 인간의 건강 문제에 복합적으로 걸쳐있다. 미세플라스틱의 발생을 저감하고자 하는 규제는 발전하고 있지만, 정작 해양환경과 해양생태계에 존재하여 왔고 해양에서 다시금 생성되어 축적되고 있는 해양미세플라스틱에 대하여 구속력을 갖는 법적 근거는 없다. 이 글에서는 국민과 미래세대의 건강 보호 측면에서 해양미세플라스틱 오염 문제에 대해 환경법상의 원칙인 사전배려의 원칙과 국민의 알권리 보장, 유엔해양법협약에 따른 국가의 책무 등에 입각하여 검토해 보았다. 그 결과, 국가는 국민과 미래세대의 건강권과 환경권을 보장하기 위하여 해양미세플라스틱 오염에 대한 사전배려조치와 무해성 입증에 기반한 적극적인 행정체계 내지 환경적응 방안을 마련할 책무와 필요가 있었다. 이 글에서는 환경적응 시스템과 관련하여 세 가지의 해결방안을 마련해 보았다. 첫째, 환경법적 대응 방안과 해양수산 관련 법적 대응 방안 간의 법적 쟁점에 대해 논의해 보았다. 2차 미세플라스틱 등의 해양미세플라스틱의 저감 및 관리, 수산식품의 해양미세플라스틱 관리, 해양미세플라스틱의 해양환경 기준 및 식품 기준, 해양환경 보전 및 해양생태계 보호 방안 등과 관련한 사무는 해양수산부가 관장하는 것이 바람직할 것이나, 해양미세플라스틱 오염으로 인한 국민 건강 보호와 관련된 사무는 환경부 소관의 환경보건법에 근거한 사무로 할 것인지 또는 해양수산부 소관의 사무로 개편하여 규율할 것인지 문제가 된다. 이 글은 해양미세플라스틱 오염으로 인한 국민의 건강보호 관련 사무가 환경행정법인 「환경보건법」상의 환경유해인자로 규율할 것인지 또는 「정부조직법」상 해양수산부장관의 관장 사무 범위에 따라 「해양환경 보전 및 활용에 관한 법률」에 필요한 사항을 신설하거나 「해양환경보건법」을 새롭게 제정하여 관련 사항을 규율할 것인지에 대해 짚어 보았다. 이 글에서는 양자에 대하여 고려할 부분들을 개별적으로 정리하고, 해양수산부보다 환경부에서 해양미세플라스틱 오염을 규율하는 방안이 국민 건강 보호 관련 행정에 대하여 전문성, 신속성, 관련 행정사무 체계에 대한 전담 종사자의 경험, 고도화된 환경보건정책 등의 측면에서 더욱 실효성이 있다고 판단하고 있다. 특히 해양수산부의 사무로 이를 규율하는 경우에는 수산산업 관련 이해관계의 복잡성으로 말미암아 사전배려원칙과 무해성 입증에 입각한 행정행위에 제약 요인으로 작용할 가능성이 있어 실효성에 대한 검토가 추가적으로 요구된다. 둘째, 해양미세플라스틱 관리를 위한 적극적인 행정체계 마련 방안으로서 연안지역주민 및 취약계층 보호 차원의 「환경정책기본법」 제12조(환경기준) 또는 「해양환경 보전 및 활용에 관한 법률」 제13조(해양환경기준의 설정) 관련 환경기준 및 사람의 건강보호 기준에 해양미세플라스틱 기준을 신설하는 방안이 먼저 검토될 필요가 있다. 그리고 신설된 해양미세플라스틱 기준을 바탕으로 해양미세플라스틱의 농도가 기준치를 초과하거나 해양미세플라스틱 함량이 높을 ...
더보기Under the current law, regulations related to the people's health protection measures due to marine microplastic pollution are insufficient. The secondary microplastics problem among marine microplastics contamination is because microplastics already exist widely in the marine environment. Marine microplastics are not only difficult to reduce and manage, but they are also complex in the marine environment, marine ecosystems, seafood, and human health problems. Regulations related to the reduction of the occurrence of microplastics are steadily developing. However, there is no legal basis for managing marine microplastics that already exist in the marine environment and marine ecosystem, are being produced and accumulated in the ocean. In this article, the principles of prior consideration, which are the principles of environmental law on marine microplastic pollution, the guarantee of the people's right to know, and the state's responsibility under the United Nations Convention on the Law of the Sea were reviewed in terms of protection of the health of the people and future generations. As a result, the state had a responsibility and need to come up with active administrative systems and environmental adaptation measures based on pre-consideration measures and prove no harm to ensure the health and environmental rights of the people and future generations. In this article, three solutions have been prepared in relation to the environmental adaptation system. First, we discussed the legal issues of environmental legal countermeasures and legal countermeasures related to marine and fisheries. It would be desirable for the Ministry of Oceans and Fisheries in Republic of Korea to take charge of affairs related to the reduction and management of marine microplastics such as secondary microplastics, the management of marine microplastics in marine food, marine environment standards and food standards of marine microplastics, marine environment conservation and marine ecosystem protection measures. However, it is a question of whether business related to public health protection due to marine microplastic pollution will be business based on the ‘Environmental Health Act’ under the Ministry of Environment in Republic of Korea or reorganized into affairs under the Ministry of Oceans and Fisheries in Republic of Korea. The article believes that the Ministry of Environment manages administration related to public health protection in terms of professionalism, speed, experience of dedicated workers in related administrative affairs systems and advanced environmental health policies. This is because the Ministry of Oceans and Fisheries has complicated interests with the fisheries industry. Therefore, the Ministry of Oceans and Fisheries has restrictions on active administration. Second, as an active administrative system preparation plan for marine microplastics management, marine microplastics standards should be newly established in environmental standards and human health protection standards. And provide information on seafood to the public, where concentration of marine microplastics is expected to exceed the standard or the marine microplastics content is expected to be high. Through this, the people should be able to take or avoid the risks on their own. Finally, marine microplastics should be included in the scope of environmental hazards under the ‘Environmental Health Act’. As a result, it is necessary to seek policy measures together so that current environmental and health responses can operate quickly.
