‘피해자 권리장전’에 비추어 본 거창사건 = The Geochang Massacre in the Light of the ‘International Bill of Victims’ Rights’

유엔 총회는 2006년 <국제인권법의 총체적 위반과 국제인도법의 심각한 위반의 피해자의 구제와 손해배상에 대한 권리에 관한 기본원칙과 가이드라인>을 결의하였다. 피해자 권리장전으로 불리는 이 문서는 그 자체로 구속적인 국제법이 아니지만 국제관습법, 여타국제조약과 국가관행을 반영하고 있어서 과거청산의 권고적 지침으로 널리 수용되고 있다. 저자는 권리장전의 세부내용을 개괄하고 이를 기준으로 거창사건의 현황을 평가해보았다. 국제인도법의 시각에서 보자면 거창 민간인 학살은 국제범죄로서 시효가 배제되어야 한다. 그런데 2008년 대법원은 거창 민간인 학살의 유족들이 제기한 손해배상 소송에서 학살부대 지휘관이 1951년 유죄판결을 받았다는 점을 들어 소멸시효가 완성되었다고 판시하였다. 유죄판결 후 시행된 사면이 오히려 한국전쟁기에 자행된 국제범죄의 불처벌에 대한 확고한 실례였다는 점에 비추어볼 때 2008년 대법원의 시효소멸론은 국제인도법의 취지에 반한다. 국제인도법은 국제범죄의 사면을 금지하고 있을 뿐만 아니라, 최소한 피해자에 대한 피해구제 없이 이루어진 사면조치를 국제인도법 위반으로 규정하기 때문이다. 거창사건특별법의 제정 이후 거창사건명예회복위원회에 의한 희생자 인정과 합동묘역의 조성은 진실에 대한 권리를 다소나마 만족시켜 주었지만, 손해배상을 거부한 판결은 피해자의 재판받을 권리와 손해배상에 대한 권리를 침해하였다. 특히 다른 학살사건의 피해자들이 국가배상을 받았다는 사정을 감안할 때 그러한 판결은 거창사건 피해자들에 대한 매우 불평등한 처사이다. 따라서 피해배상을 포함한 거창사건특별법 개정안은 신속히 도입되어야 하며, 아울러 재발방지의 보증을 위해 인권침해적인 법제와 관행 등이 근본적으로 개혁되어야 한다.
더보기The author intends to address the rights of victims of the Geochang Massacre from the point of view of international humanitarian law, seeing that domestic judicial remedies have been shut down by the 2008 Supreme Court ruling. The United Nations General Assembly resolved the ‘Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law’ in 2006. This document contains a series of criminal, civil, political, and socio-cultural solutions from the victimcentric perspective, considering the recent developments in international humanitarian law after the Nuremberg Tribunal. This document which embodies the legal practices of civilized nations and principles of international humanitarian law is not deemed binding international law, but function as a acceptable standard for domestic legislation and interpretation of the domestic courts.
The author concludes that the Geochang Massacre could constitute war crimes and crimes against humanity simultaneously. The 2008 Supreme Court ruled in the Geochang claims that the victims’ right to compensation ceased to exist by prescription on the grounds that the commanders responsible for the Geochang massacre had been criminally convicted in 1951. However, the Supreme Court’s ruling conflicts with the principle of international humanitarian law, because it neglects that the above-mentioned commanders received pardon immediately after the conviction and that such pardon reflected the practice of impunity during the Korean War. The International humanitarian law prohibits amnesty or pardon for genocide, crimes against humanity, war crimes and at least, amnesty or pardon without the fair and effective relief of victims’ rights, because it is deemed a breach of the obligation of states to comply with international humanitarian law.
The three pillars of rights of the International Bill of Rights of Victims are the right to truth, the right to justice, and the right to reparation. The official recognition by the Geochang Massacre Inquiry Commission and the establishment of the National Geochang Graveyard and Memorial Hall for Victims by the Government satisfied only insufficiently victims’ right to truth. The right to justice has been severely violated by pardoning the convicted commanders and rejecting claims for damages. Furthermore, the victims’ right to reparation, including restitution, compensation, rehabilitation, satisfaction, and guarantee of non-repetition, has been essentially neglected, being compared with several compensation decisions relating to other massacres. Only the passing of the pending compensation bill will satisfy to a high degree the victims’ rights to reparation. At the same time, the fundamental reform of institutions and practices that aggravated the massacre by the army and the police could secure the superiority of civil power over the army and contribute to the guarantee of non-recurrence of massacres.
