코로나 바이러스 위험 하에서의 실내 대면예배 규제의 합헌성 판단기준 = Constitutional Criteria for Assessing the Constitutionality of Indoor In-person Worship Regulations under the Threat of the Coronavirus

지난 수년간 한국 교회는 코로나바이러스의 위협으로 인한 정부규제로 인하여 교회가 문을 닫기도 하고 아주 제한된 숫자의 대면예배만을 드리기도 하는 등 사상 초유의 상황을 맞이하였다. 이제 코로나바이러스의 위협이 대부분 물러갔지만 과거의 규제의 정당성을 다시 한 번 되새겨볼 필요가 있다고 본다. 그것은 앞으로 유사한 상황에서 정부규제를 어느 정도로 허용할 수 있느냐에 대하여 합당한 국가적 기준을 마련하여야하기 때문이다. 이런 관점에서 코로나 바이러스로 인한 보건규제가 실시되었던 기간 동안 예배의 자유에 대한 제한의 상황과 그에 대한 여러 소송과 판결 등을 검토하고 보건규제에 대한 합헌성 판단의 기준을 모색해 볼 필요가 있다.
위의 문제의식에 기초하여 본고에서는 다음의 세 가지 관점에서의 검토를 행하고 이에 기반하여 보건규제를 통한 종교자유의 제한에 대한 합헌성 판단기준을 도출하였다.
첫째로, 코로나바이러스 보건위험에 대하여 다른 나라 최고법원들이 어떻게 대응을 해왔는가에 대하여 검토하고 그로부터 일정한 시사점을 도출하였다. 우리나라의 사법적 판단에 가장 큰 영향을 미치는 미국과 독일의 경우를 살펴보면, 미국의 경우 판례는 시간에 따라 변화하였는데 미국연방헌법재판소는 결국 전면적 실내 대면예배의 금지는 위헌이며 제한적 실내 대면예배의 규제도 규제당국이 규제필요성과 조치의 적절성에 대해 입증을 하는 경우에만 정당성을 가진다고 판시하였다. 또한 그러한 보건규제는 다른 세속적 활동과 비교하여 형평성을 유지하여야 한다고 하였다. 한편, 독일 연방헌법재판소는 실내 대면예배의 금지는 허용될 수 있으나 예외가 인정되어야 하며 단기간 동안만 정당화될 수 있고 지속적으로 비례성 심사를 실시하여 이에 위반되지 않아야 한다고 하였다. 다른 세속적 활동과의 형평성에 대해서도 언급하였다.
둘째로, 우리 대법원과 헌법재판소가 종교의 자유에 대한 제한이나, 코로나 보건규제로 인한 국가의 기본권 침해에 대해 어떠한 시각에서 판단하여 왔는가 하는 점을 살펴보았다. 대법원은 종교의 자유에 대해서는 다른 자유에 비해 고도의 광범위한 보장이 이루어져야한다고 판시한 바 있으며 종교단체 내부의 문제에 대해서는 사법심사가 자제되어야 함을 밝힌 바도 있다. 한편 헌법재판소는 코로나바이러스 사태에 대한 과도한 기본권제한에 대하여 비례원칙 등을 위반하여 위헌이라고 판단한 바 있다. 셋째로, 코로나보건규제로 인한 종교자유 침해 사건에 대한 해결방안을 위하여 이에 대한 하급법원의 판례를 쟁점 별로 검토하였다. 결국 하급법원이 종교의 자유에 관한 대법원 판례이론의 큰 틀을 존중하여야 할 필요가 있다고 보며 최근의 헌법재판소의 코로나보건규제에 대한 위헌 결정의 취지도 하급법원의 판결에 반영되는 것이 바람직하다고 생각한다.
결론적으로 미지의 보건위협에 대한 초기의 극단적인 보건규제에 대하여 대법원과 헌법재판소는 적절한 합헌성 판단의 기준을 마련하여야 한다. 지금까지의 검토에 비추어 보아 그것은 ① 종교의 자유의 본질과 기본권 향유주체의 인식에 대한 존중, ② 종교의 자유에 대한 고도의 광범위한 보장원칙에 입각한 사법심사, ③ 평등원칙과 과잉금지원칙의 적절한 적용, ④종교적 핵심활동에 대한 존중이라는 이익형량 기준의 채택 ⑤ 증명책임법리에 대한 올바른 적용 등으로 구체화할 수 있다.
In recent years, Korean churches have faced unprecedented challenges in response to government regulations due to the threat of the coronavirus. Churches have had to close their doors and conduct limited in-person worship services, all due to government restrictions.34) Now that the threat of the coronavirus has largely receded, it is deemed necessary to reevaluate the legitimacy of past regulations. This is crucial to establish reasonable national standards for how much government regulation can be tolerated in similar situations in the future.
In light of this concern, it is necessary to review the situation of restricted religious freedom during the period of coronavirus health regulations in Korea, along with various lawsuits and judgments. Based on this awareness, the following three perspectives were examined in this paper to derive criteria for judging the constitutionality of restrictions on religious freedom through health regulations: Firstly, an examination was conducted on how different countries' supreme courts have responded to the health risks posed by the coronavirus. For instance, in the United States and Germany, judicial precedents have evolved over time. The US Supreme Court ultimately ruled that a blanket ban on indoor worship is unconstitutional, and even limited indoor worship regulations must be justified by the authorities' demonstrated need for regulation and the suitability of measures. It also emphasized maintaining equity compared to secular activities. Meanwhile, the German Federal Constitutional Court stated that while a ban on indoor worship may be permissible, exceptions must be recognized, and it should only be justified for a short duration, subject to continuous proportionality assessment, and ensuring fairness compared to other secular activities.
Secondly, this paper examined how our Supreme Court and Constitutional Court have interpreted limitations on religious freedom and infringements on fundamental rights. The Supreme Court has emphasized that religious freedom should be broadly and highly guaranteed compared to other freedoms and that judicial scrutiny should be exercised with restraint regarding internal issues within religious groups. On the other hand, the Constitutional Court has deemed excessive restrictions on fundamental rights during the coronavirus crisis as unconstitutional due to violations of the principle of proportionality.
Thirdly, lower court precedents regarding cases of infringement on religious freedom due to COVID-19 health regulations were reviewed to explore solutions. It is believed that lower courts should respect the overarching principles of the Supreme Court's theories on religious freedom and also consider the Constitutional Court decision in 2023 on the unconstitutionality of COVID-19 health regulations.
In conclusion, the Supreme Court and Constitutional Court must establish appropriate criteria for constitutional judgment regarding extreme health regulations in response to unknown health threats. Based on the review so far, these criteria could be articulated through ① respect for the essence of religious freedom and the recognition of the subject of fundamental rights enjoyment, ②judicial scrutiny based on broad and highly guaranteed principles of religious freedom, ③ principles of equality and proportionality, ④ standards for balancing interests to value religious core activities, and ⑤ correct application of the burden of proof law.
