청구인이 2006년3월 10일 남성에게만 병역의무를 부과하는 병역법 제3조 제1항이 청구인의 평등권 등을 침해하여 헌법에 위반된다고 위 조항의 위헌확인을 구하는 헌법소원심판을 청구한지 4년이 지나서야 헌법재판소의 결정이 내려졌다 헌법재판소가 기각 결정을 할 것이라고 예정은 되었지만 법여성주의 입장에서는 그 결과에 대한 아쉬움을 표할 수밖에 없었다. 헌법재판소의 다수견해는 다음과 같은 이유로 기각결정을 내렸다. (1) 여성은 그 생래적 특성상 현재 임신상태가 아니라 하더라도 임신· 출산·수유 등 대체 불가능한 부담으로 인하여 훈련 및 전투 관련 업무수행에 장애가 있다. (2) 전투를 수행함에 있어 요청되는 신체적 능력과 관련하여 집단으로서 남성은 집단으로서 여성에 비하여 근력 등이 우수하므로 더 적합하다 (3) 남자 중심으로 짜여진 군대조직 내에서 여성은 성희롱 등에 노출되어 있고, 전시에는 포로가 된 경우 성적 학대의 대상이 될 수 있는 등의 문제가 있다 위의 논거에 따라 여성을 병역의무에서 배제하고 남성에게만 병역의무를 부과하는 병역법 제3조 제1항은 자의적 차별이 아니므로 헌법에 반하지 아니한다고 하였다. 판례평석에서는 헌법재판소가 합리적인 이유로 정당한 차별을 하고 있다는 논지에 대하여 반박했다. (1) 첫째, 1970년대 미국을 중심으로 발달한 ``평등 모델`` 이론의 발전 과정을 추적하여 임신을 여성의 특별한 성징으로 구별하는 것이 아니라 업무수행을 하는데 장애가 되는 사유의 하나로 이해함으로써 임신의 ``정상화``를 꾀하였다. 이에 따라 임신 또는 임신 개연성만으로 여성 전체를 병역의무에서 배제하는 것은 합리적이지 못하다고 지적했다. (2) 둘째, 병사의 적합성을 판단하기 위해서는 진정직업자격을 검토해야 하므로 설사 양성간 신체적 능력의 차이가 존재하는 자료가 있어도 집단으로서 여성을 남성에 대비하여 평가하는 것은 바람직하지 못하다고 지적했다. 헌법재판소는 전통적인 성역할 구분 통념을 해체했다는데 그 의의가 있지만, 한편으로는 남성의 경험이 보편화된 남성중심적 기준으로 여성에 대한 평가를 하여 여성을 남성에 비해 ``부담``이 있는 존재로 규정하고 우열관계에서 열등한 ``2등 시민``으로 인식하였다는 한계를 보여주었다.
더보기The long awaited judgment by the Constitutional Court in the case of the judicial review of Article 3(1) of the Military Service Act (Case No. 2006HunMa328) was handed down on November 25, 2010. While the outcome of the decision by the Constitutional Court was not a surprise to the majority of legal professionals or the public, it was nevertheless a huge disappointment from the perspective of feminist legal theory. The applicant argued that Article 3(1) of the Military Service Act, based on Article 39(1) of the Constitution stipulating the constitutional obligation to national defense, violated Article 11(1) of the Constitution that provides the fundamental right to equality by imposing involuntary military service only to men. The Constitutional Court countered that claim on the grounds that (i) women become incapacitated to perform military duties because of their physiological characteristics which include menstration, pregnancy, childbirth, and nursing; (ii) men as a group possess the physical capacity that suits combat situations better than women do as a group; and (iii) women are vulnerable to deliberate sexual violence in the hands of the enemy and also within the military compounds due to the military`fs top-down organizational structure. I contend that what the Constitutional Court states as reasonable grounds for lawful discrimination based on gender is established upon erroneous reasoning. First, the feminist legal theory of ``equal treatment`` helps us understand the status of pregnancy not as a unique characteristic but as one of many examples of physical incident that temporarily hinders a person from fulfilling his or her job performance. Second, the selection of enlisted soldiers should depend on Bona Fide Occupational Qualification and not on conventional practices. Therefore, despite the fact that the disparity between men and women on physical capacity is well documented, men and women should not be judged as a group but as individuals. The Constitutional Court`fs decision is successful in dismantling the conventional idea of distributing social roles according to gender. However, the decision still lacks understanding of the notion of full equality by appraising women against male standards and defining women`fs characteristics as ``burdens`` not found in men`fs.
