기후위기 시대에 기본적 권리로서의 환경권- 미국의 판례를 중심으로 - = Environmental Rights as a Fundamental Rightin the Era of Climate Crisis- Focusing on the Precedents of the U.S. Court -

기후위기 시대에 지구환경을 보전하기 위한 전지구적인 협력체계가 실효적으로 운영되기 위하여는, 개별 국가는 환경국가의 목표를 기반으로 하여 기후위기 대응을 위한 적극적 입법행위 및 행정행위가 구현되어야 한다. 그러나 개별 국가의 입법과 행정작용 과정에서 환경보다 경제발전을 향한 유인이 더 크게 작용하는 경향성을 보이고 있어, 기후위기 대응을 위한 적극적 입법이나 행정계획 수립이 지지부진하고 실질적 대응조치로는 미흡하다는 비판이 제기되어 왔다. 위와 같이 불충분한 국가작용에 대해 시민들은 권리 침해를 이유로 법원에 행정소송, 헌법소송 등을 제기하였고, 일부 국가에서는 시민들의 청구가 받아들여지기도 하였다. 이러한 상황은 기후위기 시대에 입법과 정책에 대한 견제 수단으로서 사법부의 역할과 사법영역에서 환경권의 중요성을 단적으로 보여주는 것이다.
미국은 연방헌법상 환경권에 관한 명시적 규정을 갖고 있지 않지만, 일찍이 환경권에 관한 여러 가지 법률을 제정하였고 일부 주헌법에서 환경권을 규정하고 있다. 그럼에도 불구하고, 기후변화에 대한 정부의 불충분한 대응을 다투는 소송에서는 환경권이 주된 피침해권리로 등장하고 있다. 환경권은 실체적 적법절차원칙에 근거하여 기본적 권리로서 인정될 여지가 있고, 기본적 권리로서의 환경권이 인정되면 엄격심사의 원칙이 적용될 가능성 있어, 기후변화에 대한 정부정책의 실효성을 점검할 수 있을 것이다. 먼저, 주헌법상 기본적 권리로서 환경권이 인정된 판례를 분석하고, 연방지방법원의 판단을 살펴보면서 환경권이 연방헌법상 기본적 권리로 인정될 수 있는지를 검토해 보고자 한다.
우리는 미국과 달리 헌법에서 환경권을 규정하고 있다. 이러한 헌법상 환경권은 자유권적 성격과 사회권적 성격을 모두 갖는 종합적 권리이자 구체적 권리이다. 환경권의 침해는 사인에 의해 발생하는 경우가 일반적이고, 이러한 사인의 침해에 대해 국가의 기본권보호의무가 인정된다. 이러한 경우 헌법재판소는 과소보호금지원칙을 적용하면서, 첫째, 적어도 적절하고 효율적인 최소한의 보호조치를 할 것, 둘째, 과소보호조치의 위반이 명백할 것을 요구하고 있다. 그러나 이러한 기준으로는 환경권침해가 인정될 가능성이 낮기 때문에, 기후위기 시대에 환경권의 실효성 확보를 위하여 과소보호금지 원칙의 내용을 재정립하고, 환경권의 특성을 고려하여 환경권의 본질적인 내용이 침해되지 않는 심사기준이 적용되어야 한다. 정부의 불충분한 행위로 인하여 환경권이 침해되는 경우 엄격심사의 원칙을 적용하려는 미국의 논의를 살펴보면서 우리나라의 환경권 침해와 구제에 있어서의 시사점을 발견하고자 한다.
Although a global cooperation system has been established to protect environmental rights in the era of climate crisis, in order to actually guarantee environmental rights, every country’s will to protect environmental rights must be expressed through legislation and policies. There must be effective legislation, active administration, and judicial oversight as a means of checking them.
In the United States, various laws regarding environmental rights were enacted early on, and the Constitution was enacted about environmental rights in some state, but the federal Constitution does not provide for environmental rights. However, there is debate as to whether environmental rights can be recognized as a fundamental right under the Constitution. Therefore, the possibility of environmental rights being recognized under the U.S. Federal Constitution is being raised. In the United States, fundamental rights are recognized by the courts, and the due process principles of the 5th and 14th Amendments to the Constitution are invoked as the main basis for this. Therefore, environmental rights can be recognized as a fundamental right based on substantive due process. If environmental rights are recognized as fundamental rights, the principle of strict scrutiny is likely to be applied, making it possible to demand effective policies from governments that are not responding to climate change.
Among the precedents on whether environmental rights are recognized as a fundamental right, I analyze the precedents in which environmental rights were recognized as a fundamental human right under state constitutions, and examine the federal district court’s judgment on whether environmental rights can be recognized as a fundamental right under the federal Constitution. I would like to examine the possibility of recognizing environmental rights as a fundamental right.
Meanwhile, the Constitution of Korean stipulates environmental rights, this constitutional environmental rights must be recognized as both a comprehensive right and a specific right that has the characteristics of both freedom rights and social rights.
The state’s obligation to protect basic rights is recognized against violations of environmental rights by third parties. Once the state’s obligation to protect fundamental rights is recognized, it is determined whether the obligation to protect fundamental rights has been violated. In this case, the principle of no underprotection applies.
However, since it is difficult to recognize violations of basic rights by environmental rights when applying the principle of no undermining, strict standards need to be applied for actual protection of environmental rights. Therefore, assuming that the principle of prohibition of under-protection is applied, the words expressing the content must be organized, moving from clarity control to efficiency control, and review standards that take into account the characteristics of environmental rights must be applied.
