1998년 미국 워싱턴주의 IT 노동자들이 만든 노동조합인 ‘워싱턴테크노동조합’(이하 워시텍)은 미국 경제의 금융화와 노동의 불안정화라는 미국의 경제적인 변화를 바탕으로 탄생했다. IT 기업들은 나스닥을 통한 기업 상장과 미국 연기금의 투자를 바탕으로 단기간에 폭발적으로 성장할 수 있었지만, IT 기업 내부에서는 임금 수준, 고용 형태, 기술 교육 등을 비롯한 다양한 차원의 차별이 점차 형성되었다. 고임금과 엄청난 액수의 스톡옵션을 보장받은 상위 IT 노동자들과는 다르게, 하위 IT 노동자들은 사설 의료보험 혜택조차도 받지 못했다. 고용 형태 측면에서는 다른 기업으로의 이직을 반복하면서 더 좋은 조건을 찾아 나간 IT 노동자들과 다르게 1980년대부터 독립 계약자, 파견 노동자, 임시직 노동자와 같이 처음부터 제도적 차원에서 형성된 불안정한 조건의 IT 노동자들이 나타났다. 기술 교육 측면에서는 IT 노동자들이 최첨단 기술을 지닌 전문가로서 인식되었던 것과는 다르게 IT 기업 내에서 파견직 노동자들을 대상으로 ‘이류’, ‘무능력’, ‘배제 대상’으로 불리기 시작했다. 심지어 명찰 색깔, 이메일 주소, 회사 내 동호회 활동, 야유회 참석과 같은 부분에서도 IT 노동자들 내의 양극화가 나타났다.
1980년대 이후 워싱턴주에서 일한 IT 노동자들은 이상의 다양한 차별과 양극화를 겪으면서 집단적인 차원의 행동을 보였다. 대표적으로 1980년대에 불안정한 고용 형태에서 일하면서 차별을 받아온 마이크로소프트의 독립 계약자들이 마이크로소프트를 대상으로 한 집단소송을 시작했다. 하지만 여전히 IT 노동자들에 대한 차별은 파견 노동이라는 고용 형태를 통해 지속되었다. 또한 집단소송이 끝나기도 전인 1997년에 워싱턴주정부와 소프트웨어 기업 연합회의 유착을 통해서 ‘컴퓨터 노동자 초과근로수당 제외 행정 규칙’이 만들어졌고, 기업가들이 시간 당 27.63달러 이상을 받는 IT 노동자들에게는 초과근로수당 자체를 지급하지 않아도 되도록 만들었다. 워싱턴주정부에 대한 IT 노동자들의 분노는 700여 편이 넘는 주정부를 대상으로 한 집단항의서한 발송으로 나타났다. IT 기업들과 주정부, 정규직 기술직 노동조합에서 자신들의 이익이 대변되지 못하는 것을 보면서, IT 노동자들은 자신들의 목소리를 낼 수 있는 단체인 노동조합인 워시텍을 만들게 되었다.
본 논문은 IT 노동자들의 세 가지 특성을 분석할 것이다. 1998년 공개적으로 활동을 시작한 워시텍의 주요 활동을 살펴보면 당시 IT 노동자들이 형성한 정체성을 알 수 있다. 워시텍은 크게 초기업적 차원의 노조 활동, 노조 자체의 기술 교육 활동, 외국을 경계하고 미국 IT 노동자 우대를 요구한 국가주의적 활동을 보였다. 먼저 노동조합 초기 구성원들이 마이크로소프트라는 단일 기업에서 일했지만, 그들은 워싱턴주 차원에서의 IT 노동자들을 위한 활동을 중시했다. 워시텍의 초기업적 활동은 상술한 워싱턴주정부의 IT 노동자들의 이익에 반하는 입법과 집단적인 분노, 워시텍의 초기 형성을 지원한 미국통신노조의 조직화 방식 그리고 IT 노동자들에게 반강제적으로 요구된 고용 제도의 불안정성 속에서 나타났다. 두 번째로 워시텍은 다른 노동조합들과 다르게 노조 내부에서 IT 기술 교육을 매 분기마다 시행하고자 했다. 이들을 끊임없이 새로운 기술을 요구받는 IT 노동자들의 조건과 함께 기술 교육에서 배제된 IT 노동자들의 분노라는 배경 아래, 자신들의 주요한 활동을 기술 교육으로 삼고자 했다. 마지막으로 2001년 ‘IT 거품’ 붕괴 이후 수많은 IT 기업들의 파산과 대량 실업은 워시텍의 활동의 방향을 기존과 다르게 주로 국가주의적 활동으로 전환시켰다. 워시텍은 IT 기업들의 해외 아웃소싱을 막는 활동과 H-1B 비자를 통한 외국인 IT 노동자들의 인력 축소에 집중했고, 점차 외국인 IT 노동자들을 경계하고 미국인 IT 노동자들에 대한 고용을 우선하는 입장을 취하게 되었다.
결론적으로 필자는 워시텍의 활동과 그 과정에서 드러난 IT 노동자들의 정체성 분석을 통해 IT 노동자들에 대한 이해의 폭을 넓히고자 한다. 이 시도의 핵심은 그동안 단면적으로만 비춰져 왔던 IT 노동자들의 모습을 다층적으로 들여다보고자 하는 노력이다. IT 노동자들에 대한 과도한 일반화를 지양하고 그들의 양극화된 모습 등을 분석한다면 불안정한 고용 형태로 인해서 불가피하게 지니게 된 초기업적인 정체성, 부족한 기술 교육에 목말라 하는 노동자로서의 정체성, 외국에서 온 IT 노동자들을 배척하는 국가주의적 정체성을 확인할 수 있다. 이처럼 IT 노동자들의 분화와 복잡한 정체성을 정확히 인식하는 것은 이후 이어질 IT 노동자들과 새로운 기술 혁신 분야 노동자들의 노동조합 활동에도 도움이 되리라 여겨진다.
In 1998, the Washington Alliance of Technology Workers, a labor union created by IT workers in Washington State, was created based on the U. S. economic changes - the financialization of the U. S. economy and the instability of labor. IT firms were able to grow explosively in a short period of time based on initial public offering through NASDAQ and investments by U. S. pension funds, but within IT firms, discrimination was gradually formed at various levels, including wage levels, employment patterns and technology training. Unlike top IT workers, who were guaranteed high wages and huge amounts of stock options, lower IT workers even do not receive private medical benefits. In terms of employment patterns, IT workers with unstable conditions formed from the beginning, such as independent contractors, contingent workers, and temporary workers, emerged in the 1980s, unlike IT workers who repeatedly moved to other companies and sought better conditions. In terms of technology training, IT workers have begun to be called ‘second-rate’, ‘incompetence’ and ‘subjects for exclusion’, contrary to what was perceived as being experts with state-of-the-art skills. Even in areas such as name tag color, e-mail address, club activities in the company, and attendance at picnics, polarization within IT workers appeared.
IT workers, who have worked in Washington state since the 1980s, have shown collective action as they undergo a variety of further discrimination and polarization. Representatively in the 1980s, Microsoft’s independent contractors, who have been discriminated against while working in unstable forms of employment, launched class action suits against Microsoft. However, discrimination against IT workers still persisted through the form of employment called contingent labor. In addition, in 1997, even before the class action lawsuit was over, the “rule exempting computer professional overtime pay rate” was created through the collusion between the Washington State government and the Washington Software and Digital Media Alliance, and it made entrepreneurs not have to pay overtime pay themselves to IT workers who receive more than $27.63 per hour. IT workers’ anger toward the Washington state government turned out to be a collective protest mailing to more than 700 state governments. Seeing their interests not represented by IT companies, state and full-time technology unions, IT workers created Washtech, an organization that can speak for itself.
This paper will analyze three characteristics of IT workers. A look at Washtech’s main activities, which began publicly in 1998, shows the identity formed by IT workers at the time. Washtech has largely shown beyond-company(industrial) union activities, its own technical education activities, and nationalistic activities that have been wary of foreign countries and demanded the preferential treatment of U. S. IT workers. First of all, early members of the labor union worked for a single company called Microsoft, but they valued activities for IT workers at the Washington State level. Washtech’s beyond-company activities have emerged amid the aforementioned legislative and collective anger against the interests of IT workers in Washington state, the way the Communication Workers of America organized supporting the early formation of Washtech and the instability of the employment system, which is demanded semi-forced by IT workers. Secondly, unlike other unions, Washtech wanted to implement IT technology training within the union every quarter. They wanted to use their main activities as technical training in the background of the anger of IT workers who were excluded from technical training, along with the conditions of IT workers who were constantly asked for new technology. Finally, the bankruptcy and mass unemployment of numerous IT companies since the collapse of the “IT bubble” in 2001 have shifted the direction of Washtech’s activities to largely nationalistic activities, unlike before. Washtech focused on activities preventing IT companies from outsourcing abroad and reducing the workforce of foreign IT workers through H-1B visas, gradually taking a stance of wary of foreign IT workers and prioritizing employment for American IT workers.
In conclusion, I would like to broaden understanding of IT workers through the activities of Washtech and the analysis of the identity of IT workers revealed in the process. At the heart of this attempt is an effort to look at the image of IT workers in multiple layers, which has been seen only in cross-section. By avoiding excessive generalization of IT workers and analyzing their polarization, one can identify the beyond-company identity inevitably had due to unstable employment patterns, the identity of workers thirsty for poor technical training, and the nationalistic identity of rejecting IT workers from abroad. This exact recognition of the differentiation and complex identity of IT workers is also believed to help the labor union activities of IT workers and workers in new technological innovations that will follow.
