As Immanuel Kant reiterated, "man is the only being who needs education." Then, what is education, which is considered a special activity of human beings? In which forms has it existed and should it be?
To answer these questions, it is essential to review constitutional approaches to education as the constitution represents the fundamental consensus among members of a national community. The constitution recognizes an education as significant only when the education is most suitable to fostering an exemplary constitutional citizen, who is a man with dignity closely engaged with the national community, and the outcome of the education substantially contributes to individuals and the nation. In particular, the constitution guarantees the 'right to receive an education' as a fundamental human right, which serves as the most optimum impetus to ensure the education to be most effective, and, to this end, it establishes an 'institutionalized system.' As such, due to these optimum conditions for education, the entitlement to education has been claimed against the nation from the beginning.
However, the hitherto legal research and judicial precedents have been limited in explaining how the right to education under the Constitution of the Republic of Korea has been systematically enforced, how it can help solve actual issues, and how changed reality surrounding the Constitution can be interpreted. Based on the recognition of these problems, this study aims to prove the system of guaranteeing the right to education under the Constitution.
Chapter 2 outlines the constitutional concept of education and its enforcement structure. This is a process to reaffirm the concept of education, which has been evolved into diverse directions from ancient times, by newly understanding it as a constitutional one. From a constitutional perspective, a meaningful education represents a 'behavior system' and 'institutionalization' of fostering a citizen living up to the expectations under the constitution. In other words, such a behavior system is an education in the narrow sense, implemented under a nation's special protection or within permitted or safeguarded institutions. To ensure education has a substantial meaning as a constitutional concept, it is prerequisite to guarantee rights for those who receive an education.
Chapter 3 examines the background of the constitutional guarantee of the right to education. The French Revolution and other movements in the 18th and early 19th centuries led the western world to view education as a public function under the government's responsibility and to increasingly perceive education as a right to claim against the nation. From the mid 19th century, however, the right to education was only translated into the freedom of education through enactment of private education. Rather, socialist countries stipulated that the government shall guarantee the right to education after the enactment of the constitution by the Union of Soviet Socialist Republics (USSR) in 1936. This has led most countries around the world to enshrine the right to education in their constitutions. For Korea, the recognition of education as a right was already embedded in the thinking of establishing the nation on the basis of education during the time of enlightenment, but in the wake of the colonial suppression by the Japanese Empire, the perception was overshadowed by the freedom of education, underpinned by the development of private educational institutions for the Korean public. However, the right to education enshrined in the constitution document of the Provisional Government of the Republic of Korea before the liberation of the nation was reflected in the draft of the constitution after its liberation, guaranteeing the right to education under the Constitution.
Chapter 4 focuses on the system to guarantee the educational right in Article 31 of the Constitution of the Republic of Korea. The right to education specified in Paragraph 1 of Article 31 of the Constitution has been discussed in various ways. However, this is a fundamental constitutional right focused on the right to learn in the 'narrow sense.' The right to education takes on dual features considering the historical background of its being guaranteed, distinct characteristics of the norm applied to educational areas, and the current situation of gradually blurring distinction between civil liberty and social right. The right to education as a fundamental social right means a subjective right enshrined in the constitution. The right to education is a universal human right. In particular, when it comes to the compulsory education, even foreigners are entitled to the right in that it is the minimum core to be guaranteed.
Examining the relations between Paragraphs 2 and 3 of Article 31 of the Constitution, Paragraph 2 is about compulsory education, not compulsory schooling as argued from the conventional interpretation. Therefore, Paragraph 3 stipulates that the nation shall provide education free of charge should any citizen not perform obligation to educate their child. Given this, home schooling and the like can be explained as a special subject of the Constitution today. In order to entitle the people to the right to lifelong education, Paragraphs 5 and 6 of Article 31 specifically states a lifelong education system. To ensure the nation to formulate policies on education under the law, the Constitution of the Republic of Korea instructs legislators to fully comply with Paragraph 4 of Article 31 to come up with concrete measure of the 'basic conditions.'
Chapter 5 deals with the relations between the right and authority of stakeholders in education. Children's right to learn cannot always take precedence over their parents' right to educate them. Parents may impede their children's right to learn for their long-term interest. In principle, citizens' right to educate their children has precedence over the nation's authority to educate them. However, in the public education, parents and the government have an obligation to work together to entitle children to the right to education. While teachers' educational right has been perceived as a mere authority on duties, there is a possibility it can be recognized as a basic constitutional right in the minimum range.
The current dispute over what is a true education today has mainly arisen from conflicts related to education given its surroundings and context in reality. To resolve the dispute it is imperative to examine the Constitution's approach to education, the fundamental norm of a national community. A meaningful education under the constitution is a behavior system to foster a constitutional citizen as a man with dignity living up to the expectations of the constitution. To this end, the constitution enshrines the right to education on the one hand and stipulates systematic institutions on the other hand.
Therefore, to answer the questions of what is a true education, which education should be taken, and what should be a standard in reality in resolving conflicts surrounding education, it is necessary to have a systematic explanation of how the right to education is guaranteed by the Constitution.
칸트(Immanuel Kant)가 “오직 인간만이 교육을 필요로 한다(Man is the only being who needs education)”라고 선언한 바처럼, 인간 존재에 있어서 그 특별한 활동으로 여겨지는 교육이란 무엇인가? 어떤 모습으로 존재하여 왔으며, 또 존재하여야 하는가?
이러한 물음에 답하기 위해서는 국가공동체 구성원의 근본 합의인 헌법의 태도를 확인하는 작업은 필수적이다. 헌법은 자신의 인간상에 부합한 헌법적 시민, 즉 국가공동체와 긴밀하게 연결된 존엄한 인격체를 형성하는데 가장 적합하고, 그 결과가 개인과 국가차원에서 중대한 기여를 할 수 있을 때, 헌법은 그것을 의미있는 교육이라고 부른다. 특히 헌법은 이러한 교육이 가장 효과적으로 이루어질 수 있는 최적의 장치로서 ‘교육을 받는 자의 권리’를 기본권으로 보장하고 있고, 이를 위해 ‘제도화된 시스템’을 마련하고 있는 것이다. 이처럼 교육을 받을 권리는 그것이 가장 효과적으로 이루어질 수 있는 최적의 조건 때문에, 처음부터 국가를 대상으로 주장하여 왔다.
그러나 지금까지의 연구와 판례의 태도는 우리 헌법에 보장된 교육을 받을 권리가 어떻게 체계적으로 보장되어 있는지, 현실적인 문제 해결에 어떤 도움을 줄 수 있는지, 그리고 변화된 헌법현실을 어떻게 설명할 수 있는지에 대해 한계를 보여 왔다. 본 연구에서는 이러한 문제의식을 기초로 교육을 받을 권리의 헌법적 보장 체계를 논증하고자 하였다.
제2장에서는 교육의 헌법적 개념과 실현구조를 다룬다: 이것은 고대로부터 현재까지 다양하게 전개되어온 교육이라는 개념을, 다시 헌법적으로 개념으로 재인식하고 확정하는 과정이다. 헌법적 관점에서 의미 있는 교육이란, 헌법의 인간상에 부합하고 헌법적 시민을 형성하기 위한 ‘행위체계’와 ‘제도화’를 의미한다. 즉 국가의 특별한 보호아래 형성되거나 허용․보호되는 제도 안에서 이루어지는 행위체계로서 좁은 의미의 교육을 의미한다. 이러한 헌법적 개념으로서 교육이 실제적인 의미를 가지기 위해서는, 무엇보다 그것을 받는 자의 권리 보장이 필수적이다.
제3장에서는 권리로서 교육의 헌법적 보장 배경을 살펴본다: 서양의 경우 18-9세기 초 프랑스대혁명 등을 계기로 교육을 국가가 책임지는 ‘공적 기능(Public function)'으로 인식하고, 교육에 대한 권리 의식은 국가를 향하여 성장하였다. 그러나 19세기 중반 이후 교육에 관한 권리는 사교육법제화를 통해 교육의 자유를 보장하는데 그친다. 오히려 사회주의국가에서 1936년 소비에트헌법(USSR, 1936)을 계기로 교육의 권리를 국가가 보장해야 한다고 규정하였다. 이를 계기로 오늘날 대부분의 국가에서 교육을 받을 권리를 헌법차원에서 보장하게 되었다. 우리의 경우 개화기 교육입국사상 등에 교육에 관한 권리 의식이 이미 잠재되어 있었으나, 일제의 탄압을 계기로 오히려 민족사학이 발달하는 등 교육의 자유를 먼저 요구하였다. 그러나 해방 전 대한민국임시정부의 헌법문서에 규정된 교육의 권리가, 해방 이후 헌법초안에 반영됨으로써 교육을 받을 권리가 헌법적으로 보장되었다.
제4장에서는 헌법 제31조의 교육을 받을 권리의 보장 체계를 다룬다: 우리 헌법 제31조 제1항에 규정된 교육을 받을 권리는 그동안 다양하게 논의되어 왔다. 그러나 동권리는 ‘좁은 의미’의 학습권이 중심이 되는 헌법의 기본권이다. 이러한 교육을 받을 권리는 그것이 보장되어 온 역사적 배경을 살펴보거나, 규범영역(Normbereich)의 특수성, 오늘날 자유권과 사회권의 구별에 관한 상대화 논의 과정을 살펴볼 때, 이중적 성격을 가지는 기본권이다. 여기서 사회적 기본권으로서 교육을 받을 권리는 헌법의 확정된 주관적 권리이다. 특히 교육을 받을 권리는 오늘날 누구나 가져야 할 인권으로서, 최소한의 보장영역(Minimun Core)인 초등교육에 관하여는 외국인도 그것을 받을 주체가 된다.
헌법 제31조 제2항과 제3항의 관계를 살펴보면, 제2항은 전통적인 해석처럼 ‘취학 의무(Compulsory Schooling)’를 규정한 것이 아니라, ‘교육 의무(Compulsory Education)'를 규정한 것이다. 따라서 제3항은 부모가 자녀에 대한 교육의무를 이행하지 아니한 경우, 국가가 무상으로 교육을 제공하도록 규정한 것이다. 이렇게 볼 때 오늘날 헌법의 특수문제로서 홈스쿨링 등이 설명될 수 있다. 국민이 평생을 통하여 교육을 받을 권리를 보장하기 위하여, 헌법 제31조 제5항과 제6항은 평생교육시스템을 특별히 마련하고 있다. 국가가 교육에 관한 제도를 법률로 형성함에 있어, 우리 헌법은 제31조 제4항 규정을 입법자가 반드시 준수하여 ’기본적인 사항‘을 구체화할 것을 명령하고 있다.
제5장에서는 교육당사자간의 권리와 권한 관계를 다룬다. 미성년자녀의 학습권은 부모의 교육권에 대하여 언제나 우선할 수 없다. 부모는 자녀의 장기적 이익의 관점에서 자녀의 학습권을 제한할 수도 있다. 부모의 자녀에 대한 교육권은 국가의 교육권한 보다 원칙적으로 우선된다. 그러나 학교교육에서는 부모와 국가가 함께 협력하여 자녀의 교육을 받을 권리를 보장해야 할 의무가 있다. 교사의 교육권은 그동안 직무권한에 불과한 것으로 이해되어 왔으나, 오늘날 최소한의 범위에서 헌법의 기본권으로 인정될 수 있는 가능성도 있다.
오늘날 무엇이 진정한 교육인가에 대한 물음은 그것이 제기되는 현실적 좌표와 맥락을 고려할 때, 교육을 둘러싼 다툼에서 비롯된 것들이 대부분이다. 이러한 문제해결을 위해서는 국가공동체의 근본 규범인 헌법의 태도를 반드시 확인해야 한다. 헌법은 자신의 인간상에 부합한 존엄한 인격체로서 헌법적 시민을 기르는 행위체계를 의미 있는 교육이라고 부른다. 이를 위해 한편으로 교육을 받는 자의 권리 보호를, 다른 한편 제도적 시스템 체계화하고 있다.
따라서 무엇이 진정한 교육인지, 어떤 교육을 받아야 하는지, 교육을 둘러싼 현실적 갈등 해결의 기준이 무엇인지는 교육을 받을 권리가 어떻게 헌법적으로 보장되어 있는지를 체계적으로 설명할 때 답할 수 있는 것이다.
