미국과 러시아는 지난 1990년 미·러 해양경계협정에서 1867년 체결한 알래스카 조약선을 그대로 양국간 해양경계선으로 합의하였다. 이 협정이 구체적으로 논의되고 타결되기까지(1981년~90년) 국제사회에서는 미·러의 정치적 냉전 시대와 1985년 이후의 뉴데탕트 시기를 거쳐 소련이 와해되기 직전인 1990년에 탈냉전의 분위기 편승하여 타협에 이르게 된다.
협정의 진행과정에서 미국과 러시아는 베링해역 경계획정의 문제를 두고 많은 의견차이를 가지고 있었다. 미국의 경우, 지난 1867년 조약선을 그대로 해양경계선으로 제정할 것을 주장했는데 이는 1867년의 조약을 '양도(concession)'의 개념이 아닌 '영토와 통치(territory and dominion)' 개념으로 인식했으며 '국가 주권 (national sovereignty)'의 개념으로 받아들이려 했음을 의미한다.
이후, 1945년 '트루만 선언(Truman Proclamation)'을 발표하여 국가관할 대륙붕 자원에 대한 권리를 확고히 굳혀나갔다. 이는 대륙붕이 연안국에 속한다는 생각을 명백히 규정한 최초의 주장이며 대륙붕 제도의 효시로 인정되고 있다.
반면, 러시아의 경우, 1867년 조약은 시기적으로 해양경계에 대한 개념이 부재(不在)한 시기에 맺은 조약이며 지리적 영토분할로 나눈 선이라고 밝히고 있다. 또한 1867년의 조약선을 양국간 해양 경계선으로 적용할 경우, 국제 해양경계법의 원칙인 '등거리 원칙 (equidistance principle)'을 적용하는 경우보다 불리한 상황에 놓이게 되었다.
해양경계선의 문제가 구체적으로 제시된 것은 1977년 '어업관할권(fisheries jurisdiction)' 설정을 두고 양국이 논의를 벌이던 과정에서 1867년 조약선을 서로 다르게 인식한 것에서 비롯한다. 이는 지도제작법 상의 문제인 메르카토르 투영도법(mercator projection)의 직선(straight line)인 정각선(rhumb line)과 곡선(curved line)인 측지선(geodetic line)과의 차이에서 비롯되었다.
1984년까지 협상을 위한 회담은 1867년 조약선의 어업관할권 시행에 관해서만 언급하고 있다. 이에 양국은 연안으로부터의 200 해리 내의 선에서만 '어업관할권(fisheries jurisdiction)'을 시행하도록 합의했다. 해양경계협정을 위한 회담은 1981년에서 90년까지 양국의 수도(首都)인 워싱턴과 모스크바를 오가며 외무, 국방, 항해, 석유, 가스 개발의 대표를 구성하여 진행해갔다.
협상의 첫 단계는 1867년 지도제작법상의 문제에 중점을 두었고 1867년 조약의 해석차이에 관한 문제를 논의했다. 전반적으로 1981년에서 90년까지의 협상 과정은 해양경계선의 적용과 관련한 문제에 집중, 1867년의 조약선과 단일 국가 200 해리 내의 지역, 양국 간 200 해리 이상의 지역문제에 중점을 두었다.
러시아의 경우, 처음에 미국의 요구사항(1867년 조약선을 그대로 해양경계선으로 인정하는 안(案))에 대해 반대했다. 그러나 러시아는 미국과 타협을 이루기 위해 1867년 조약선을 해양경계선으로 적용하되 미국관할권에 속하는 중부 베링해역 경제수역에 관한 경제적 보상과 대륙붕 석유자원에 대한 공동 탐사를 요구했다. 미국은 이에 반대했으나 대륙붕 자원의 개발 문제를 두고 정치적 해결(political solution)을 하기에 이른다. 이는 곧, '중부 베링해 경제수역에 대한 보상' 건(件)이 공식적인 협상의 타결과정에서 하나의 '교환 조건(trade-off)'으로 작용했음을 의미한다.
1990년 미·러 해양경계협정의 특성을 언급하면 다음과 같다. 첫째, 1990년 미·러 해양경계협정(이하 1990년 협정)은 1867년 조약선을 그대로 해양경계선으로 인정했음에도 1867년 조약과의 관계를 명확히 명시(明示)하지 않은 채, 상호분쟁 지역에 대한 타협안만을 제시하고 있다. 결국 러시아는 1867년 조약을 해양경계로 제정함으로서 영토에 관한 요구(claim)와 연계를 맺는 관계를 만들었다.
둘째, 1990년 협정은 '선의 규정(definition of line)'이란 측면에서 다른 의미를 가지고 있는데 이는 제 5조 "국제법에서 허용되는 한(as far as permitted under internatinal law)"이라고 표기하고 있으며 양측의 차후(此後) 요구사항에 대해 명확히 밝히지 않고 있다.
셋째, 1990년 협정에서는 지난 1867년 조약의 지도제작법의 오류에서 기인 '기술적 방법(technical method)'의 문제를 명확히 하고 있다. 즉, 베링해 내 200 해리 이상의 북부 공해상의 폐쇄해역은 정각선(rhumb line)을 사용하며 그 외의 모든 지역은 측지선(geodetic line)을 사용한다고 명시하고 있다.
넷째, 1990년 협정은 배타적 경제수역(EEZ)의 주권적 소유와 관할권의 이전(移轉)을 조정하는 조항을 포함, EEZ의 주권과 이와 연관된 어업시행(fishery enforcement) 및 200 해리 이상의 EEZ 관할권에 대해서도 국제법상 선례로 남게 되었다.
본 협정이 서명된 후, 미·러 양국은 서로에게 200해리의 배타적 경제수역을 요구했으며 그로 인해 양국의 대륙붕은 서로 겹쳐지는 상태에 이르게 된다. 협정이 체결된 후, 러시아 국내에선 협정에 대한 비난의 여론이 들끊었고 1990년 9월 16일 미(美) 상원은 동의안을 제출했으나 러시아가 비준서를 제출하지 않음으로써 양국은 2000년 6월 지금 현재까지 이 상태로 남아있다.
미·러 해양경계협정이 이루어지는 과정은 초(超) 강대국간 냉전의 역사와 고르바초프의 개혁정치 이후 시작된 탈냉전으로의 전환기를 배경으로 하고 있다. 또한 국제해양법에서 배타적 경제수역의 개념과 해양자원 개발의 문제가 크게 대두되면서 이루어진 1982년 유엔해양법 협약 역시 1990년 미·러 해양경계협정 성립에 장기적으로 영향을 미쳤다고 할 수 있다.
당시 소련의 국내적 상황(민족문제 및 지역갈등 등)은 상대국에 대한 대외적 관계에 비해 더 많은 비중을 차지했으며 정치적 혼란의 와중에 있었다. 이에 반해, 1980년 대 후반의 미국의 대(對) 러시아 정책은 소련의 변화를 긍정적으로 인식하고 평화공존의 기조를 강화하는 과정에 있었다. 반면, 러시아는 미국과의 대외부문에 대한 경쟁보다 국내문제의 해결이 급선무였다.
미·러 해양경계협정은 1991년 소련의 와해(瓦解) 직전, 탈냉전의 분위기에 편승하여 미·소간의 급격한 관계변화와 국제정치질서의 재편과정에서 합의에 이르게 된다. 이는 '탈 냉전의 이데올로기'가 협정의 성립과정에 가장 큰 '정치적 고려사항(Political Considerations)'이 되었음을 의미한다. 즉 국가 간 협력의 양상은 공통된 목표와 이해관계를 바탕으로 갈등적이며 보완적인 관계에서 나타나는데 그 시대의 이데올로기는 이러한 '국제 협력'의 형태에 가장 큰 영향을 끼친다고 할 수 있다.
결국 국제사회의 '무정부 체제(Anarchical System)'의 성격은 기존(旣存)의 국제 해양관계의 역사적인 면과 비교해 상당히 유사한 측면을 가지고 있고 1990년 당시의 지배적 '탈냉전의 신국제질서'는 미·러 해양경계협정에 이르기까지 두 나라 관계에 지대한 영향을 끼쳤다고 볼 수 있다.
In June 1990 the United States and Soviet Union signed an agreement on their maritime boundary that has been applied the line of article 1 of the 1867 Convention on the cession of Alaska. During the negoatiation for ten years(1981 ~90), it's the periods of political Cold War between the United States and Soviet Union and the New Detente. In the 1990, just before the Soviet Union's break-up, it came to reach agreement due to Post- Cold War's mood.
During the estabishment of maritime boundary agreement, the United States and Russian Federation have given diverging interpretations of the relationship between the 1990 maritime boundary agreement and the 1867 Convention.
The United States is of the opinion that the 1990 agreement reflects the view of the United States that the maritime boundary should follow the 1867 Convention line. It based on the fact that the 1867 Convention in its Article 1 refers to the cession of "territory and dominion". The United States holds that this term covers the cession of sovereign rights and jurisdiction of the coastal state over maritime zones, which did not exist under international law at the time the convention was concluded.
The United States established firmly the 'national jurisdictional resources of the Continental Shelf' by the Truman Proclamation in 1945. It is the first one on the Continental Shelf's appertainment to the coast nation and accepted as the foundation of Continental regime.
On the other hand, for the Russian Federation an important element of the 1990 agreement on the delimitation of the maritime boundary is that it reflects that the line in the 1867 Convention was not at the time of the conclusion of the 1867 Convention intended as a line to delimit maritime zone. It Just marked as the 'territorial division' on Geographical Considerations.
In case, the 1867's Convention line applied to the maritime boundary delimitation between the two countries, Russian Federation would be disadvantageous in comparison to an equidistance line has applied. They took the 1867's Convention line in different ways resulting from the cartographical matter. Soviet Union depicted the 1867 Convention line in the Bering Sea as rhumb line while the United States utilized are of great circle regarding on the Mercator projection. The differing depictions resulted in an area of overlapping claims of almost 21,000 square n.m. in the Bering sea.
Negotiations on the delimitation of a boundary, until 1984 only concerned the definition of the 1867 line for the purpose of fisheries jurisdiction. The establishment of economic zones and exploration activities on the continental shelf in the Bering Sea led to the decision to negotiate an all-purpose boundary. The first round of negotiations focused on the method for depicting the 1867 line and the interpretation of the 1867 Convention.
U.S.-Soviet discussions began in November 1981 and generally alternated between Washington and Moscow. They continued until 1990. Delegations included representatives of agencies responsible for foreign affairs, defense, navigation, fisheries, and oil and gas development. The agreement was initialed in January 1990 in Moscow and signed on 1 June 1990 during the Washington summit meeting.
By and large, while the talks were being held from 1981 to 1990, United States and Russian Federation were concentrating on settlement of maritime boundary delimitation line and the sea area within the single states's 200 nautical miles and the above sea area of 200 nautical miles.
The Russian Federation never seems to have regarded the 1867 Convention as having established a maritime boundary. But later, the 1867 line has become accepted as a line delimiting the maritime zones of the parties. The Russian Federation held that it had to be compensated for the loss of part of its EEZ in the central Bering Sea which was located on the United States side of the 1867 line, but which was situated more than 200 miles from the coast of the United States. In addition, the Russian Federation proposed joint exploitation of the continental shelf area in the central Bering Sea.
At first the United States declined the Soviet's claim concerning compensation for the loss of undisputed EEZ area east of 1867 line, but later stage indicated that it was prepared, as a compromise, to reverse this position. The Soviet Union dropped its claim to continental shelf area east of the 1867 line in order to obtain the United States' agreement over the compensation for the EEZ area, thus securing a compromise. Russian Federation's proposals acted as 'trade-off' for the negotiation on formal talks. As a result of dispute, the United States took a cautious approach to the development of hydrocarbon resources, which was specifically designed to support the United States' claims while not prejudicing the outcome of the negotiations on the boundary. The Soviet Unoin entered a protest with the United States against this approach.
The peculiarities of the 1990 agreement is as follows;
First, even though the 1990's agreement applied the 1867's Convention line to the Maritime Boundary line, it does not seem to provide unequivocal evidence concerning its relation to the 1867 Convention. Furthermore, 1990 agreement does not explicitly record that the 1867 Convention created a legal obligation for the parties regarding the delimitation of their maritime boundary. Instead, article 1 of agreement only provides that the line of the 1867 Convention Is the maritime boundary.
Second, although the 1990 agreement accepts the 1867 line in principle as the maritime boundary, the 1990 agreement differs considerably with the 1867 Convention as regards the definition of this line. The 1990 agreement defines the line as following a meridian 'as far as permitted under international law'. The formulation 'as far as permitted under international law' is indefinite and does not explicitly rejects any claims in regard of the sector line.
Third, the 1990 agreement specifies the technical method used to depict the boundary line. Article 2(3) states that all geographic positions are connected by geodetic line, except where noted. In an area north of high seas enclave beyond the outer limit of the 200 miles zones in the central Bering Sea the boundary is defined for some 70 miles as a rhumb line.
Forth, the 1990 agreement contains a provision to arrange the transfer of jurisdiction from the party possessing the EEZ sovereign rights and jurisdiction to the other party. It is an example of the exercise of EEZ related rights and jurisdiction beyond the 200 miles and use such a precedent as a justification to extend their own EEZ jurisdictional rights beyond 200 miles.
United States and Russian Federation requested the 200 nautical miles' EEZ after the agreement had signed, the Continental shelf became overlapped. As a result of the 1990 agrement both states have on their side of the boundary a number of areas which are further than 200 miles from their coasts, which without the agreement would have formed part of the other states. Three of these areas are situated on the American side of the boundary (referred to as 'eastern special area') and one on the Russian side (referred to as 'western special area'). The 1990 agreement and the way in which the Soviet Ministry of Foreign Affairs conducted the negotiations with the United States have been sharply criticized in a number of newspaper articles.
While the Unites States's senate voted favorably to give its advice and consent to ratification of the 1990 agreement on 16 september 1991. But the agreement as yet has not been ratified by Russian Federation. It has been suggested that the Russian Parliament might reject ratification of the 1990 agreement. However, its provisions, including the boundary line, have been applied by agreement of both governments since 15 June 1990 pursuant to an exchange of notes signed 1 June 1990.
The negotiations had to resolve fundamental issues of principle, including the basis for resolving the boundary issues of treaty interpretation, and a range of complex, technical issues. And while Russian Federation has yet ratified the agreement, its provisions have been applied by agreement of both governments since 15 June 1990. Its duration is indefinite.
During the maritime boundary agreement, the Cold War between the United States and Soviet Union, Perestroika and the transition to Post- Cold War had followed. The 1982 UN law of the sea that formed by Exclusive Economic Zone's concept in the international law of the sea and the ocean resources development had being effected for a long time to the agreement.
At that time, Soviet Union's domestic situation (national matter and regional conflict) was given more weight than foreign relations. And Soviet Union was in political conflict. But the late of 1980's United States' policy towards the Soviet Union was affirmative acceptance of its change and the strengthened peace co-existence. For Russian Federation, the solutions to domestic matter was more urgent than the competition with foreign countries.
The U.S.- Russian maritime boundary issues were reached agreement due to Post-Cold War mood, just before the Soviet Union's break-up. That is the one of the factors, the 'Ideology of the Post- Cold War' attributed greatly regarding on political considerations.
Finally, the nature of 'Anarchical System' in international Community has quite similar attributes on historical aspect in international maritime boundary relations and the dominant 'new international order based on the end of Cold War' influenced a lot by the time of the 1990 Agreement's negotiation.
