Social Rights concern material needs which are essential to guarantee decent living goods and services enough for human dignity which includes the rights to minimum income・housing・food・water・heath care・medical care・education・labor・environment・social security・social welfare etc. Social Rights are usually claims on states demanding protection from social risks and provision of benefits which are necessary for a decent living economically, socially and cuturally. States assume a final responsibility for implements to respect, protect and fulfill of Social Rights. Its ultimate objective is heading for substantial guarantee of personal liberties.
The Constitutional Court has to determine the contents and protection-area (Schutzbereich) of Social Rights through interpretation of the Constitutional Law. On the basis of this interpretative analysis, The Constitutional Court has to judge whether states’ acts or omissions violate the requirements for implementing the relevant Social Rights. That is the order of the Constitutional Law. On this scrutiny process, “Minimum Core Approach” works as a lowest marginal line for guarantee of the relevant Social Rights. The infringement of “Minimum Core” is definitely unconstitutional because it damages the essential contents of the relevant Social Rights. But the “Minimum Core” is neither fixed nor absolute. Rather, it is extracted through weighing a balance(Abwägung) considering contexts of each case. The “Minimum Core Approach” justifies giving much more weights on a special section of Social Rights’ protect-area(Schutzbereich) and its urgent realization. Further more, the “Minimum Core Approach” imposes burden of proofs on states who infringes even the “Minimum Core”.
Through the judicial review on Social Rights, the Constitutional Court can shape Optimization to implement of Social Rights by combining the continually phased Intensities of Scrutiny with multiple layers of Standards of Scrutiny. Judicial Review would depends on various points such as the concrete facts of each case, types of state action or omission, total population of beneficiaries, types and degrees of social risks, urgent needs, importance and gravity of relevant basic social rights, restrictions and infringements on basic social rights, colliding and competing basic rights. Furthermore it has to be considered how to balance constitutional interests and values individually and concretely, how to finance, how to allocate resources. Besides strict scrutiny has to be called for when it comes to the urgent needs of the marginalized and coping with urgent or short-term crisis. When states argue the scarcity and constraints of resources to justify the restrictions on Social Rights, the combinations of scrutinies like the contents-control(Inhaltskontrolle) and the proportionality test can exercise to review the influences on budgetary allocation and financial distribution. In general, Judging Criteria on state's action to meet its obligation of fulfilling Social Rights would be the Untermaßverbot and when the Constitutional Court applies the Untermaßverbot to that kinds of cases, evaluating the suitability of the means will be the key. In that case, suitability test consists of “4A-sutability test: Availability, Accessibility, Acceptability, Adaptability”. When balancing a number of individual conditions of each case including type・quantity・quality of state actions, eligibility・conditions・ duration to receive benefits, the Constitutional Court can lower the scrutiny criterion to “evident control(Evidenzkontrolle)”. The Untermaßverbot combined with Evidenzkontrolle works as a modified forms as to “Reasonableness review”. In this “Reasonableness reivew”, Constitutional Court would examine investment adequacy, expenditure efficiency, expenditure equity on the basis of legislator's perception and prediction about the related case facts.
In constitutional adjudication of Social Rights, the burden of proof to justify the limitations of Social Rights is on states. Specially, State has to prove that it has investigated all relevant interests and weighed the importance and gravity(Abwägung) objectively and reasonably. In the courtroom, states have to persuade the public that it did its all obligation to fulfill Social Right by exercising all the consistent constitutional binding authorities. The burden of proof on states could be reinforced in some cases.
