DNA Analysis, which has been regarded as an industrial revolution in the field of forensic science and criminal justice system, stands unchallenged in identifying an individual, since Prof. A. Jeffrey succeeded in identifying a rape suspect with the DNA from a victim in 1985 and the bench of Florida took the DNA Analysis as a valid evidence in identifying an individual in 1987.
Especially DNA Analysis is a very useful method in telling suspects of homicides, robberies, rapes in which they usually leave bodily substances. The Justice Program of Solving Cold Cases with DNA analysis is a good example in the U.S. in recent years.
We got a useful method which can keep society safe from felon who has learned how to deal with traditional investigatory clues like finger prints and has made public and society shake in terror.
The usefulness of DNA Analysis continues. With much social concern for human rights, a forensic investigatory method is very important to overcome depending on the statement of suspects to solve cases. And DNA forensic analysis is a significant new method which made it possible to assess cases in scientific way with clues from crime scenes and to estimate of backlogs of cases involving DNA forensic evidence.
In addition, DNA analysis has been used by agencies in the criminal system to both convict the guilty and exonerate the innocent.
In Korea, we also face the terror of crime. With long depression since 1997, serious crimes without motives made public feel terrible and a series of shocking felonies happened. Existing criminal justice system looks no more use to cope with these serious crimes.
In order to keep our society safe like other developed, we need to put DNA analysis to practical use that has been a model of forensic analysis and evidence since 1990's.
Before getting far in forensic DNA analysis, we should examine it is possible to use forensic DNA analysis as an investigatory method in existing criminal justice system. Existing warrant system can restrict violation of human rights in the course of DNA forensic evidence collection, storage and analysis as a new method to collect and analyze criminal evidences. In the principle of non-mandatory research, to execute a warrant can be more effective to discover the material truth of cases.
To get far in forensic DNA analysis, it is necessary to find first some biological samples of suspects in the crime scene. With perfect forensic investigation in crime scene, investigators should find biological evidences, extract DNA data of suspects so that obtain figured DNA forensic analysis data.
The collected DNA reagent should be analyzed by professional analysts in reliable laboratories with official processes and technical equipment.
It is desired to analyze reagent in international authorized laboratories with authorized techniques. And the result of analysis also can be trusted in the criminal court. So laboratories should make efforts to satisfy the international authorized standard.
In order to make the collected evidence valid as a proof, not collecting of evidence but also the chain of custody like evidence(storage, analysis and production etc.) should be done transparent.
Regardless of theses conditions, the main issue to activate DNA forensic analysis is to expand the data bank of DNA information.
The more DNA data of ex-convicts, the more activation of DNA forensic analysis. Finally suspects can be caught in early stage to prevent making damage inflicted and the innocent can avoid being extorted to prove his alibi.
In this point of view, the U.K that adopted DNA forensic analysis early make collection and storage of DNA analysis data to all the recorded crime and the U.S that started later also expands the boundary of DNA collection and storage.
But, concerns for the invasion of privacy, the abuse of DNA data and the appearance of "Big Brother" make not a few disagreement to the criminal DNA collection and storage of convicts.
Considering the social damage, which is caused by 1,000 toll of homicides a year and much more 10,000 toll of rapes and robberies, difficulties in investigating roving crimes and effects of learning skills at prisons on crimes it is more necessary to control crimes by managing DNA forensic data.
But in order not to make this intention be awakened to human rights violations, the subject of collecting DNA forensic data should be restrict to the ex-convicts who had committed homicides, robberies, rapes and larceny-thefts, kiDNApping and organized crimes which show a tendency to be anti-social and to commit a second offense.
And the storage of DNA forensic data also should not be the DNA information itself but the figured DNA forensic data to identify the suspect with the reagent so that prevent abusing and draining the data and cope with invasion of privacy. After all the violation of human rights caused by DNA forensic data bank can not be worried.
In order to prevent abusing and draining the DNA data, it is necessary to divide DNA forensic data from individual information and to make the independent committee with the right to deliberate and to vote, control the whole work about DNA forensic data. So that the DNA forensic analysis can control social crime without invasions of human rights.
