공익사업에 있어서 정당한 영업 손실보상 저해요인에 관한 연구 = (A) study on the obstruction factors of the fair business loss compensation for public projects
This study was intended to contribute to just compensation for business loss by finding out the factors impedimental to it and complementing it.
For this purpose, it attempted to elicit the problems and suggestions for it through the analysis of cases, judicial precedents and questionnaire responses. And for empirical analysis, the questionnaire research was conducted. An attempt was made to extract the factor most impedimental to just compensation for business loss using AHP(Analytic Hierarchy Process) and elicit its improvement scheme.
In the AHP model, the factors impedimental to business loss were primarily classified into the legal · institutional aspect, the aspect of the project developer, the aspect of appraiser and the aspect of the indemnitee's liability. And three sub‧factors were selected as the those corresponding to each aspect, and an attempt was made to conduct research and analysis of their detailed contents.
An attempt was made to investigate the importance and influence(weight) of the factors impedimental to just compensation for business loss. The legal and institutional aspect ranked first, second and fourth of six upper elements of priority, the sub‧factors corresponding to the first classification, followed by the indemnitee and the project developer and the appraiser. This indicates that the factor impedimental to just compensation for business loss was the legal and institutional aspect, followed by indemnitee, project developer and appraiser's aspect. It was found that the deficiency of the regulations of the requirements for business loss compensation and of the detailed criterion and standard, of the impedimental factors of the legal and institutional aspect, acted as the biggest factor most impedimental to just compensation and made it confusing to make a judgement about the object related to compensation for business loss of the project developer.
In the above process, this study presented the improvement scheme based on the primary and secondary classification of the factors impedimental to just compensation for business loss and their contents. For this purpose, the improvement scheme of just compensation for business loss elicited from the results of cases and judicial precedents, and the contents of questionnaire responses as well as AHP analysis was divided into the legal and institutional aspect, the project developer aspect, the appraisal aspect and the indemnitee liability. And it was explained by dividing them into the legal and institutional aspect and the enforcement and operation and environment aspect of the law.
The improvement scheme for the legal and institutional aspect was presented as follows:
First, it is necessary to relax the requirements for compensation for business loss and detailed legal provisions.
It is necessary to enact the regulation covering special cases and provide for the object eligible for business loss compensation when a special sacrifice exceeding the endurance limit occurs as a result of leaving the project behind for a long time due to the project developer's liability.
And the requirement for business loss compensation is that the “business should continue with human and physical facilities at the legal place.” There have been many problems and matters to be improved and complemented. In keeping with the diverse changes of business behavior with the change of the times, it is thought that it is necessary to make the detailed guidelines for each business category and type and make compensation for business loss in compliance with them.
In case tenants have done their business in the unlicensed building since Jan 24, they are eligible for business loss compensation when they have the registration of entrepreneur one year before the notice date of project approval if other conditions are met. If the registration of entrepreneur and other conditions are met from the notice date of the project approval, it should be eligible for business loss compensation and the compensation limit of 10,000,000won should be adjusted upwards to fit the realities.
Second, it is necessary to extend and improve the period of compensation for business loss.
The period of business suspension should not uniformly be within three months but extend to more months according to business categories and facility sizes. And if all the matters are required within more than the period, it is possible to prove them and ask for this, which is cumbersome and uneasy. Accordingly, it is necessary to typify compensation for business loss by business category and by size and make the more reasonable and objective period of compensation.
Third, it is necessary to make the improvement scheme for premium compensation in relation to compensation for business loss.
It is necessary to make compensation for the premium widely known in practice by enacting the detailed regulation according to issues in terms of fair burden and the guarantee of property rights, the original intent of business loss compensation. And it is necessary to investigate the present situation of the giving and taking of the premium of the same business category, see it as the necessary expense accompanied beforehand and include it in the removal expense, and pay it in a form of allowance for the store removal by dividing it by area and by business category.
In addition, it is necessary to make compensation in case a considerable amount of sales is reduced in the temporarily installed business office, and it is necessary to complement it in relation to compensation for business loss outside the public-service project district.
