‘Who is a worker?’ and ‘Who is the worker's employer?’, to put it differently, ‘Who bears employer responsibilities towards the worker?’ are the basic and key questions that need to be asked when it comes to applying labor law. In the past when typical employer-employee relationships were based on labor contracts, it was clear who were subject to labor law and who should take the responsibilities imposed by law. However, as the industrial structure has changed and advances in information and communications technology have changed the way people work, labor contract-based typical employment relationships have dwindled and new kinds of service contracts have increased. As a result, types of employment have greatly diversified. This trend is also being accelerated by employers' gimmicks to avoid their responsibilities under labor law.
Dependent contractors usually work on a regular basis under a mandate or service contract with a particular business owner, are paid for the work they have done and live on such pay, and have their pay collectively and unilaterally determined, so they need to be protected by labor law. Nevertheless, the courts had consistently denied them the status of a worker under the Labor Standards Act and taken different positions, on a case-by-case basis, on their status as workers under the Trade Union and Labor Relations Adjustment Act (hereinafter referred to as “Trade Union Act”). However, in a recent case involving 88 country club, the court made clear that although golf caddies are not workers under the Labor Standards Act, they must be considered workers under the Trade Union Act given the legislative purpose of the Trade Union Act. This position seems to be due to the difference between the legislative purposes and intents of the Labor Standards Act and the Trade Union Act. In other words, the Labor Standards Act is meant to set minimum standards for labor conditions and punish any violation of those standards whereas the purpose of the Trade Union Act is to guarantee collective and autonomous determination of working conditions by ensuring equal bargaining powers for both labor and management. Therefore, the Trade Union Act does not require as strong employer-employee relationships as the Labor Standards Act does.
Other countries, too, are extending the application of labor law to dependent contractors by interpreting an existing law more broadly or enacting a new law. In the case of Japan, its Labor Union Act is actively interpreted so that it can apply to dependent contractors. Recently even convenience store franchisees have been recognized as workers under the Labor Union Act. Meanwhile, in Germany, the U.K., France and Canada, new legal provisions were introduced to extend statutory protection to dependent contractors. Legislation governing collective labor relations applies to dependent contractors in all these countries.
Given the cases of other countries and court rulings, dependent contractors should be included in the scope of workers subject to labor law in such a way that they are excluded from the application of the Labor Standards Act but are fully covered by the Trade Union Act. To do so, first, it is necessary to set up a research body, like the Japan Industrial Relations Research Association, and create criteria for interpreting the concept of a worker under the Trade Union Act so as to extend the application of labor law to dependent contractors using an interpretative approach. However, the range of dependent contractors is so wide that the interpretative approach would still have big limitations. Parallel efforts should be made to establish legislation that specifies the scope of dependent contractors subject to the Trade Union Act and matters concerning its application. Inserting a special provision applicable to dependent contractors into the Trade Union Act would be a reasonable way to establish such legislation.
Meanwhile, another aspect of the diversification of employment types is an increase in indirect employment that involves using workers belonging to someone else. A typical example of indirect employment is employment of dispatched workers. Another example is in-house subcontracting which is widespread across industries in Korea. An in-house subcontractor's workers perform their jobs in the workplace of the principal contractor and their work is closely linked to that of the principal contractor's workers, so their place of work and working time are both under the actual control of the principal contractor, resulting in something similar to indirect employment. In particular, in-house subcontracting in Korea is characterized by its long-term service. Many in-house subcontractors are exclusive ones that provide their services only to a particular principal contractor and in cases where peripheral work, such as cleaning and security guarding, is outsourced to a subcontractor, it frequently happens that the subcontractor's workers continue to work in the workplace of the principal contractor even after a change of subcontractor. Considering all this, in-house subcontracting which is neither a supply contract nor a project contract requiring completion of a task before a deadline but an arrangement for continuous provision of services seems to need regulation by law even if it is legitimate.
The Supreme Court ruled in the Hundai Heavy Industries case in 2010 that although the principal contractor is not in a labor contract-based relationship with its subcontractors' workers, it has responsibilities to them as a main agent controlling or intervening in their affairs under the Trade Union Act. And in its recent ruling on the 88 country club case, the Supreme Court reaffirmed its teleological interpretation recognizing a broader scope of workers under the Trade Union Act. These rulings are considered to have paved the way for a broader recognition of principal contractors' responsibilities under the Trade Union Act, that is, collective labor relations law. However, extending the application of labor law to in-house subcontractors' workers using an interpretative approach could raise controversy over the extent to which principal contractors' responsibilities can be recognized. After all, it would be necessary to clarify principal contractors' responsibilities towards their in-house subcontractors' workers using a legislative approach. Establishing a special law to protect in-house subcontractors' workers can be suggested as a solution to this.
누가 근로자인가 하는 문제와 누구의 근로자인가, 즉 근로자에 대한 사용자 책임을 누가 지는가 하는 문제는 노동법 적용의 기초이자 핵심적 과제이다. 과거 근로계약을 중심으로 한 전형적인 근로자와 사용자관계에서는 노동법 적용 대상이 명확했고, 그 책임의 주체도 명확하였다. 그러나 산업구조가 변하고 정보통신 기술의 발달로 일하는 방식도 변화하면서 전형적 근로계약관계는 줄어들고 새로운 노무제공 계약이 늘면서 고용형태는 매우 다양화해졌다. 또한 노동법상 책임을 회피하고자 하는 사용자의 전략이 이러한 추세를 가속화시키고 있다.
특수형태근로종사자는 특정 사업주와 위임이나 도급 계약을 맺고 노무를 상시적으로 공급하고, 그 댓가로 보수를 지급받으며 생활하고, 노무제공에 대한 댓가가 집단적, 일방적으로 정해지는 등 노동법상 보호를 필요로 하는 대상이다. 그러나 법원은 특수형태근로종사자에 대해 근로기준법상 근로자성을 일관되게 부정해 오고 있으며 노동조합법상 근로자는 사례별로 다른 입장을 취해왔다. 그런데 최근 88관광개발 사건에서 법원은 골프장 캐디를 근로기준법상 근로자는 아니지만 노동조합법의 입법목적을 고려할 때 노동조합법상 근로자로는 인정해야 한다는 입장을 명확히 하였다. 법원의 이러한 입장은 근로기준법과 노동조합법의 입법목적과 취지의 차이 때문인 것으로 보인다. 즉 근로기준법은 근로조건의 최저기준을 법률로 정하고 이에 위반할 경우 형벌의 적용까지 받도록 하는 것인데 비해, 노동조합법은 대등한 교섭력 확보를 통해 근로조건의 집단적, 자율적 결정을 할 수 있도록 보장하는데 목적이 있는 것으로 근로기준법만큼 근로자와 사용자간에 강한 사용종속관계가 있어야 하는 것은 아니기 때문이다.
외국의 경우도 특수형태근로종사자에 대해 해석이나 입법을 통해 노동법 적용을 확대해 나가고 있다. 일본의 경우는 최근 편의점 점주까지 노동조합법상 근로자로 인정하는 등 적극적으로 해석을 통해 노동조합법 적용을 확대해가고 있다. 독일, 영국, 프랑스, 캐나다의 경우 입법을 통해 특수형태근로종사자에 대한 법적용을 확대하고 있는데 집단적 노사관계법은 공통적으로 모두 적용하고 있다.
이러한 외국의 사례와 판례의 입장을 고려할 때, 특수형태근로종사자에 대해 근로기준법 적용은 제외하고 노동조합법은 전면적으로 적용하는 방식으로 노동법 적용 대상에 포함시킬 필요가 있다고 하겠다. 이를 위해 일단 해석론적 접근방식으로 적용대상을 넓혀가도록 일본의 노사관계법전문연구회와 같은 연구 기구를 두고 ‘노동조합법상 근로자 개념 판단기준’을 마련하는 것이 필요하다고 하겠다. 그러나 광범위한 특수형태근로종사자 범주를 고려할 때 해석론만으로는 한계가 크므로 입법을 통해 노동조합법을 적용할 특수형태근로종사자 범주와 법 적용사항을 명기하는 방안도 함께 추진해야 할 것이다. 입법은 노동조합법상 특수형태근로종사자에 대한 특례규정을 신설하는 방식으로 추진하는 것이 타당하다고 하겠다.
한편 고용형태다양화의 또 하나의 측면은 타인 소속 근로자의 노동력을 활용하는 간접고용의 증가이다. 간접고용의 전형적인 형태는 파견근로이다. 그런데 우리나라 산업 전반에 퍼져있는 사내하청의 경우도 노무제공이 원청 근로자의 사업장내에서 이루어지고 원청 근로자의 작업과 연계되어 이루어지기 때문에 노무제공 장소와 시간이 모두 원청 사업주의 실질적 지배력하에 놓이게 되어 간접고용과 유사한 결과를 초래하게 된다. 특히 우리나라 사내하청은 특정 원청 사업주에 대해서만 노무를 공급하는 원청전속형 하도급이 많고, 청소, 경비 같은 주변부 업무 위탁의 경우는 하청업체가 변경되어도 원청 사업장에 계속 근무하는 경우가 많아 노무제공의 장기성이 있다. 이러한 점을 고려할 때, 납품형 도급이나 기한내 일의 완성이라는 프로젝트형 도급이 아니라 노무의 지속적 제공형태인 사내하청에 대해서는 적법 도급이라 할지라도 일정한 법적 규율이 필요하다고 보인다.
2010년 현대중공업 판결에서 대법원은 원청 사업주에 대해 근로계약관계는 없지만 노동조합법상 지배ㆍ개입의 책임을 인정한 바 있고, 최근 88관광개발 판결에서 노동조합법상 근로자을 넓게 인정한 합목적적 해석을 다시 확인한 바 있다. 이를 계기로 집단적 노사관계법에 있어서는 원청사업주의 노동조합법상 책임을 보다 넓게 인정해나갈 수 있는 계기가 마련되었다고 판단된다. 그러나 해석론을 통한 적용확대는 구체적으로 어느 범위까지 원청사업주의 책임을 인정할 수 있는지에 대한 논란을 불러일으키게 되므로, 결국 입법론을 통한 원청사업주의 사내하청 근로자에 대한 책임을 명확히 할 필요가 있다고 판단된다. 이를 위해 특별법 형식의 사내하청 근로자 보호 법률안을 제안한다.
