This dissertation discusses how non-standard workers respond to precarious labor in times of unstable employment relations. It explores a decade's experiences of university facilities management workers in indirect subcontracted employment who experienced unionization and fragmentation. This study focuses on the intersections of solidarity and adversary actors in labor movements from the perspective of ‘multi-organizational field’ during the process of changing labor laws around the workplace.
For workers who are in unequal power relations with respect to capital, labor laws and labor unions are the minimum protective institutions that workers rely on to cope with the inequality. However, non-standard workers remain outside basic labor laws such as minimum legal wage and labor standard law, resulting in a low-density union for non-standard workers’. In many cases, workers in indirect employment relations can only be covered by labor laws through unionization.
This study deals with the entanglement of labor unions and labor laws, which are the institutional basis for protecting the basic rights of workers. This ‘entanglement’ is the multiple union system at the workplace level implemented in the law on July 2011 and brought about changes in the organizational form of labor unions. How did the amendments in labor laws that allowed the establishment of multiple trade unions in the workplace change the basis on which non-standard workers can respond to precarious labor? This study seeks the answers to the following questions by analyzing the actual workings of the multiple union system at the workplace focusing on the workers' experiences. Under what conditions, how do unions organize and split? What changes did the establishment of a new union bring to the workplace? What did these changes mean to the actors of the workplace?
This study identifies how changes in the system of ‘multiple unions’ affect workers’ behaviors, perceptions, and experiences. It is an attempt to interpret how labor unions are experienced in indirectly employed non-standard workers by analyzing the changes in the macro “institution” and the micro personal “life”. Through participant observation field research, my findings of the response to unstable labor relations by indirectly employed workers proceeded as follows.
First, in January 2008, indirectly employed workers in university facilities management service workplace organized a labor union based on ‘customer-driven organizing’ in solidarity with students, who are customers of facilities management services. Through the unionization, workers entered the system of labor law and obtained the basic rights of worker such as legal minimum wage. This unionization was a process in which ‘slaves’ who had been working with the loss of basic self-confidence in the structure of daily exploitation and abuses were recognized as ‘human beings’. Second, in July 2011, on the occasion of the implementation of the multiple union system, the ‘triangle alliance of dissatisfaction’ was formed among the prime contractor, subcontractor and workers who complained to the labor union. The labor union was divided through the ‘triangle alliance of dissatisfaction’. Before and after the implementation of the multiple union system, the prime contractor and subcontractor pursued a strategy to pursue management-led industrial relations by establishing company-friendly union and acquiring majority union status. To this end, the management prepared and did establish a second union through the recruitment and intimidation of the workers. Third, the second union, which failed to acquire the status of majority unions, pursued collusion with the prime contractor, while joining and switching the umbrella unions to survive. Fourth, workers experienced conflicts through the multiple union system, and the management pursued the union avoidance scheme by establishing a company-friendly union through the ‘divide and rule strategy’. In this process, workers' responses can be divided into two categories. The workers who remained in the existing union pursued a strategy to eliminate precariousness through negotiation and struggle with the company. The second union pursued a strategy to defend unstable jobs by colluding and adapting to the management. Fifth, the expansion of the rights of the workers through the multiple union system remained at a superficial level, and the second union, which failed to acquire the right to bargain, took the form of a non-standard workers’ atypical labor union that emphasizes the welfare of the union members through collusion with capital.
Overall, this study shows that the implementation of the multiple union system at the workplace level functioned as an institutional device to establish company-friendly unions for the capital and the occasion of fragmentation to the workers in the process of responding to precarious work of indirectly employed non-standard workers. The system initially aimed at revitalizing the labor movements and improving working conditions through the free establishment of labor unions and sound competition between the unions. However, in reality, the number of unions has increased due to the splits of existing unions, but the density has not risen and we witness the prevalence of capital’s union avoidance strategy by establishing management-friendly unions. This means that the labor unions’ power has weakened and the system is becoming a big obstacle to the non-standard workers’ labor movements.
Consequently, the non-standard workers’ labor movements came to a crisis in the multiple union system, originally expected to bring about the revitalization of the workers' movement, through the intervention of the capital and the collusion of labor with capital. This is an unintended consequence of the new labor law and a paradoxical phenomenon in the multi-organizational field of non-standard workers’ labor movements.
이 논문은 노동의 힘이 점점 쇠퇴해가는 불안정 노동의 시대에 비정규직 노동자가 불안정 노동에 어떻게 대응하는지를 다루는 연구이다. 이를 위해 이 연구는 대학의 시설관리서비스작업장에서 일하는 간접고용 노동자들의 노동조합 조직화와 분열, 그리고 복수노조 제도 하 신생 노동조합의 설립을 둘러싼 최근 10여년의 경험을 집중적으로 들여다보았다. 이 연구는 비정규직 노동자의 불안정 노동에 대한 대응과 작업장을 둘러싼 노동관련법률의 제도 변화 과정에서 사회운동의 ‘복합적 조직의 현장’(multi-organizational field)의 관점을 통해 노동운동의 연대와 적대 행위자의 뒤얽힘을 주목한다.
자본과의 관계에서 불평등한 권력관계에 놓여있는 노동자가 불평등에 대처할 수 있는 최소한의 제도적 보호 장치로 여겨지는 것은 노동법과 노동조합이다. 그러나 오늘날 비정규직 노동자들은 최저임금법이나 근로기준법 등 가장 기초적 수준의 노동법의 보호로부터 벗어나 있으며, 노동조합 조직률도 매우 낮은 수준이다. 이러한 상황 속에서 간접고용 상태의 대학 시설관리노동자들의 조직화는 노동조합 조직화를 통해 비로소 노동법의 적용을 받게 되었다는 점에서 비정규직 노동자가 불안정 노동에 대응할 수 있는 운동 조직의 탄생을 의미했다. 비정규직 노동자의 불안정 노동에 대한 대응의 동학에서 이 연구가 특히 주목하고자 하는 부분은 노동자의 권리 보호에 중요한 제도적 기반인 ‘노동조합’과 ‘노동법’의 뒤얽힘이다. 이 뒤얽힘은 2011년 7월 시행된 사업장 단위 복수노조제도의 시행이다. 사업장 단위에서 여러 개의 노동조합의 설립을 가능케 한 노동법의 변경은 비정규직 노동자들이 불안정 노동에 대응할 수 있는 토대를 어떻게 변화시켰는가?
이 연구는 사업장 단위 복수노조 제도의 실제 작동을 노동자들의 경험을 중심으로 분석하면서 이 질문에 대한 답을 구한다. 이러한 질문은 어떤 조건 하에서 어떻게 노동조합이 조직화되고, 분열되는가? 신생노조가 설립되어 사업장 단위 복수노조 체제가 형성되는 과정은 어떠한가? 그리고 그 조직화는 노동현장에 어떤 변화를 가져왔으며, 작업장의 구성원들에게 그 변화의 의미는 무엇이었는가를 묻는다. 이를 통해 이 연구는 ‘복수노조’라는 제도의 변화가 노동자들의 행위, 인식, 경험에 어떤 영향을 미치는가를 파악한다. 이는 곧 거시적인 ‘제도’의 변화와 미시적인 ‘개인’의 삶의 맞물림을 분석하면서 비정규직 불안정 노동자에게 노동조합은 어떤 의미로 경험되는가를 해석하려는 시도이다.
참여관찰 현장연구를 통해 살펴본 비정규직 노동자의 불안정 노동에 대한 대응은 다음과 같이 진행되었다. 첫째, 2008년, 간접고용 상태의 대학 시설관리서비스작업장의 노동자들은 시설관리서비스의 고객인 학생들과의 연대로 ‘고객 주도형 조직화(customer-driven organizing)’에 기반한 노동조합을 조직화하였다. 노동자들은 노동조합 조직화를 통해 비로소 노동법의 체계 내에 진입하여 최저임금제 등의 권리를 획득하였다. 이 과정은 일상적인 착취와 학대의 구조 속에서 기본적 자신감을 상실한 채로 노동하던 ‘노예’가 ‘사람됨’을 인정받는 과정이었다. 둘째, 2011년 7월 복수노조 제도 시행을 전후하여 노동조합에 불만을 품고 있던 원청과 용역회사, 노동자 사이의 ‘불만족의 삼각동맹’이 형성되었고, 이를 통해 기존 노조가 분열하였다. 자본은 복수노조제도의 등장을 전후하여 사측에 우호적인 노조를 설립하고 다수 노조 지위를 획득함으로써 자본 주도의 노사관계를 추구하려는 전략을 추구했다. 이를 위해 자본은 노조에 불만이 존재하고 사측에 우호적인 노동자들을 포섭하여 사측 주도의 노동조합을 설립을 준비하고 노동자에 대한 회유‧협박을 통해 제 2노조를 출범시켰다. 셋째, 다수노조 지위 획득에 실패한 제 2노조는 조직의 생존을 위해 상급단체 가입 및 상급단체 갈아타기를 하면서 원청과 담합을 추구하였다. 넷째, 복수노조제도를 통해 노동자들은 갈등을 경험하였고 자본은 분할지배를 통해 사측에 우호적인 노조를 설립함으로써 노조회피전략을 추구하였다. 이 과정에서 노동자들의 대응은 두 가지로 나누어 볼 수 있다. 민주노조에 잔류한 노동자는 사측과의 교섭과 투쟁을 통해 노동의 불안정성을 제거하려는 전략을 추구하였고, 제 2노조는 자본과 담합하고 순응함으로써 불안정한 일자리를 지키려는 전략을 추구하였다. 다섯째, 복수노조 제도를 통한 노동자의 권리 확대는 표면적인 수준에 머물게 되었고, 교섭권을 확보하지 못한 제 2노조는 자본과 담합하면서 조합원의 복지를 강조하는 비정형적인 비정규직 노조 형태를 보여주었다.
종합적으로 이 연구는 간접고용 비정규직 노동자의 불안정 노동에 대한 대응과정에서 사업장 단위 복수노조 제도의 시행이 자본에게는 사측에 우호적인 노조를 설립할 수 있는 제도적 장치로 기능했으며, 노동에게는 분열의 계기로 작동했음을 밝힌다. 복수노조제도는 당초 노동조합의 자유로운 설립과 노조 간 건전한 경쟁으로 노동운동의 활성화와 노동조건의 개선을 목표로 하였다. 그러나 현실에서는 기존 노조의 분열로 노조의 수는 증가했으나 노조조직률은 상승하지 않았고 사측의 분할지배 전략의 노골화와 노노 갈등의 양상이 더 많이 관찰되었다. 이는 곧 노동의 단결력이 약화되면서 비정규직 노동운동에 큰 걸림돌이 되고 있음을 의미한다. 비정규직 노동운동의 활성화를 가져다 줄 것으로 예상되었던 복수노조제도는 비정규직 노동운동의 적대 상대방인 자본의 개입과 노동의 담합을 가능케 하였다. 이처럼 복수노조제도를 통해 노동운동이 위기를 맞게 되는 경험은 제도 시행의 의도치 않은 결과인 동시에 하나의 역설적인 현상이라고 평가할 수 있다.
