플랫폼노동종사자의 법적 보호방안에 관한 연구
With the Sharing Economy, epoch-making changes take place all around the world. A key area of concern regards the legal status of workers who provide their services to consumers through online platforms. The platforms match workers with clients and provide the infrastructure and the governance conditions for the exchange of work and related compensation.
Traditionally, the legal concepts of ‘employer’, ‘employee’ and ‘the employment relationship’ have been used to define the scope of labor law, differentiating between employees (subordinate and dependent workers) and independent contractors.
The Problem is whether platform workers should be considered employees or independent contractors. There is little agreement on how to classify these workers in traditional employment relations. The platforms have usually classified workers as independent contractors, making them ineligible for most employee benefits and labor protections.
Platform workers are at risk of lacking both the flexibility of traditional autonomous work and the security of an employment relationship.
The legal status of platform workers is ambiguous because they don't fall employees under the labor law, but have an intermediary or dual status, with characteristics similar to those of employers, employees, and the self-employed. If platform workers are self-employed, as is often assumed, then they would have the responsibility to arrange their own protection and insurances.
In Korea, there are recently heated debates about the employment status of platform workers and protection for them; however, it lacks of firm theories and understandings regarding the legal status of them. In particular, platform workers cannot be classified as employee under the terms of Labor Standards Act.
It may be possible to examine whether platform workers are considered independent contractors; however, platform workers cannot fulfil the requirement of independent contractors in terms of the Industrial Accident Compensation Insurance Act. Besides under this Act, only nine types of independent contractors are protected.
Therefore, it is necessary to consider another measures to apply the Industrial Accident Insurance Act to platform workers, such as by expanding the scope of independent contractors, abolishing exclusiveness belongingness to a certain employers, and introducing compulsory subscription to Industrial Accident Insurance Act.
Or, platform workers can be protected as employees if the existing criteria of employees are expanded by the supreme court's interpretation. Employment law could be reformed to shift classification towards a recognition of vulnerability.
Platform-dependent workers are much more vulnerable in terms of their health and financial security. Then these persons can be treated as employees but with special minimum wages set according to their sector of occupation.
And the risk of unemployment of platform workers is higher than that of employees. Therefore, for the protection of platform workers, it is necessary to introduce compulsory employment insurance for them.
Although protection for these workers is not of the same extent of the protection of regular employees, the issue shouldn't be viewed in terms of the traditional employment relations framework.
The new proposal to design and reform social security in a way that would extend rights to a growing population of non-standard workers is a desirable move towards improving social protection in the platform economy.
