문화재 보호를 위한 사업 집행형 신탁제도에 관한 연구 = A Study on Business Performing Trust System for Protecting Cultural Properties

문화적 이익을 확보하기 위해서는 문화재의 소유권의 내용을 제한하고 보존 및 활용을 확보할 필요성이 있다. 이러한 목적으로 문화재의 소유권의 내용을 제한하는 수단으로 공익신탁 제도가 있다. 본 연구에서는 먼저 문화재의 소유권을 제한하는 수단으로서의 공익신탁의 구조, 이용 현황 및 효과에 대해 개관하고 연구방향을 제시하였다.
현행 법제도는 자연유산과 문화유산을 보전하기 위하여 여러 가지 장치들을 갖추고 있다. 자연환경보전법, 습지보전법, 특정도서생태계보전법 또는 문화재보호법 등이 그 예이다. 그러나 이러한 법들은 자연유산과 문화유산들에 대한 개발행위들을 제한하는 규제조치들을 중심으로 짜여 있다. 그러나 금지와 규제의 법률들만으로는 현실적인 개발압력을 극복하기 어렵다. 토지나 건축물 등의 소유자에게 당장의 개발이익을 멀리하고 보전이익을 추구하라고 기대한다는 것은 억측이고 무리이다. 그렇다면 꼭 보전하여야 할 유산들은 이를 개인의 소유물로 남겨두지 말고 국민일반의 즉, 공공의 소유물로 전환시켜야 한다. 이때 유용한 개념이 외국에서 널리 활용되는 공익신탁 제도임을 확인하였다.
자연자원이나 문화재를 공공의 소유물로 전환하기 위하여서는 국가나 지방자치단체가 해당 재산을 직접 수용하거나 매입하는 방법을 취할 수 있다. 그러나 공용수용의 방식은 특정한 공익사업을 위하여 필요한 부지를 확보하는 방법이기 때문에 어떠한 자연자원이나 문화재 자체를 보전하기 위한 방법으로 부적절하다. 또 공공의 재정에 의한 직접매입 방법은 본질적으로 재원의 한계가 있고 재정운용 순위에서도 뒤쳐지기 쉽다. 공익신탁(National Trust 또는 Public Trust) 제도는 바로 이러한 부적절함의 한계를 극복하기 위한 대안이 될 수 있다.
공익신탁이란 자연자원 또는 문화재 등의 보전에 관심이 있는 시민들이나 기업들이 정부와 함께 협동체를 구성하여 보전가치가 있는 유산을 구입하여 이를 신탁 설정함으로써 미래 세대들을 위한 유산으로 남겨두는 장치를 말한다. 재산을 보유하고 있던 원래의 소유자들이 해당 재산 등을 신탁재단에 기부하는 민간 매입 못지않게 큰 비중을 차지한다. 매매나 증여가 어려울 경우에는 당사자들끼리 임대차계약을 체결하거나 관리계약을 맺어 보전에 기여할 수도 있다.
공익신탁 제도를 활성화시키기 위하여 새로운 법제화를 추진할 것인가 아니면 기존의 법제도를 이용할 것인가의 문제는 정책적 판단에 속하는 문제이다. 현재도 일부 지역이나 단체들은 사단법인이나 재단법인을 설립하여 공익신탁 운동과 같은 목표를 추구한다. 또 신탁법은 공익신탁과 같은 장치들을 두고 있다. 그러나 종래의 방식들은 모두 일정한 한계를 지닌다. 사단법인은 사람들의 모임이기 때문에 자연자원이나 문화재를 매입하거나 보전하는데 어려움이 있다. 재단법인은 사단보다 안정성이 있으나 토지나 재산의 보유에 일정한 제한을 받으며 또 영리사업이 제한된다. 신탁법은 토지나 재산의 증여 또는 매입에 대한 세제혜택이 미흡하고 신탁재산에 대한 안전장치가 부족하다. 결국 공익신탁 제도의 활성화가 문제로 등장하게 된다.
영국, 미국 등 선진국에서 시행되고 있는 공익신탁 제도는 종래의 법제도가 안고 있는 여러 가지 문제점들을 한꺼번에 해결할 수 있다는 장점이 있다. 즉, 취득재산에 대한 제한을 풀고 세제혜택을 부여할 수 있으며 그 신탁재산을 토대로 수익사업을 운영함으로서 신탁유지 비용을 확보할 수도 있다. 그리고 공익신탁을 위한 별도의 법률이 제정될 경우에는 신탁재산이 안전하게 유지될 수 있는 잠금장치를 둘 수 있고 개발법제 등에 맞설 수 있는 대항력을 규정할 수도 있다. 공익신탁을 위한 별도의 법을 제정한다 하더라도 국토계획에 우선할 수 있는 법적 대항력을 확보하기는 힘들지만, 별도의 법이 제정된다면 개발계획과 보전계획이 협의를 통하여 서로의 목표와 수단 들을 조정할 수 있는 장치를 입법화시킬 수 있다. 따라서 공익신탁 제도를 활성화 할 수 있는 강력한 법적 틀을 만들 필요가 있고 이런 측면에서 본 연구가 의의를 갖는다.
In order to secure cultural interests, it is necessary to restrict ownership of cultural properties and secure preservation and utilization. For this purpose, there is a public trust system as a means of restricting ownership of cultural properties. In this study, first, an overview of the structure of public interest trusts as a means of restricting ownership of cultural properties, their use status, and effects, and the research direction of this proposal was presented.
The current legal system is equipped with a number of mechanisms to preserve natural and cultural heritage. Examples include the Natural Environment Conservation Act, the Wetland Conservation Act, the Specific Islands Ecosystem Conservation Act, or the Cultural Heritage Protection Act. However, these Acts are structured around regulatory measures restricting the development of natural and cultural heritages. However, it is difficult to overcome development pressures only with laws of prohibition and regulation. It is speculative and unreasonable to expect owners of land or buildings to avoid immediate development profits and pursue conservation profits. If so, the heritages that must be preserved should not be left as private property, but should be converted into public property. At this time, it was confirmed that a useful concept was a public trust system widely used in foreign countries.
In order to convert natural resources or cultural properties into public property, the state or local government may take the method of directly accommodating or purchasing the property. However, since the method of public accommodation is a method of securing a site necessary for a specific public service, it is inappropriate as a method for preserving any natural resource or cultural property itself. In addition, the direct purchase method through public finance has inherently limited financial resources and tends to lag behind in the ranking of financial management. The National Trust (or Public Trust) system can be an alternative to overcome the limitations of this inadequacy.
A public trust refers to a device in which citizens or companies interested in the conservation of natural resources or cultural properties form a cooperative with the government to purchase a heritage with conservation value and establish a trust to leave it as a legacy for future generations. The original owners who owned the property accounted for as much as private purchases by donating the property to the trust foundation. If it is difficult to sell or donate, the parties may conclude a lease or management contract to contribute to the conservation.
The question of whether to promote a new legal system or use an existing legal system to revitalize the public trust system is a matter of policy judgment. Even now, some regions and organizations have established corporate judicial or foundations to pursue the same goals as the public interest trust movement. In addition, the trust law has the same devices as public trust. However, all of the conventional methods have certain limitations. Since the incorporated association is a gathering of people, it is difficult to purchase or preserve natural resources or cultural properties. Although the incorporated foundation is more stable than the division, it is subject to certain restrictions on the possession of land or property, and the for-profit business is restricted. The Trust Act lacks tax incentives for the donation or purchase of land or property, and lacks safeguards for trust property. Eventually, the activation of the public trust system emerged as a problem.
The public trust system implemented in advanced countries such as the United Kingdom and the United States has the advantage of being able to solve various problems of the conventional legal system at once. In other words, it is possible to remove restrictions on acquired property and grant tax incentives, and secure the cost of maintaining the trust by operating a profitable business based on the trust property. In addition, when a separate law for public trust is enacted, a locking device can be placed to keep the trust property safe, and the countermeasure against the development legislation can be prescribed. Although it is difficult to secure legal countermeasures that can prioritize national territorial planning, development plans and conservation plans can legislate a mechanism to coordinate each other’s goals and means through consultation. Therefore, it is necessary to create a strong legal framework that can revitalize the public trust system, and this study is significant in this respect.
